END-USER LICENSE AGREEMENT FOR DOC-O-MATIC 7 PROFESSIONAL, DOC-O-MATIC 7 SRC, DOC-O-MATIC 7 FOR AUTHOR AND DOC-O-MATIC 7 EXPRESS IMPORTANT PLEASE READ THE TERMS AND CONDITIONS OF THIS LICENSE AGREEMENT CAREFULLY BEFORE CONTINUING WITH THIS PROGRAM INSTALL: This End-User ("EULA") is a legal agreement between you (either an individual or a single entity) and toolsfactory software inc. for the toolsfactory software inc. software product(s) identified above which may include associated software components, media, printed materials, and "online" or electronic documentation ("SOFTWARE PRODUCT"). By installing, copying, or otherwise using the SOFTWARE PRODUCT, you agree to be bound by the terms of this EULA. This license agreement represents the entire agreement concerning the program between you and toolsfactory software inc., and it supersedes any prior proposal, representation, or understanding between the parties. If you do not agree to the terms of this EULA, do not install or use the SOFTWARE PRODUCT. I The SOFTWARE PRODUCT is protected by copyright laws and international copyright treaties, as well as other intellectual property laws and treaties. The SOFTWARE PRODUCT is licensed, not sold. 1. GRANT OF LICENSE. The SOFTWARE PRODUCT is licensed as follows: (a) Installation and Use. toolsfactory software inc. grants you the right to install and use copies of the SOFTWARE PRODUCT on your computer. (b) EVALUATION LICENSE. This section ("EVALUATION LICENSE") applies if you are using an evaluation version of the SOFTWARE PRODUCT. An evaluation version of the SOFTWARE PRODUCT is defined as a version that operates using a time-limited trial key. You may use the SOFTWARE PRODUCT for evaluation purposes only. You may use the SOFTWARE PRODUCT to test whether it meets you demands. You must not distribute materials produced by the SOFTWARE PRODUCT to computer systems different from the computer on which the SOFTWARE PRODUCT is installed, regardless of how such a distribution takes place. You must not modify any material produced by the Software, including but not limited to computer files which where created as a result of the usage of the SOFTWARE PRODUCT. You are not allowed to sell, rent, lease or otherwise use commercially files or parts of files which where created by the SOFTWARE PRODUCT. The SOFTWARE PRODUCT may be equipped with a mechanism that prevents the usage of the SOFTWARE PRODUCT after a certain period of time has elapsed. You must not take steps to circumvent the expiration of this time period. You agree that you will delete the SOFTWARE PRODUCT from all computer systems to which you have installed it when this date has been reached. (c) COMMERCIAL LICENSE. 1 / 8
The terms of this section ("COMMERCIAL LICENSE") do apply only if you own a commercial license of the SOFTWARE PRODUCT. "Desktop" is defined as an "end-user" personal computer (PC). "Build Server" is defined as a computer system that runs automated processes without user interaction configured with the intention of multiple people accessing it for any kind of service. "Developer" is defined as an individual engaged in the development of a software application. "Help Author" is defined as an individual engaged in the creation of documentation. "Contributing" is defined as being engaged in the development of source code and documentation. "Site" is defined as one physical location of a company or organization. Depending on the license acquired you may install the SOFTWARE PRODUCT on a desktop (DESKTOP LICENSE) or on a build server (BUILD SERVER LICENSE). I (i) DESKTOP LICENSE. A DESKTOP LICENSE entitles you to use the SOFTWARE PRODUCT on a Desktop. (ii) BUILD SERVER LICENSE. A BUILD SERVER LICENSE entitles you to use the SOFTWARE PRODUCT on a Build Server. You may use the SOFTWARE PRODUCT to process source code and documentation with up to 25 Contributing Developers or Help Authors. (d) EDUCATIONAL LICENSE. The restrictions of this section ("EDUCATIONAL LICENSE") do apply only if you own a EDUCATIONAL license for the SOFTWARE PRODUCT. In addition all terms of section (c) ("COMMERCIAL LICENSE") apply. You may use the SOFTWARE PRODUCT only if you have been authorized by toolsfactory software inc. to do so. You may use the SOFTWARE PRODUCT only for the sole purpose of creating documentation systems used as part of your non-commercial academic work. You are allowed to use the SOFTWARE PRODUCT for non-commercial purposes only. You are not allowed to sell, rent, lease or otherwise use commercially files or parts of files which where created by the SOFTWARE PRODUCT. (e) DOC-O-MATIC 7 EXPRESS NON-COMMERCIAL USE LICENSE The restrictions of this section ("DOC-O-MATIC EXPRESS NON-COMMERCIAL USE LICENSE") apply to users operating DOC-O-MATIC 7 EXPRESS using a trial key. You may use the SOFTWARE PRODUCT for non-commercial purposes only. You are not allowed to sell, rent, lease or otherwise use commercially files or parts of files which where created by the SOFTWARE PRODUCT. Use of the SOFTWARE PRODUCT is expressly prohibited in for-profit and government entities. (f) Backup Copies. You may also make copies of the SOFTWARE PRODUCT as may be necessary for backup and archival purposes. 2. DESCRIPTION OF OTHER RIGHTS AND LIMITATIONS. (a) Maintenance of Copyright Notices. 2 / 8
