2 1 EP B1 2 Description BACKGROUND OF THE INVENTION 1. Field of the Invention [0001] This invention relates to connecting of telephone calls and, more particularly, to connecting of telephone calls over internet protocol networks. 2. Background Information [0002] The traditional telephone network is a switched network that provides users with a dedicated end-to-end circuit for the duration of each call. Circuits are reserved between the originating switch, tandem switches (if any), and the terminating switch based on the called party number to create the end-to-end circuit. [0003] Recently, telephone calls have been transmitted over digital networks using packet switched internet protocol (IP) networks, termed voice over IP (VoIP) transmission. Packet-switched IP networks provide shared, virtual circuit connections between users. Voice information to be transmitted across an IP network is converted into digital data and broken up into multiple, discrete packets. Individual packets may travel over different network paths to reach the final destination where the packets are reassembled in the proper sequence to reconstruct the original voice information. The transmission speed between any two users can change dramatically based on the dynamic number of users sharing the common transmission medium, their bandwidth requirements, the capacity of the transmission medium, and the efficiency of the network routing and design. [0004] VoIP transmission typically costs less than transmission over traditional public switched telephone networks (PSTNs). A disadvantage of VoIP networks is the variability of the quality of the signal received at the destination as determined by changing network conditions. The received signal quality depends on a large number of variable network factors such as packet loss, packet latency, queuing delay, and bandwidth availability. These network factors will vary depending on the volume of network traffic and the location of the destination. The IP network, unlike the traditional public switched network, is not uniformly or predictably suitable for voice quality transmission. [000] Prior art systems for connecting calls over IP networks have monitored the quality of service (QoS) provided by the network and disabled the gateway to the IP network when QoS fell below an acceptable level. However, QoS is not a uniform characteristic in an IP network. QoS is dependent on the destination and it may be unacceptable for transmissions to one destination but be acceptable to another destination. WO 97/27692 discloses an Internet telecommunications system that monitors multiple IP routes and determines which to use based on which will take the least time. US,6, discloses an access module that is connected to several networks of different types where the access module selects a network to carry communication traffic based on the quality provided by the networks. T.F. Houghton, et al., "A Packet Telephony Gateway for Public Network Operators," XVI World Telecom Congress Proceedings, pages 3-44, discloses a gateway that can be connected to multiple data networks and reroute calls between these networks to compensate for variations in quality. [0006] The present invention provides an apparatus according to claim 1 that causes alternate connection of a telephone call directed to an IP network if the quality of service provided by the IP network is less than a predetermined threshold. BRIEF DESCRIPTION OF THE DRAWINGS [0007] Figure 1 shows an embodiment of the invention. Figure 2 shows a second embodiment of the invention that uses an ISDN PRI interface. Figure 3 shows a third embodiment of the invention that uses an analog trunk loop back path. DETAILED DESCRIPTION OF THE INVENTION [0008] The present invention provides a method and apparatus for monitoring the quality of service (QoS) of the internet protocol (IP) network and connecting a telephone call over an alternate network, on a call by call basis, if the QoS of the IP network is unacceptable based on the destination for the call. [0009] Figure 1 is an exemplary system for providing voice over IP (VoIP). The system includes a call processor 0 that receives a telephone call from a local user 1, including a destination telephone number, and a plurality of network interface cards 2, 4 to provide connections to networks 6, 8 capable of carrying telephone calls, including at least one network interface card 4 that provides a connection to an IP network 8. The call processor 0 uses the telephone number of the received call to consult a routing table 1 and identify a network interface card 2, 4 that can provide a connection for the telephone call. [00] A network interface card 4 that provides a connection to the IP network 8 and contains an embodiment of the present invention, will cause a call directed to the card to be redirected to a different network 6 if the QoS for the call will be below the desired threshold based on the destination of the call. The IP interface card 4 receives the call to be connected through the IP network 8 and a desired QoS for the call. The desired QoS may be received with the call, or in advance of the call as a general level of QoS desired, possibly based on one or more call characteristics. The 2

