16 SPECIALIZED CAMERA SYSTEMS KENWORTHY-NETTMANN-SNORKEL Ein fernsteuerbares Aufnahmesystem, bei dem sich Kameramann und Aufnahmekomponenten außerhalb des eigentlichen Sets befinden, lediglich der Snorkel-Tubus ist innerhalb des Sets. Die Kameraoptik blickt in den periskopartigen Tubus (er enthält ein optisches System), der unterhalb der Kamera ansetzt und nach ca. 55 cm mit einem kleinen vorderseitig beschichteten Spiegel endet. Dieser neigbare Spiegel ist fernsteuerbar, genau wie folgende andere Funktionen: Pan (Schwenken), Roll (Drehung der optischen Achse), Zoom, Focus und Iris (Blende). Der KENWORTHY-NETTMANN-SNORKEL erlaubt extremere Nahaufnahmen als Periskope, die direkt vor die Kamera gesetzt werden. Er gibt zudem Einblikke in sehr enge und verwinkelte Situationen, indem man entweder mit dem Snorkel-Tubus von oben in die Dekoration "eintaucht" oder das aufzunehmende Objekt aus einer sehr tiefen Kameraposition heraus betrachtet. Dieses ist besonders bei Aufnahmen innerhalb von Miniatursets wichtig und vermittelt dem Zuschauer den Eindruck, sich direkt im Set zu befinden. Ein zusätzlicher wasserdichter Tubus ermöglicht auch Unterwasseraufnahmen. KENWORTHY-NETTMANN-SNORKEL A remote image taking system with operator and camera components removed from shooting area. The camera looks into a periscope-like optical relay tube that extends downwards below the camera and ends with a small front-surfaced mirror. Since the mass of the camera and operator are removed from the shooting area, considerations of scene staging are concerned only with the small end (1,25" x 1,25" at the mirror) of the tube. The tilting mirror is remote controlled, as are other functions such as pan, roll, focus, zoom and iris. The mirror system permits more intimate shooting (due to its small size) than add-on right-angled lens periscopes. It also permits tilting up in constricted situations because the mirror, rather than the tube/camera combination, does the tilting. The system allows viewpoints into tight quarters reachable from overhead, or from very low viewpoints or in miniature sets. Pans and tilts are on system nodal point. An added waterproof tube permits underwater or transition shots.

36 ALLGEMEINE GESCHÄFTSBEDINGUNGEN 1. Die von MAT durchgeführten Aufträge werden nur zu den nachstehend aufgeführten Bedingungen abgewickelt; der Auftraggeber bzw. Mieter erkennt diese Bedingungen für den vorliegenden Auftrag und zugleich für alle zusätzlichen und zukünftigen Geschäfte mit der MAT an. 2. Die Höhe der Leihmiete für die Überlassung der Geräte richtet sich nach der jeweils gültigen Preisliste der MAT bzw., den in dem einzelnen Angebot schriftlich festgelegten Preisen. Die Preise gelten ab MAT Lager. In der Leihmiete sind die Kosten für Hin- und Rücktransport nicht inbegriffen. Diese werden zu Lasten des Mieters gesondert berechnet. Für Geräte, die vor Uhr abgeholt oder geliefert werden, ist der volle Tagessatz zu bezahlen; das Gleiche gilt, falls die Geräte nicht vor Uhr mittags zurückgegeben werden. Sonntage und gesetzliche Feiertage innerhalb der Mietzeit werden nur dann nicht berechnet, wenn die Geräte an diesen Tagen nachweislich nicht benutzt wurden. Transport- und sonstige Standzeiten werden mit 50 % der Tagesmiete berechnet. Pauschalregelungen bedürfen einer gesonderten schriftlichen Absprache. 3. Der Mieter ist verpflichtet, die Geräte sorgfältig zu behandeln. Er hat sich bei der Übergabe am Auslieferungsort von der ordnungsgemäßen Beschaffenheit der gemieteten Geräte einschließlich Zubehör zu überzeugen. Mängelrügen müssen umgehend nach Erhalt der Geräte schriftlich erfolgen. Macht der Mieter von diesem Recht keinen Gebrauch, so erkennt er die ordnungsgemäße Lieferung an. Der Mieter haftet für die Vollständigkeit und Schadlosigkeit der gemieteten Geräte einschließlich Zubehör vom Zeitpunkt der Übergabe an bis zur Rückgabe am Auslieferungsort. 