Hintergrund Das Pilotprogramm "Patent Prosecution Highway" (PPH) zwischen dem Europäischen Patentamt und dem Patentund Markenamt der Vereinigten Staaten (USPTO) hat am 29. September 2008 begonnen und wurde mit Wirkung vom 30. September 2009 um zwölf Monate verlängert. Mit diesem "Patent Prosecution Highway" werden die in beiden Ämtern bereits praktizierten beschleunigten Patentprüfungsverfahren so gebündelt, dass die Anmelder schneller und effizienter korrespondierende Patente erlangen können. Die beiden Ämter können ihrerseits die Arbeitsergebnisse des jeweils anderen Amts nutzen. Dadurch dürfte sich die Qualität der Patente verbessern und der Arbeitsanfall im Prüfungsbereich verringern. Diese Mitteilung ersetzt die in ABl. EPA 2008, abgedruckte Version. II. Pilotprogramm "Patent Prosecution Highway" Im Rahmen des PPH-Pilotprogramms können Anmelder, deren Patentansprüche vom Amt der Erstanmeldung für patentierbar/gewährbar befunden wurden, beantragen, dass die beim Amt der Nachanmeldung eingereichte korrespondierende Anmeldung bei der Prüfung vorgezogen wird; das Nachanmeldeamt kann seinerseits von den Arbeitsergebnissen des Erstanmeldeamts profitieren. Wenn das EPA als Erstanmeldeamt tätig war und die EP-Anmeldung Ansprüche enthält, die für patentierbar/gewährbar befunden wurden, kann der Anmelder beim USPTO als Nachanmeldeamt beantragen, dass die dort eingereichte korrespondierende Anmeldung beschleunigt geprüft wird. Wie die Teilnahme am PPH-Pilotprogramm beim USPTO beantragt werden kann und welche Teilnahmevoraussetzungen zu erfüllen sind, ist der USPTO-Website Patent Prosecution Highway pilot programme between the European Patent Office and the United States Patent and Trademark Office I. Background The Patent Prosecution Highway pilot programme between the European Patent Office (EPO) and the United States Patent and Trademark Office (USPTO) was launched on 29 September 2008 and extended for an additional twelve months from 30 September The Patent Prosecution Highway will leverage fast-track patent examination procedures already available at both offices to allow applicants to obtain corresponding patents faster and more efficiently. It will also permit each office to exploit the work previously done by the other office. In turn the initiative is expected to improve patent quality and reduce the examination workload. The present notice replaces that published in the EPO OJ 2008, II. Patent Prosecution Highway pilot programme The PPH was established to enable an applicant whose claims are determined to be patentable/allowable in the office of first filing (OFF) to have the corresponding application filed in the office of second filing (OSF) advanced out of turn for examination while at the same time allowing the OSF to exploit the work results of the OFF. Where the EPO is the OFF and the EP application contains claims that are determined to be patentable/allowable, the applicant may request accelerated examination at the USPTO for the corresponding application filed with the USPTO as the OSF. The procedures and requirements for filing a request with the USPTO for participation in the PPH pilot programme are available from the USPTO website at Where the USPTO is the OSF, the Programme pilote "Patent Prosecution Highway" entre l'office européen des brevets et l'office des brevets et des marques des Etats-Unis I. Programme pilote "Patent Prosecution Highway" Le PPH a été créé pour permettre aux demandeurs dont les revendications sont jugées brevetables/admissibles par l'office de premier dépôt de faire examiner en priorité la demande correspondante déposée auprès de l'office de second dépôt, tout en permettant à ce dernier d'exploiter les résultats du travail de l'office de premier dépôt. Lorsque le premier dépôt est effectué auprès de l'oeb et que la demande EP contient des revendications considérées comme brevetables/admissibles, le demandeur peut demander à l'uspto, en tant qu'office de second dépôt, de procéder à un examen accéléré de la demande correspondante déposée auprès de l'uspto. Wenn das USPTO als Nachanmeldeamt tätig wird, muss der Anmelder dem USPTO alle für die Teilnahme am PPH- Pilotprogramm erforderlichen Unterlagen übermitteln oder beantragen, dass das USPTO diese Unterlagen über das epoline -System des EPA erhält. Wurde die EP-Anmeldung nicht veröffentlicht, so ist der Anmelder dafür zuständig, dem USPTO die erforderlichen Unterlagen zu übermitteln. Wenn das EPA als Nachanmeldeamt tätig wird und die beim USPTO als Erstanmeldeamt eingereichte korrespondierende Anmeldung Ansprüche enthält, die für patentierbar/gewährbar befunden wurden, kann der Anmelder beim EPA die Teilnahme am PPH-Pilotprogramm beantragen. Das ab 29. Januar 2010 geltende Verfahren zur Beantragung der Teilnahme am PPH-Pilotprogramm beim EPA und die Teilnahmevoraussetzungen werden nachstehend unter II.B erläutert. Dieses Verfahren gilt für PPH-Anträge auf der Grundlage von Arbeitsergebnissen, die auf die Bearbeitung einer nationalen Anmeldung im Erstanmeldeamt oder einer vor dem Erstanmeldeamt in die nationale/regionale Phase eingetretenen zurückgehen. Soweit dem PPH-Pilotprogramm des EPA und des USPTO PCT-Arbeitsergebnisse (d. h. WO-ISA, WO-IPEA und IPER) zugrunde liegen, wird auf das PCT-PPH-Pilotprogramm der trilateralen Ämter verwiesen. A. Versuchszeitraum für das PPH- Pilotprogramm Das PPH-Pilotprogramm hat am 29. September 2008 begonnen und wurde mit Wirkung vom 30. September 2009 um zwölf Monate verlängert, um die Umsetzbarkeit des PPH-Programms angemessen beurteilen zu können. Die Ergebnisse werden vom EPA und vom USPTO ausgewertet, die dann entscheiden, ob und wie das Programm nach dem Probelauf implementiert werden soll. Bei zu hohem Aufkommen, aber auch aus anderen Gründen können die Ämter das Pilotprogramm auch vorzeitig beenden. Für den Fall, dass es vor dem 30. September 2010 beendet werden sollte, ergeht eine entsprechende Bekanntmachung. applicant must provide the USPTO with the necessary documents for requesting participation in the PPH pilot programme, or request that the USPTO obtain these documents via the EPO epoline system. Effective 29 January 2010, the procedures and requirements for filing a request with the EPO for participation in the PPH pilot programme are set forth below (II.B) and apply to PPH requests made on the basis of work products established during the processing of a national application before the OFF or a that has entered the national/regional phase before the OFF. With regard to the EPO-USPTO PPH pilot programme based on PCT work products (i.e. WO-ISA, WO-IPEA and IPER), reference is made to the Trilateral PCT PPH pilot programme. A. Trial period for the PPH pilot programme The PPH pilot programme commenced on 29 September 2008, for a period of one year, and with effect from 30 September 2009 was extended for an additional twelve months to adequately assess the feasibility of the PPH programme. The EPO and the USPTO will evaluate the results of the pilot programme to determine whether and how the programme should be fully implemented after the trial period. The offices may also terminate the PPH pilot programme early if the volume of participation exceeds a manageable level, or for any other reason. Les procédures et conditions à remplir pour déposer à l'oeb une demande de participation au programme pilote à compter du 29 janvier 2010 sont décrites ci-dessous (II.B.). Elles s'appliquent aux demandes de participation au PPH présentées sur la base de travaux établis lors du traitement d'une demande nationale à l'office de premier dépôt, ou d'une demande PCT entrée dans la phase nationale/régionale à l'office de premier dépôt. S'agissant du programme pilote PPH entre l'oeb et l'uspto concernant les travaux au titre du PCT (WO-ISA, WO-IPEA et IPER), voir le programme pilote PPH-PCT de la coopération tripartite. A. Période d'essai du programme pilote PPH Le programme pilote PPH a débuté le 29 septembre 2008 pour une période d'un an, et a été reconduit pour une année supplémentaire à compter du 30 septembre 2009 afin de permettre une évaluation adéquate de la faisabilité du programme. L'OEB et l'uspto analyseront les résultats du programme pilote afin de déterminer s'il doit être mis en œuvre au terme de la période d'essai, et si oui, comment. Le cas échéant, les offices mettront fin au programme de manière anticipée si la participation au programme pilote est trop importante, ou pour toute autre raison. Un avis sera publié si le programme pilote PPH prend fin avant l'échéance du 30 septembre 2010.

