11 K th European Summer Academy Public Procurement for EU Funded Projects The new EU Directives on Public Procurement implicate a number of modifications and bring in some significant changes, particularly to the range of contracts subject to the EU public procurement regime. The European Commission wishes to increase the flexibility for contracting authorities by splitting larger public contracts into several lots and therefore improve SME access to public tenders. Moreover, the lowest price criteria should no longer be considered as the most effective method. Improved public procurement practices should support a faster market uptake of innovative products and services. In addition there will be a stronger focus on more socially and environmentally sustainable procurement; hence violations of social and environmental laws and provisions should become exclusion criteria of economic operators. Furthermore, joint procurement and framework agreements is being promoted as an effective tool for saving costs in public authorities. The 4 th European Summer Academy Public Procurement for EU Funded Projects 2015 is a three-day intensive practical training providing practical skills and know-how in the field of public procurements for all authorities within the management and control system of EU funds. Practical exercises and tasks will show you how to improve your measures to control public procurement procedures. Furthermore, you will receive advice on how to prepare appropriate checklists for public procurement, how to avoid control errors and what are most frequent flaws in awarding contracts. In addition, you will deepen your knowledge on the modernisation of EU Public Procurement legislation and on exemptions and derogations of public procurement regulations. 12 K th European Summer Academy State Aid STATE AID RULES ARE UNDER STRICT CONTROL OF THE EUROPEAN COMMISSION State aid elements are difficult to identify. The very wide definition of State aid causes a high risk, especially for the recipients of support. The challenge for national authorities is to decide which measure requires notification. Failure to notify a measure, which is subsequently found to involve aid, may result in the repayment of aid granted, which can bring drastic consequences for its beneficiary. The 5 th European Summer Academy State Aid 2015 will provide deepened training on practical State aid issues. Due to its workshop character participants delve deep into legal case studies to clear out difficulties with identification and definition of State aid. The State aid Modernisation (SAM) which was undertaken by the European Commission has brought a set of new guidelines. Public authorities now face the challenge to apply the new regulations for de minimis and block exemption, as well as a range of further revised guidelines, for instance in the area of energy and environment, aviation or research, development and innovation. Besides these new regulations which practitioners now have to deal with there are numerous areas which remain difficult to assess and to manage: How to implement the rules for Services of General Economic Interest, how to perform a private investor test and how to manage the notification procedure. These issues are only some of the practical approaches of this training event. But also other areas such as recovery policy, sector specific rules, forms of procedure and the legal backgrounds will be covered. This set of skills will provide each participant with the ability to check individual cases on the eventuality of State aid implications. The initial screening and review to ensure that measures or projects comply with State aid rules are important tools to be mastered. Particularly providers of national and EU funding need to ensure that aid schemes comply with EU State aid rules. Otherwise entire projects can be at risk of a possible State aid recovery. The 5 th European Summer Academy State Aid 2015 is a three-day practical training and offers detailed information on the all important State aid issues. After every training module, our experienced speakers prepare a knowledge check for you which will take place at the end of every training day. Based on your successful results of the daily knowledge check, you will be awarded a unique diploma of the European Academy for Taxes, Economics & Law. 13 K-127 Master Class Improving Financial Management, Control and Audit of EU Funds EFFECTIVE FINANCIAL CONTROL AND AUDIT REMAINS CRUCIAL FOR THE CORRECT IMPLEMENTATION OF EU FUNDS IN With the start of the new programming period new regulations and rules regarding financial management, control and audit have been introduced. On the basis of the Common Provisions Regulation, Fund-specific rules as well as delegated and implementing acts EU-Member States have created and set up management and control systems for the European Structural and Investment Funds (ESI Funds) Although many professionals are already experienced in financial management, control and audit issues, the present rules introduce new elements like flexibilities for dealing and reimbursement of costs, drawing up of management declaration and audit of accounts. Besides these new aspects, some old areas remain difficult and could be substantially improved. These areas include obtaining reliable assurance during desk based checks and on-the-spot checks, effective assessment of management and control systems or choosing the right sampling method. Sound financial management of European ESI Funds and reliable audit trail continue to be essential for securing that all European funding resources are spent properly and efficiently. Member States are obliged to prevent, detect and correct irregularities and to recover amounts unduly paid, together with any interest on late payments. When the amounts unduly paid to a beneficiary cannot be recovered and this is a result of fault or negligence on the part of a Member State, this Member State is responsible for reimbursing these amounts to the budget of the Union. Therefore, national authorities have to meet the challenges of stronger financial controls and carry out the respective audits. WHAT WILL YOU LEARN AT THIS MASTER CLASS? The Intensive Training on Improving Financial Management, Control and Audit of EU Funds offers you the unique opportunity to learn and exercise in detail the most important topics related to financial management, control and audit of ESI Funds in the programming period This three-day event provides you with theoretical and practical information on the most relevant aspects related to the management as well as to the first and second level of control. Each module consists of presentation, case studies and team exercises. The presentations at the beginning of each module offer you compact and in-depth information on the respective topic. The following case studies and team exercises make you familiar with practical aspects and deepen your knowledge on the basis of cases that occur in practice. The workshop facilitator will be available to answer individual questions, to guide the participants through the exercise with suggestions and help in case of uncertainties. Towards the end of each session, all groups may present their work, compare results with the other groups and discuss further solutions with our experts. In addition to team exercises and discussions on each module, you are invited to test your fresh-acquired knowhow by participating in the daily knowledge checks that will take place at the end of every training day. These consist of multiple choice questions based on the main issues discussed previously in the morning and afternoon sessions.
