1 PRESS RELEASE EXCHANGE COUNCIL SUPPORTS EPEX SPOT S COMMITMENT TO DELIVER THE EUROPEAN DAY AHEAD AND INTRADAY TARGET MODELS IN NORTH WEST EUROPE THROUGH JOINT VENTURE WITH NORD POOL SPOT Fast implementation of Austrian intraday segment welcomed Vienna/Paris, 01/12/2011 The fourth meeting in 2011 of the EPEX SPOT Exchange Council took place on 30 November 2011 in Vienna and was chaired by Dr. Günther Rabensteiner, member of the Executive Board of Verbund AG. The subject of the meeting was the commitment of EPEX SPOT for further harmonization of European day-ahead and intraday markets. The Exchange Council fully supports the steps taken by EPEX SPOT towards a joint venture with the Nordic Power Exchange Nord Pool Spot. The goal of this joint venture is to create common trading platforms for the day-ahead and intraday market. In a second step, these platforms shall be operated together. Both EPEX SPOT and Nord Pool Spot will stay independent exchanges, responsible for their local markets. This creation of harmonised transnational trading platforms in North West Europe (NWE) by two main drivers of the integration of the European electricity market will set standards for the road to the day-ahead and intraday target models of the European Commission (EC). EPEX SPOT is fully committed to accomplish these goals by 2014 in accordance with the EC. Moreover, the Exchange Council welcomed the concept of an Austrian intraday market. The concept was elaborated in cooperation with the Austrian transmission system operator APG, Austrian Power Grid. Austria, whose day-ahead market is already integrated with neighbouring countries, will likewise benefit from an organised intraday market which will facilitate the integration of renewable energy into the power system. EPEX SPOT is now planning to offer an Austrian intraday market, pragmatically using existing infrastructure for the moment, in anticipation of the migration to the new ELBAS-like intraday system. In addition, easy and secured access to the Franco-German intraday liquidity pool via cross-

2 border trading can promote the future Austrian intraday market. Its implementation is scheduled for the second quarter of 2012, but still subject to testing and regulatory approvals. This project is seen as a first step of a deeper cooperation amongst Austrian market actors with EPEX SPOT. * * * The Exchange Council of EPEX SPOT is an official body of the exchange. 16 members represent adequately the diversity of economic and corporate profiles that exists among the Exchange Members from various sectors: power trading companies, transmission system operators, regional suppliers, brokers and financial service providers, as well as commercial consumers and academics. The missions of the Exchange Council include in particular the adoption of the rules and regulations of the exchange and their amendments. Its task also comprises the appointment of the head of the Market Surveillance Office and the approval of the new trading systems. The Exchange Council of EPEX SPOT meets up quarterly. EPEX SPOT SE operates the power spot markets for France, Germany, Austria and Switzerland (Day Ahead and Intraday). Together these countries account for more than one third of the European electricity consumption. EPEX SPOT is a Paris-based company under European law (Societas Europaea) with a branch in Leipzig. 258 TWh have been traded from 1 January to 31 October 2011 on EPEX SPOTs power markets. 3 PRESSEMITTEILUNG BÖRSENRAT UNTERSTÜTZT ENGAGEMENT VON EPEX SPOT FÜR DAS ERREICHEN DER EUROPÄISCHEN DAY AHEAD UND INTRADAY ZIELMODELLE IN NORDWESTEUROPA DURCH JOINT VENTURE MIT NORD POOL SPOT Schnelle Einführung des österreichischen Intraday Marktes begrüßt Wien/Paris, 01/12/2011 Die vierte Sitzung des Börsenrats der EPEX SPOT im laufenden Jahr fand am 30. November 2011 in Wien statt und wurde von Dr. Günther Rabensteiner, Mitglied des Vorstandes der Verbund AG, geleitet. Thema der Sitzung war das Engagement von EPEX SPOT zur weiteren Harmonisierung der europäischen Day-Ahead- und Intraday- Märkte. Der Börsenrat unterstützt dabei ausdrücklich die von EPEX SPOT unternommenen Schritte in Richtung eines Joint Ventures mit der nordischen Börse Nord Pool Spot. Ziel des Joint Ventures ist es, gemeinsame Handelssysteme für den Day-Ahead- und Intraday-Markt zu schaffen. In einem zweiten Schritt sollen diese Systeme zusammen betrieben werden. Sowohl EPEX SPOT als auch Nord Pool Spot bleiben unabhängige Börsen und sind weiterhin für ihre lokalen Märkte verantwortlich. Diese Schaffung von harmonisierten transnationalen Handelsplattformen in der Region Nordwesteuropa (NWE) durch zwei Hauptakteure der Integration des europäischen Strommarktes wird Maßstäbe auf dem Weg zu den Day-Ahead- und Intraday-Zielmodellen der Europäischen Kommission setzen. EPEX SPOT arbeitet mit aller Kraft daran, diese Ziele entsprechend der Vorgabe durch die Europäische Kommission bis 2014 zu erreichen. Darüber hinaus begrüßte der Börsenrat das Konzept eines österreichischen Intraday- Marktes. Das Konzept wurde in Kooperation mit dem österreichischen Übertragungsnetzbetreiber APG, Austrian Power Grid, erarbeitet. Österreich, dessen Day- Ahead-Markt bereits mit den Nachbarländern integriert ist, wird auf gleiche Weise von einem börslichen Intraday-Markt profitieren. Dieses Marktsegment wird die Integration erneuerbarer Energien in das Stromnetz erleichtern. EPEX SPOT plant, einen österreichischen Intraday- Markt anzubieten und wird dabei zunächst die bestehende Infrastruktur nutzen, um zu einem