4. Bei Schäden, die durch den Mieter an MAT-Geräten oder Fahrzeugen entstehen, haftet der Mieter. Dieser verpflichtet sich, das Equipment für Dreharbeiten gegen alle Risiken, für die er oder Dritte nach diesen Bedingungen gegenüber MAT einzustehen haben, auf eigene Kosten zu versichern, und zwar ab Versand oder Übernahme vom Lager MAT bis zur Rücklieferung an Lager MAT. 5. Der Versand oder Transport ab Lager/Versandort erfolgt stets auf Rechnung und Gefahr des Auftraggebers/Mieters. Er trägt auch dann das Gefahrenrisiko, wenn frachtfreie Lieferung vereinbart worden ist. 6. Schadenersatzansprüche gegen MAT sind nur bei grob fahrlässigem oder vorsätzlichem Handeln möglich, allerdings begrenzt auf die Höhe der vereinbarten Leihmiete. Dies gilt auch dann, wenn dem Mieter oder Dritten durch den Einsatz von MAT sowie durch etwaige Störung oder den Ausfall der gemieteten Geräte während der Vertragszeit Schäden entstehen, und bezieht alle von MAT zur Verfügung gestellten Leistungen ein. Die Geltendmachung eines mittelbaren Schadens ist ausgeschlossen. 7. Der Mieter ist verpflichtet, der MAT alle während der Mietzeit auftretenden Schäden oder den Verlust der Geräte unverzüglich anzuzeigen. Alle notwendigen Reparaturen gehen zu Lasten des Mieters. 8. Die gemieteten Geräte dürfen ohne Zustimmung weder Dritten vermietet oder überlassen noch verändert werden. Falls nicht ausdrücklich vereinbart, dürfen sie nur im Bundesgebiet verwendet und transportiert werden. Dies gilt auch für den Fall, daß MAT Fachpersonal zur Verfügung stellt. 9. Wird ein Auftrag/Mietvertrag aus Gründen, die MAT nicht zu vertreten hat, nicht ausgeführt, kann MAT ein Ausfallhonorar in Höhe von 50 % der vereinbarten Preise berechnen, ohne daß es eines Schadensnachweises bedarf. Wird ein bereits begonnener Auftrag/Mietvertrag vorzeitig beendet, ohne daß dies die MAT zu vertreten hat, ist die MAT berechtigt, alle Leistungen in voller Höhe zu berechnen. Weitergehende Schadenersatzansprüche der MAT bleiben hiervon unberührt. 10. Beiden Vertragsparteien bleibt vorbehalten, den Nachweis zu führen, ein höherer bzw. ein geringerer oder gar kein Schaden sei entstanden. 11. Der Mieter nimmt zur Kenntnis, daß MAT auch Subunternehmer beauftragt, d.h. firmenfremde Leistungen für die Erfüllung ihrer vertraglichen Verpflichtungen einsetzt. Aus diesem Grunde können Rechnungen der Subunternehmer in den Abrechnungen auftauchen. 12. MAT hat Anspruch darauf, in allen Medien im Vor- und/oder Abspann wie folgt genannt zu werden: "MAT Specialized Remote Camera Systems". 13. Die Rechnungen der MAT sind nach 14 Tagen ohne Skontoabzug zur Zahlung fällig. Bei Überschreitung des Zahlungszieles ist MAT berechtigt, Zinsen in Höhe von 5 % über dem jeweiligen Bundesbankdiskontsatz zu berechnen. Werden von der MAT Wechsel an Zahlung statt angenommen, so gehen sämtliche entstehenden Spesen zu Lasten des Auftraggebers/ Mieters. Die Zahlung gilt erst dann als geleistet, wenn die Wechsel fristgemäß eingelöst und sämtliche Nebenkosten bezahlt sind. 14. Der Auftraggeber/Mieter darf gegenüber den Forderungen der MAT nur mit rechtskräftig festgestellten oder von der MAT anerkannten oder nicht bestrittenen Gegenforderungen aufrechnen. 15. Änderungen und Ergänzungen des abgeschlossenen Mietvertrages sind nur gültig, wenn sie von MAT schriftlich bestätigt werden. 16. Erfüllungsort und Gerichtsstand für alle sich aus dem Vertragsverhältnis mit der MAT mittelbar oder unmittelbar ergebenden Rechte und Pflichten ist der jeweilige Geschäftssitz der MAT. 17. Der Besteller bestätigt durch die Auftragserteilung ausdrücklich, von diesen Allgemeinen Bedingungen Kenntnis genommen zu haben und mit ihnen in vollem Umfang einverstanden zu sein. 37 TERMS AND CONDITIONS 1. MAT will only carry out orders under the following conditions. The principal/hirer accepts these terms/conditions for the present order and at the same time for all additional and future business with MAT. 2. The level of the rental/hiring fee for the let equipment is determined by the MAT price-list, that is valid at the time of contract or the prices fixed in the individual written offer. The prices run from MAT stock, expenses to and for are not included. They will be charged extra to the principal`s account. The full daily rate has to be paid for equipment, that is either fetched or delivered before 12.a.m. or not returned before 12 a.m.. In case, the hired equipment is provably not used on sundays and public holidays during hiring time, these times will not be taken into account. Transport and other parking time will be charged with 50 % of the daily rate. All-inclusive prices are only valid with written agreement. 