3 3 EP B1 4 IP network card 4 uses the destination of the call to be connected to consult statistics collected by a network monitor 122 that runs on the card. The statistics for the IP network 8 QoS to the destination of the call to be routed are compared to the desired QoS for the call. If the QoS that the IP network 8 has provided recently for test packets to the destination of the call to be routed is less than the desired QoS threshold, then the call is returned to the call processor 0 to be connected through another network 6. Otherwise, the call is connected through the IP network 8. [0011] Figure 2 shows an embodiment of the invention in which the IP network card 4 is an integrated services digital network (ISDN) to IP gateway that provides a primary rate interface (PRI) to the call processor. In this embodiment, the IP network interface 4 sends an ISDN call reject signal to the call processor 0 if the call cannot be connected through the IP network 8 because of a low QoS. The call processor 0 will then use an alternate connection through another network interface 2 according to ISDN protocol. [0012] Figure 3 shows another embodiment of the invention in which the IP network interface 4 emulates an analog trunk interface. In this embodiment, the IP network interface 4 contains a loop back path that allows the IP network interface 4 to send a call to the call processor 0. If the call cannot be connected through the IP network 8 because of a low QoS, the IP network interface 4 will connect the call to the call processor 0 through the loop back path and give the call a special number to force a connection through an alternate network 6. In one embodiment, the special number includes a special prefix, such as 9999, that is placed at the front of the original called number. When the call processor 0 receives the looped back call, it directs the call to an alternate network interface 2 because of the special called number that was attached to the call by the network card. The looped back call is not distinguishable from other calls received by the call processor 0 except for the special routing number. The following is an exemplary call setup sequence for fall back to PSTN of a call directed to the IP network in an embodiment of the invention emulating an analog trunk interface: Step 1: Step 2: A user 1 calls a destination by dialing a number such as " "; The call processor 0 receives the call and, based on the prefix of the dialed number, the call processor 0 finds a matching entry in a routing table 1 and directs the call to the IP network interface 4; Step 4: Step : Step 6: If the QoS is less than a supplied desired QoS threshold, the IP network interface 4 inserts the special prefix "9999" in the dialed number and connects the call to the call processor 0 through a loop back path; The call processor 0 receives the call generated by the IP network interface 4 with the called party number of " "; The call processor 0 finds a matching entry in the routing table 1 for the special prefix "9999," and, based on the routing information, the call processor deletes the first five digits and directs a call to " " to the PSTN network interface 2. [0013] While certain exemplary embodiments have been described and shown in the accompanying drawings, it is to be understood that such embodiments are merely illustrative of and not restrictive on the broad invention, and that this invention not be limited to the specific constructions and arrangements shown and described, since various other modifications may occur to those ordinarily skilled in the art. Claims 1. An apparatus comprising: a network monitor (122) adapted to measure a transmission rating factor for an IP network (8); a comparator, coupled to the network monitor (122), adapted to compare a desired transmission rating factor to the measured transmission rating factor for the IP network (8); and characterized by an IP network interface (4), coupled to the comparator, to an originating system (0), and to the IP network (8), adapted to receive a telephone call for a dialed number from the originating system (0), and adapted to cause the originating system (0) to connect the telephone call through a first network (6) that is coupled to the originating system (0) if the measured transmission rating factor for the IP network (8) is less than the desired transmission rating factor, and adapted to connect the telephone call through the IP network (8) otherwise. Step 3: The IP network interface 4 tests the QoS statistics generated by the network monitor 122 for the destination IP address of the call; 2. The apparatus of claim 1, where the IP network interface (4) is further adapted to replace the dialed number with a special number based on the dialed number and to connect the telephone call for the 3