4 späteren Zeitpunkt auf das neue, an ELBAS angelehnte Intraday-System umzustellen. Darüber hinaus kann der zukünftige österreichische Intraday-Markt vorangetrieben werden, indem er durch grenzüberschreitenden Handel einfachen und sicheren Zugang zum deutschfranzösischen Liquiditätspool erhält. Die Umsetzung ist für das zweite Quartal 2012 vorgesehen, hängt aber noch von Tests sowie Zustimmung seitens der Regulierungsbehörden ab. Das Projekt wird als erster Schritt einer engeren Kooperation zwischen österreichischen Marktakteuren und EPEX SPOT gesehen. * * * Der Börsenrat der EPEX SPOT ist ein offizielles Börsenorgan. Die 16 Mitglieder bilden die Vielfalt der Wirtschaftskreise und Unternehmensprofile unter den Börsenmitgliedern angemessen ab: Sie umfassen Stromhandelsunternehmen, Übertragungsnetzbetreiber, Regionalversorger, Broker und Finanzdienstleister sowie gewerbliche Verbraucher und Vertreter der Wissenschaft. Die Aufgaben des Börsenrates umfassen insbesondere die Verabschiedung des Regelwerks der Börse sowie dessen Änderung. Darüber hinaus gehören auch die Ernennung des Leiters der Handelsüberwachungsstelle und die Genehmigung neuer Handelssysteme zu seinen Aufgaben. Die Sitzungen des Börsenrates finden vierteljährlich statt. EPEX SPOT SE betreibt die Strom-Spotmärkte für Deutschland, Frankreich, Österreich und die Schweiz (Day-Ahead und Intraday). Diese Länder machen zusammen mehr als ein Drittel des europäischen Stromverbrauchs aus. Le sujet de la réunion a été l'engagement d'epex SPOT à poursuivre l'harmonisation des marchés dayahead et intraday européens. L Exchange Council soutient pleinement les démarches entreprises par EPEX SPOT pour créer une société commune avec la bourse d électricité nordique Nord Pool Spot. Cette société commune a pour objectif la création de plateformes communes de négociation pour les marchés day-ahead et infrajournalier. Dans un deuxième temps, ces plateformes seront opérées conjointement. EPEX SPOT et Nord Pool Spot restent toutes deux des bourses indépendantes, responsables de leurs marchés locaux. La création de plateformes de négociation transfrontalières harmonisées en Europe du Nord- Ouest (NWE) par deux acteurs majeurs de l intégration des marchés européens de l électricité fixera les normes en matière de modèles cible de la Commission Européenne (CE) pour les marchés day-ahead et infrajournaliers. EPEX SPOT se consacrera entièrement à l accomplissement de ces objectifs d ici 2014 en conformité avec la CE. L Exchange Council a également accueilli favorablement l idée d un marché infrajournalier autrichien. Le concept a été élaboré en collaboration avec le gestionnaire de réseau de transport autrichien APG, Austrian Power Grid. L Autriche, dont le marché day-ahead est déjà intégré à ceux des pays voisins, bénéficiera également d un marché organisé infrajournalier, qui facilitera l intégration des énergies renouvelables dans le système électrique. EPEX SPOT projette actuellement de proposer un marché infrajournalier autrichien, en utilisant pour le moment et de manière pragmatique, l infrastructure existante,

6 en prévision de la migration du nouveau système de négociation infrajournalier de type ELBAS. Un accès facile et sécurisé à la liquidité du marché infrajournalier franco-allemand par le biais des négociations transfrontalières favoriserait le futur marché infrajournalier autrichien. Sa mise en place est prévue au deuxième trimestre 2012, mais demeure l objet de tests et d autorisations réglementaires. Ce projet est considéré comme la première étape d une coopération plus étroite entre acteurs du marché autrichien et EPEX SPOT. * * * L Exchange Council d EPEX SPOT est un organisme officiel de la Bourse.