Voraussetzungen für die Beantragung einer Teilnahme am PPH-Pilotprogramm beim EPA Eine Teilnahme am PPH-Pilotprogramm ist möglich, wenn folgende Voraussetzungen erfüllt sind: 1) Die EP-Anmeldung ist a) eine europäische Direktanmeldung/ eine nach der Pariser Verbandsübereinkunft eingereichte Anmeldung, die die Priorität einer oder mehrerer Anmeldungen beim USPTO wirksam in Anspruch nimmt, oder b) eine, die vor dem EPA in die regionale Phase eingetreten ist (Euro-PCT), und wurde ab dem 29. September 2008 eingereicht bzw. ist ab dem 29. Januar 2010 in die regionale Phase eingetreten. Beispiele für europäische Patentanmeldungen, die diese Voraussetzung erfüllen, enthält die Anlage. Die Teilnahme ist auch möglich im Falle einer europäischen Teilanmeldung zu einer früheren beim Nachanmeldeamt eingereichten Anmeldung, die die Priorität einer oder mehrerer beim USPTO eingereichter Anmeldungen wirksam beansprucht. 2) Die USPTO-Anmeldung(en) muss/ müssen mindestens einen Patentanspruch enthalten, der vom USPTO für patentierbar/gewährbar befunden wurde. Der Anmelder muss die patentierbaren/ gewährbaren Ansprüche der USPTO- Anmeldung(en) in Kopie vorlegen. 3) Alle Ansprüche einer EP-Anmeldung, für die die Teilnahme am PPH-Pilotprogramm beantragt wurde, müssen den patentierbaren/gewährbaren Ansprüchen in der/den USPTO-Anmeldung(en) in ausreichendem Maße entsprechen oder so geändert werden, dass dies der Fall ist. Die Ansprüche gelten dann als ausreichend korrespondierend, wenn sie abgesehen von formatbedingten Unterschieden denselben oder einen ähnlichen Schutzumfang haben oder wenn die Ansprüche in der EP-Anmeldung einen engeren Schutzumfang haben als die Ansprüche in der/den USTPO- Anmeldung(en). Als nicht ausreichend korrespondierend gilt auch ein Anspruch in der EP-Anmeldung, der eine neue/ B. Requirements for requesting participation in the PPH pilot programme in the EPO In order to be eligible to participate in the PPH pilot programme, the following conditions must be met: (1) The EP application is (a) a European direct/paris Convention application validly claiming the priority of one or more applications filed with the USPTO or (b) a which has entered the regional phase before the EPO (Euro-PCT) and was filed as of 29 September 2008 or has entered the regional phase respectively as of 29 January Examples of European applications that fall under this requirement are illustrated in the Annex. Additionally, a divisional EP application of an earlier filed application in the OSF which validly claims the priority of one or more applications filed with the USPTO is considered to be eligible. (2) The USPTO application(s) has/have at least one claim indicated by the USPTO to be patentable/allowable. The applicant must submit a copy of the patentable/allowable claims from the USPTO application(s). (3) All the claims in the EP application for which a request for participation in the PPH pilot programme is made must sufficiently correspond or be amended to sufficiently correspond to the patentable/ allowable claims in the USPTO application(s). Claims will be considered to sufficiently correspond where, accounting for differences due to claim format requirements, the claims are of the same or a similar scope or the claims in the EP application are narrower in scope than the claims in the USPTO application(s). Additionally, a claim in the EP application which introduces a new/different category of claims than those indicated to be allowable/patentable by the USPTO is not considered to sufficiently correspond. B. Demande de participation au programme pilote PPH à l'oeb : conditions à remplir La participation au programme pilote PPH est soumise aux conditions suivantes : 1) La demande EP doit être a) une demande européenne directe ou une demande conforme à la Convention de Paris revendiquant valablement la priorité d'une ou plusieurs demandes déposées à l'uspto ou b) une demande PCT entrée dans la phase régionale devant l'oeb (euro- PCT), et avoir été déposée à compter du 29 septembre 2008, ou être entrée dans la phase régionale à compter du 29 janvier Des exemples de demandes européennes remplissant ces conditions figurent en annexe. En outre, une demande européenne divisionnaire issue d'une demande antérieure déposée à l'office de second dépôt et revendiquant valablement la priorité d'une ou plusieurs demandes déposées auprès de l'uspto peut également entrer en ligne de compte. 