3 VAT after Croatia joins the EU We would like to direct your attention to the amendments of the VAT regulations and the practical implications of such changes, following the 1st of July The new VAT Act will take effect from the date of the Republic of Croatia's accession to the European Union ( EU ), and it is the duty of all taxpayers to adjust their operations to conform with the new Act. Material adjustments will first be made by all enterprises with business partners in other EU member countries, since such transactions will no longer fall under import and export. For each business deal that such enterprises plan to enter into with business partners who have their registered office in a member country, they will have to specify where the transaction would be taxed. The specification of the location in which the transaction would be taxable will not only depend on the type of transaction, but also on other factors, such as the value of the transaction, the tax status of the recipient, etc. In certain cases, Croatian enterprises will have to be registered in a member country and will be entitled to the VAT refund in member countries, which has so far been possible only in a limited number of countries. The new Act brings numerous novelties with respect to reporting to the Tax Administration. In addition to the regular VAT form which will have somewhat different content three new forms are being introduced and they will have to be submitted by all enterprises performing commercial activities with business organisations in the EU. There are other specific details concerning the invoices, their appearance and the deadline for their issuance. For the new VAT system to be functional and to enable the issuance of invoices and VAT reporting in accordance with the new regulations, all enterprises must adjust their software systems by the 1st of July. Furthermore, from the date the Republic of Croatia joins the EU, customs control of the turnover of goods at the borders between the Republic of Croatia and other member states will be annulled. However, a new form of statistical monitoring of the turnover of goods between the EU member countries will be introduced, and that will remain within the jurisdiction of the Customs Administration (INTRASTAT). There is a series of new measures with regard to customs and the turnover of goods with third countries as well. 1

5 Umsatzsteuer nach dem EU-Beitritt Kroatiens Hiermit möchten wir Sie auf die Änderungen der umsatzsteuerrechtlichen Vorschriften sowie auf deren praktische Anwendung nach dem 1. Juli 2013 hinweisen. Mit dem Tag des Beitritts Kroatiens zur Europäischen Union (die EU ) tritt ein neues Umsatzsteuergesetz in Kraft und folglich werden alle Steuerpflichtigen ihre Geschäftstätigkeit an das neue Gesetz anpassen müssen. Wesentliche Anpassungen sind in erster Linie von jenen Unternehmern durchzuführen, deren Geschäftspartner ihren Sitz in anderen Mitgliedsstaaten der EU haben, vor allem unter Berücksichtigung der Tatsache, dass diese Transaktionen nicht mehr als Einfuhr bzw. Ausfuhr zu betrachten sind. Solche Unternehmer werden für jede einzelne Transaktion, welche sie mit den Geschäftspartnern mit dem Sitz in einem der Mitgliedstaaten der EU durchzuführen planen, den Besteuerungsort für diese Transaktion bestimmen müssen. Die Bestimmung des Ortes bzw. des Staates, in welchem die Transaktion zu versteuern ist, hängt nicht nur von der Transaktionsart sondern von mehreren Faktoren wie z.b. Transaktionswert, Steuerstatus des Transaktionsempfängers u.ä. ab. In bestimmten Fällen werden sich die kroatischen Unternehmer in einem der Mitgliedsstaaten der EU registrieren müssen und somit das Recht auf die Rückerstattung der USt haben, was bisher nur bei einer eingeschränkten Zahl der Länder möglich war. Das neue Gesetz schreibt ebenso zahlreiche Neuerungen in der Berichterstattungspflicht gegenüber dem Finanzamt vor. Neben dem üblichen Umsatzsteuerformular, dessen Inhalt einigermaßen geändert wird, werden zusätzlich drei neue Formblätter eingeführt, die von allen Unternehmern einzureichen sind, die ihre Geschäftsbeziehungen mit den Unternehmen aus der EU unterhalten. Bestimmte Besonderheiten schließen ebenso die Rechnungen selbst, deren Aussehen sowie die Frist, innerhalb welcher diese auszustellen sind, ein. Damit das neue Umsatzsteuersystem mit dem 1. Juli auch umsetzungsbereit ist, müssen die Unternehmer bis zu diesem Stichtag ihre Softwareprogramme so anpassen, dass die Ausstellung von Rechnungen und die USt betreffende Berichterstattung in Übereinstimmung mit den neuen Vorschriften sichergestellt wird. Darüber hinaus wird mit dem Beitritt Kroatiens zur EU die Zollaufsicht über den Warenverkehr zwischen der Republik Kroatien und anderen Mitgliedsstaaten an den Grenzen aufgehoben. Allerdings wird eine neue Form der statistischen Prüfung von Güterbewegungen zwischen den EU-Ländern, die weiterhin in der Zuständigkeit der Zollverwaltung (INTRASTAT) bleibt, sowie eine Reihe neuer Zollmaßnahmen bezüglich des Warenverkehrs mit Drittländern eingeführt. 3

7 PDV nakon ulaska Hrvatske u EU Ovim putem željeli bismo skrenuti Vašu pozornost na izmjene propisa o PDV-u te njihovu praktičnu primjenu nakon 01. srpnja godine. Naime, danom ulaska Hrvatske u Europsku uniju ( EU ), na snazi de biti novi Zakon o PDV-u kao i novi carinski propisi te de od navedenog dana svi porezni obveznici morati prilagoditi svoje poslovanje. Bitne prilagodbe morati de prvenstveno provesti poduzetnici koji imaju poslovne partnere u drugim zemljama članicama EU, s obzirom da se takve transakcije više nede smatrati uvozom, odnosno izvozom, ved pripadaju novoj oporezivoj kategoriji transakcija unutar EU. Takvi poduzetnici de za svaku pojedinu transakciju koju planiraju izvršiti s poslovnim partnerima sa sjedištem u nekoj od zemalja članica, morati odrediti mjesto gdje je transakcija oporeziva. Određivanje mjesta (države članice) gdje je transakcija oporeziva ne ovisi samo o vrsti transakcije, nego i o više faktora o kojima je potrebno voditi računa, kao što je vrijednost transakcije, porezni status primatelja transakcije kada se radi o isporukama od strane tuzemnih poduzetnika i slično. U određenim slučajevima de se hrvatski poduzetnici morati registrirati u nekoj od zemalja članica te de također imati pravo na povrat PDV-a u zemljama članicama, što je dosad bilo mogude samo za ograničeni broj zemalja. Novi Zakon propisuje i brojne novosti u izvještavanju o PDV-u Poreznoj upravi. Osim redovnog PDV obrasca koji de imati nešto drugačiji sadržaj od dosadašnjeg, uvode se i tri nova obrasca koja de morati podnositi svi poduzetnici koji posluju s poduzetnicima unutar EU. Određene posebnosti odnose se i na same račune, njihov izgled te rok u kojem se moraju izdati. Kako bi novi sustav PDV-a funkcionirao od 01. srpnja, poduzetnici bi do tog dana trebali prilagoditi svoje softverske sustave na način da isti omoguduju izdavanje računa i izvještavanje o PDV-u u skladu s novim propisima.