4 EP B1 6 special number to the originating system (0) if the measured transmission rating factor for the IP network (8) is less than the desired transmission rating factor. 3. The apparatus of claim 2, where the IP network interface (4) is further adapted to append the dialed number to a special fall back location code. 4. The apparatus of claim 1, where the IP network interface (4) is further adapted to return an ISDN call reject signal to the originating system (0) if the measured transmission rating factor for the IP network (8) is less than the desired transmission rating factor.. The apparatus of claim 1, where the network monitor (122) adapted to periodically measure transmission characteristics for test packets sent to a destination IP address associated with the telephone call. 6. A telephone system comprising: 1 the first network (6) further comprises replacing the dialed number with a special number based on the dialed number and connecting the telephone call for the special number to the originating system (0). 9. The method of claim 8, where replacing the dialed number with the special number further comprises appending the dialed number to a special fall back location code.. The method of claim 7, where causing the originating system (0) to connect the telephone call through the first network (6) further comprises returning an ISDN call reject signal to the originating system (0). 11. The method of claim 7, where measuring the transmission rating factor further comprises periodically measuring transmission characteristics for test packets sent to a destination IP address associated with the telephone call. a plurality of network cards including a first network card and an IP network card; a call processor adapted to receive a telephone call including a dialed number and directs the telephone call to one of said plurality of network cards; the IP network card comprising an apparatus as claimed in claims 1 to. 7. A method of connecting a telephone call for a dialed number through one of a first network (6) and an IP network (8), comprising: receiving the telephone call to be connected from an originating system (0); receiving a desired transmission rating factor; measuring a transmission rating factor for the IP network (8); comparing the desired transmission rating factor to the measured transmission rating factor for the IP network (8); and characterized by causing the originating system (0) to route the telephone call through the first network (6) that is coupled to the originating system (0) if the measured transmission rating factor for the IP network (8) is less than the desired transmission rating factor; and connecting the telephone call through the IP network (8) otherwise. 8. The method of claim 7, where causing the originating system (0) to route the telephone call through Patentansprüche 1. Vorrichtung nach Anspruch 1, bei der die IP-Netzschnittstelle (4) weiterhin so ausgebildet ist, dass sie die gewählte Nummer durch eine spezielle Nummer auf der Grundlage der gewählten Nummer 4

5 7 EP B1 8 ersetzt und den Telefonanruf für die spezielle Nummer mit dem Ursprungssystem verbindet, wenn der gemessene Übertragungs-Bewertungsfaktor für das IP-Netz (8) kleiner als der gewünschte Übertragungs-Bewertungsfaktor ist. 3. Vorrichtung nach Anspruch 2, bei der die IP-Netzschnittstelle (4) weiterhin so ausgebildet ist, dass sie die gewählte Nummer an einen speziellen Rückfall-Lokalisierungscode anhängt. 4. Vorrichtung nach Anspruch 1, bei der die IP-Netzschnittstelle (4) zur Zurücklieferung eines ISDN-Anruf-Zurückweisungssignals an das Ursprungssystem (0) ausgebildet ist, wenn der gemessene Übertragungs-Bewertungsfaktor für das IP-Netz (8) kleiner als der gewünschte Übertragungs-Bewertungsfaktor ist.. Vorrichtung nach Anspruch 1, bei der die Netzüberwachung (122) zur periodischen Messung der Übertragungscharakteristik für Testpakete ausgebildet ist, die an eine dem Telefonanruf zugeordnete Ziel-IP-Adresse gesandt werden. 6. Telefonsystem mit: 1 2 IP-Netz (8) kleiner als der gewünschte Übertragungs-Bewertungsfaktor ist; und andernfalls verbinden des Telefonanrufs über das IP-Netz (8). 8. Verfahren nach Anspruch 7, bei dem das Bewirken des Lenkens des Telefonanrufs über das erste Netz (8) durch das Ursprungssystem (0) weiterhin das Ersetzen der gewählten Nummer durch eine spezielle Nummer auf der Grundlage der gewählten Nummer und das Verbinden des Telefonanrufs für die spezielle Nummer mit dem Ursprungssystem (0) umfasst. 9. Verfahren nach Anspruch 8, bei dem das Ersetzen der gewählten Nummer durch die spezielle Nummer das Anhängen der gewählten Nummer an einen speziellen Rückfall-Lokalisierungscode umfasst.. Verfahren nach Anspruch 7, bei dem das Bewirken der Verbindung des Telefonanrufs über das erste Netz (6) durch das Ursprungssystem (0) weiterhin die Rücklieferung eines ISDN-Anruf-Zurückweisungssignals an das Ursprungssystem (0) umfasst. einer Anzahl von Netzkarten, die eine erste Netzkarte und eine IP-Netzkarte einschließen; einem Vermittlungsprozessor, der zum Empfang eines eine gewählte Nummer einschließenden Telefonanrufs ausgebildet ist, und den Telefonanruf an eine der Anzahl von Netzkarten lenkt; wobei die IP-Netzkarte eine Vorrichtung nach einem der Ansprüche 1 bis umfasst. 