2) La ou les demandes US doivent contenir au moins une revendication indiquée comme brevetable/admissible par l'uspto. Le demandeur doit fournir une copie des revendications brevetables/admissibles de la ou les demandes US. 3) Toutes les revendications de la demande EP pour laquelle une demande de participation au programme pilote PPH est présentée doivent correspondre suffisamment aux revendications brevetables/admissibles des demandes US, ou être modifiées de telle sorte que ce soit le cas. Les revendications seront considérées comme suffisamment concordantes si, compte tenu des différences liées aux exigences de présentation applicables aux revendications, leur portée est identique ou analogue, ou si les revendications de la demande EP ont une portée moins étendue que les revendications de la ou des demandes US. Par ailleurs, une revendication de la demande EP introduisant une catégorie

Der Anmelder muss außerdem eine Anspruchskorrespondenztabelle in englischer Sprache einreichen. Aus dieser Anspruchskorrespondenztabelle muss hervorgehen, inwiefern jeder einzelne Anspruch der EP-Anmeldung den patentierbaren/gewährbaren Ansprüchen der USPTO-Anmeldungen(en) entspricht. 4) Die Prüfung der EP-Anmeldung, die im Rahmen des PPH-Pilotprogramms bearbeitet werden soll, darf noch nicht begonnen haben. 5) Der Anmelder muss einen Antrag auf Teilnahme am PPH-Pilotprogramm einreichen. Das Antragsformblatt (EPA/EPO/OEB 1009 US) ist auf der EPA-Website unter erhältlich. 6) Darüber hinaus muss der Anmelder alle (die Patentierbarkeit betreffenden) amtlichen Bescheide zu jeder USPTO- Anmeldung, in der die dem Antrag zugrunde liegenden patentierbaren/ gewährbaren Ansprüche enthalten sind, in Kopie einreichen. 7) Der Anmelder muss ferner alle in den Bescheiden des USPTO angeführten Veröffentlichungen mit Ausnahme von Patentunterlagen in Kopie einreichen. Wird dem Antrag auf Teilnahme am PPH-Pilotprogramm stattgegeben, so wird der Anmelder entsprechend benachrichtigt, und die Prüfung der EP-Anmeldung wird vorgezogen. Sind nicht alle oben genannten Voraussetzungen erfüllt, so wird der Anmelder auf die in seinem Antrag festgestellten Mängel hingewiesen. Der Anmelder erhält einmal die Gelegenheit, Mängel im Antrag zu berichtigen. Allerdings setzt der Prüfer die Bearbeitung der Anmeldung nicht aus, bis der Anmelder einen erneuten Antrag auf Teilnahme gestellt hat. Wird der Antrag nicht berichtigt, so ergeht eine Mitteilung an den Anmelder, und die Anmeldung wird regulär bearbeitet. Sind einige der unter 2) und 6) genannten Unterlagen The applicant is also required to submit a claims correspondence table in English. (4) Examination of the EP application for which participation in the PPH pilot programme is requested has not begun. (5) The applicant must file a request for participation in the PPH pilot programme. A request form (EPA/EPO/OEB 1009 US) is available via the EPO website at (6) The applicant must submit a copy of all the office actions (which are relevant to patentability) for each of the USPTO application(s) containing the patentable/ allowable claims that are the basis for the request. (7) The applicant must submit copies of all the documents other than patent documents cited in the USPTO office action. Where the request for participation in the PPH pilot programme is granted, the applicant will be notified and the EP application will be advanced out of turn for examination. In those instances where the request for participation in the PPH pilot programme does not meet all the requirements set forth above, the applicant will be notified and the defects in the request will be identified. The applicant will be given one opportunity to correct any deficiencies in the request. Action on the application by the examiner will not be suspended pending a reply by the applicant to correct the request in a renewed request for participation. If the request is not corrected, the applicant will be notified and the application will await action in its regular turn. If any of the documents identified in points (2) and (6) above de revendications nouvelle/différente par rapport à celles que l'uspto a indiquées comme brevetables/admissibles ne sera pas considérée comme suffisamment concordante. Un formulaire de demande (EPA/EPO/OEB 1009 US) est disponible sur le site Internet de l'oeb ( 6) Le demandeur doit fournir une