3. The principal is liable for the accurate handling of the equipment. He has to verify during delivery at the place of delivery the proper quality of the hired equipment inclusive accessories. Dissatisfied principal`s complaints have to be put in writing immediately after delivery. If the principal does not make use of this right he will automatically admit the proper quality of the equipment.the principal will be responsible for the completeness of the rented equipment including accessories and that it will not be damaged from delivery at the place of delivery up to the returning to the place of delivery. 4. Damage done to MAT equipment and vehicles belongs to the principal`s responsibilities. The principal commits to MAT to insure at his own account the equipment against all risks that he or a third party is responsible for, that means from delivery or taking over at MAT store up to returning to MAT store. 5. Delivery or transport off the place of delivery will always be due to the principal`s account and risk. He accepts the danger risk though carriage paid delivery has been arranged. 6. Claims for damages against MAT are only possible in the point of gross and wilful negligence and limited by the agreed hiring-fee. The same will be valid if the principal or a third party suffers loss because of MAT or the breakdown or failure of rented equipment during time of contract and will include every performance made available by MAT. Receivables of indirect damages are excluded. 7. The principal has to report immediately to MAT all damages or the loss of equipment. All the necessary repairs are charged to his account. 8. The principal is not allowed to lend or give or manipulate the rented equipment without permission. If not explicitly arranged in another way the equipment is only allowed to be used or transported inside the Federal Republic of Germany. 9. If an order is not carried out on no account of MAT `s responsiblity, MAT is allowed to charge 50% of the list-price without a damage proof. If an already started order is finished in advance - without any responsibility of MAT - MAT is entitled to charge the entire sum of the charge for this order. Other claims for damages of MAT lie outside the scope of this. 10. Both parties of the contract have the right to prove that a minor, major or no damage was caused. 11. The principal takes notice that MAT may entrust also other contractors, that means to substitute the capacity of other proprietors for fulfilling its contractual-duties. Therefore bills of other contractors may be part of the invoice. 12. MAT has the right to be named in all medias in the creditlist as follows: "MAT Specialized Remote Camera Systems". 13. MAT`s invoices are to be paid within 14 days without discount. If the terms of payment are overdrawn MAT will have the right to add 5% above the valid Federal Bank interest rate to the invoice. If MAT takes a bill of exchange instead of payment all the resulting extra expenses will be charged to the principal`s account. Only when a bill of exchange is honoured in time and all extras are paid, the invoice is considered totally paid. 14. The principal is not allowed to set off MAT`s claims against him against other than valid or disallowed by MAT or not disputed counter-claims. 15. Alterations and complements to the concluded contract will only be binding if written approval by MAT exists. 16. Place of performance and forum for all the vicarious and directly rights and duties resulting out of the privity of contract with MAT will be in each case MAT `s place of business. 17. The principal validates explicitely by placing the order to have taken notice of these general conditions of contract and to have agreed to them in their entirety.