7. Verfahren zum Verbinden eines Telefonanrufs für eine gewählte Nummer, über eine erstes Netz (6) oder ein IP-Netz (8), mit den folgenden Schritten: Empfangen des zu verbindenden Telefonanrufs von einem Ursprungssystem (0); Empfangen eines gewünschten Übertragungs- Bewertungsfaktors; Messen eines Übertragungs-Bewertungsfaktors für das IP-Netz (8); Vergleichen des gewünschten Übertragungs- Bewertungsfaktors mit dem gemessenen Übertragungs-Bewertungsfaktor für das IP-Netz (8); und gekennzeichnet durch: Bewirken, dass das Ursprungssystem (0) den Telefonanruf über das erste Netz (6) lenkt, das mit dem Ursprungssystem (0) gekoppelt ist, wenn der gemessene Übertragungs-Bewertungsfaktor für das Verfahren nach Anspruch 7, bei dem die Messung des Übertragungs-Bewertungsfaktors weiterhin die periodische Messung der Übertragungscharakteristik für Testpakete umfasst, die zu einer dem Telefonanruf zugeordneten Ziel-IP-Adresse gesandt werden. Revendications 1. L'appareil de la revendication 1, dans lequel l'interface de réseau IP (4) est en outre adaptée pour remplacer le numéro composé par un numéro spécial sur la base du numéro composé, et pour connecter l'appel téléphonique pour le numéro spécial au système de départ d'appel (0) si le facteur d'évaluation de transmission mesuré pour le réseau IP (8) est inférieur au facteur d'évaluation de transmission désiré. 3. L'appareil de la revendication 2, dans lequel l'interface de réseau IP (4) est en outre adaptée pour annexer le numéro composé à un code d'emplacement de repli spécial. 4. L'appareil de la revendication 1, dans lequel l'interface de réseau IP (4) est en outre adaptée pour retourner au système de départ d'appel (0) un signal de rejet d'appel RNIS si le facteur d'évaluation de transmission mesuré pour le réseau IP (8) est inférieur au facteur d'évaluation de transmission désiré.. L'appareil de la revendication 1, dans lequel le dispositif d'observation de réseau (122) est adapté pour mesurer périodiquement des caractéristiques de transmission pour des paquets de texte envoyés vers une adresse IP de destination associée à l'appel téléphonique. 6. Un système téléphonique comprenant : une multiplicité de cartes de réseau incluant une première carte de réseau et une carte de réseau IP; un processeur d'appels adapté pour recevoir un appel téléphonique incluant un numéro composé et pour diriger l'appel téléphonique vers l'une de la multiplicité de cartes de réseau; la carte de réseau IP comprenant un appareil selon les revendications 1 à on compare le facteur d'évaluation de transmission désiré au facteur d'évaluation de transmission mesuré pour le réseau IP (8); et caractérisé en ce que on commande au système de départ d'appel (0) d'acheminer l'appel téléphonique par l'intermédiaire du premier réseau (6) qui est couplé au système de départ d'appel (0) si le facteur d'évaluation de transmission mesuré pour le réseau IP (8) est inférieur au facteur d'évaluation de transmission désiré; et on connecte l'appel téléphonique par l'intermédiaire du réseau IP (8) dans le cas contraire. 8. Le procédé de la revendication 7, dans lequel l'étape consistant à commander au système de départ d'appel (0) d'acheminer l'appel téléphonique par l'intermédiaire du premier réseau (6) comprend en outre le remplacement du numéro composé par un numéro spécial sur la base du le numéro composé, et la connexion au système de départ d'appel (0) de l'appel téléphonique dirigé vers le numéro spécial. 9. Le procédé de la revendication 8, dans lequel le remplacement du numéro composé par le numéro spécial comprend en outre l'annexion du numéro composé à un code d'emplacement de repli spécial.. Le procédé de la revendication 7, dans lequel l'étape consistant à commander au système de départ d'appel (0) de connecter l'appel téléphonique par l'intermédiaire du premier réseau (6) comprend en outre l'opération consistant à retourner au système de départ d'appel (0) un signal de rejet d'appel RNIS. 11. Le procédé de la revendication 7, dans lequel la mesure du facteur d'évaluation de transmission comprend en outre la mesure périodique de caractéristiques de transmission pour des paquets de test envoyés à une adresse IP de destination associée à l'appel téléphonique. 7. Un procédé de connexion d'un appel téléphonique pour un numéro composé, par l'intermédiaire de l'un d'un premier réseau (6) et d'un réseau IP (8), comprenant les étapes suivantes : 0 on reçoit à partir d'un système de départ d'appel (0) l'appel téléphonique à connecter; on reçoit un facteur d'évaluation de transmission désiré; on mesure un facteur d'évaluation de transmission pour le réseau IP (8); 6