copie de toutes les notifications (pertinentes pour la brevetabilité) relatives aux demandes de brevet US contenant les revendications brevetables/admissibles sur lesquelles se fonde la demande de participation au PPH. 7) Le demandeur doit fournir des copies de tous les documents non-brevets cités dans les notifications de l'uspto. Si la demande de participation au PPH est acceptée, le demandeur en sera informé et la demande EP sera examinée en priorité. Si la demande de participation au programme pilote PPH ne remplit pas toutes les conditions exposées ci-dessus, le demandeur en sera informé par une notification précisant les irrégularités que présente sa requête. Il sera alors donné au demandeur une possibilité de remédier à ces irrégularités. Veuillez noter que le traitement de la demande par l'examinateur ne sera pas suspendu en attendant que le demandeur produise une nouvelle demande de participation. Si la demande de participation n'est pas corrigée, le demandeur en sera informé et la demande de brevet sera traitée selon l'ordre habituel de priorité. Si certains des documents visés aux points 2 et 6 ci-dessus

In diesem Fall braucht er lediglich auf diese Unterlagen zu verweisen und in seinem Antrag anzugeben, wann er diese mit der EP-Anmeldung eingereicht hat; b) über PAIR (Patent Application Information Retrieval) abrufbar, so muss der Anmelder keine Kopien einreichen, sondern legt stattdessen eine Liste der abzurufenden Unterlagen vor. Ist/sind die USPTO-Anmeldung(en) unveröffentlicht, so muss der Anmelder die unter 2) und 6) genannten Unterlagen bei Stellung des s einreichen. Das EPA kann beglaubigte Abschriften der unter 2) und 6) genannten Unterlagen verlangen. C. Bearbeitung im Rahmen von PACE Wird dem Antrag auf Bearbeitung einer EP-Anmeldung im Rahmen des PPH- Pilotprogramms stattgegeben, so wird die EP-Anmeldung nach dem PACE- Programm 1 beschleunigt bearbeitet. Anfragen in Zusammenhang mit dieser Mitteilung können direkt an Eugen Stohr, Direktor Internationale Rechtsangelegenheiten, gerichtet werden (international_legal_affairs@epo.org). Prosecution under PACE Once the request for participation in the PPH pilot programme has been granted, the EP application will be processed in an accelerated manner under PACE 1. Traitement d'une demande au titre de PACE Une fois que la demande de participation au programme pilote PPH a été acceptée, la demande de brevet EP fait l'objet d'un traitement accéléré au titre de PACE 1. Eine ausreichende Korrespondenz der Ansprüche ist dann gegeben, wenn sie den gleichen oder einen ähnlichen Schutzumfang haben oder wenn die Ansprüche in der EP-Anmeldung einen engeren Schutzumfang haben als die Ansprüche in der/den USPTO-Anmeldung(en). Ein Anspruch hat einen engeren Schutzumfang, 7. Claims correspondence table: A completed claims correspondence table indi cating how the claims of the European patent application which is requested to be processed under PPH correspond to the claims determined to be patentable/allowable in the corresponding USPTO application. The claims correspond suffi ciently when they are of the same or similar scope or the claims in the EP application are narrower in scope than the claims in the USPTO application(s). A claim is narrower in scope when the USPTO claim is amended to be further limited by an additional feature that is supported in the specifi cation (description and/or claims) of the EP application. 7. Tableau de concordance des revendications : Le tableau de concordance des revendications doit indiquer dans quelle mesure les revendi - cations de la demande de brevet européen à traiter dans le cadre du PPH correspondent aux revendications jugées brevetables/admissibles de la demande déposée à l'uspto. A claim in the EP application which introduces a new/different category of claims to those claims indicated to be patentable/allowable by the USPTO is not considered to suffi ciently correspond. For example, if the USPTO application only contains claims to a process of manufacturing a product, the claims in the EP application are not considered to suffi ciently correspond if the EP application introduces product claims that are dependent on the corresponding process claims. When the claims are identical or just literally translated, the applicant can indicate that "they are the same" in the table. Applicants are requested to use one fi eld for each claim.