You must not remove or alter any copyright notices on any and all copies of the SOFTWARE PRODUCT. (b) Distribution. You may not distribute copies of the SOFTWARE PRODUCT or parts thereof to third parties. (c) Prohibition on Reverse Engineering, Decompilation, and Disassembly. You may not reverse engineer, decompile, or disassemble the SOFTWARE PRODUCT, except and only to the extent that such activity is expressly permitted by applicable law notwithstanding this limitation. (d) Rental. You may not rent, lease, or lend the SOFTWARE PRODUCT. I (e) Support Services. toolsfactory software inc. may provide you with support services related to the SOFTWARE PRODUCT ("Support Services"). Any supplemental software code provided to you as part of the Support Services shall be considered part of the SOFTWARE PRODUCT and subject to the terms and conditions of this EULA. (f) Compliance with Applicable Laws. You must comply with all applicable laws regarding use of the SOFTWARE PRODUCT. (g) XML Schema Files are copyright of Borland Software Corporation dba CodeGear. Borland and/or its licensors retain any and all right, title and interest in and to the XML Schema Files. This Agreement grants no additional expressed or implied license, right or interest in any intellectual property right of Borland. You must not remove any Borland copyright, trade secret or other proprietary rights notice from XML Schema Files. You must not copy, modify, port, translate, localize, or create derivative works of the XML Schema Files. You must not decompile, disassemble or otherwise reverse engineer the XML Schema Files. You must not sell distribute license or otherwise make available the XML Schema Files. 3. TERMINATION Without prejudice to any other rights, toolsfactory software inc. may terminate this EULA if you fail to comply with the terms and conditions of this EULA. In such event, you must destroy all copies of the SOFTWARE PRODUCT in your possession. 4. COPYRIGHT All title, including but not limited to copyrights, in and to the SOFTWARE PRODUCT and any copies thereof are owned by toolsfactory software inc. or its suppliers. All title and intellectual property rights in and to the content which may be accessed through use of the SOFTWARE PRODUCT is the property of the respective content owner and may be protected by applicable copyright or other intellectual property laws and treaties. This EULA grants you no rights to use such content. All rights not expressly granted are reserved by toolsfactory software inc. 5. NO WARRANTIES toolsfactory software inc. expressly disclaims any warranty for the SOFTWARE PRODUCT. The SOFTWARE PRODUCT is 3 / 8
provided "As Is" without any express or implied warranty of any kind, including but not limited to any warranties of merchantability, noninfringement, or fitness of a particular purpose. toolsfactory software inc. does not warrant or assume responsibility for the accuracy or completeness of any information, text, graphics, links or other items contained within the SOFTWARE PRODUCT. toolsfactory software inc. makes no warranties respecting any harm that may be caused by the transmission of a computer virus, worm, time bomb, logic bomb, or other such computer program. toolsfactory software inc. further expressly disclaims any warranty or representation to Authorized Users or to any third party. 6. LIMITATION OF LIABILITY In no event shall toolsfactory software inc. be liable for any damages (including, without limitation, lost profits, business interruption, or lost information) rising out of 'Authorized Users' use of or inability to use the SOFTWARE PRODUCT, even if toolsfactory software inc. has been advised of the possibility of such damages. In no event will toolsfactory software inc. be liable for loss of data or for indirect, special, incidental, consequential (including lost profit), or other damages based in contract, tort or otherwise. toolsfactory software inc. shall have no liability with respect to the content of the SOFTWARE PRODUCT or any part thereof, including but not limited to errors or omissions contained therein, libel, infringements of rights of publicity, privacy, trademark rights, business interruption, personal injury, loss of privacy, moral rights or the disclosure of confidential information. Sie dürfen Dateien oder Teile von Dateien, die von dem SOFTWAREPRODUKT erzeugt wurden nicht verkaufen, nicht vermieten oder verleasen oder in einer sonstigen Art und Weise kommerziell nutzen. Es ist möglich, dass das SOFTWAREPRODUKT mit einem Mechanismus ausgestattet ist, der die Verwendung des SOFTWAREPRODUKTES nach Ablauf einer bestimmten Zeitperiode 5 / 8
unmöglich macht. Sie dürfen keine Schritte unternehmen, um den Ablauf der Zeitperiode zu umgehen. Sie stimmen zu, dass Sie das SOFTWAREPRODUKT von allen Computersystemen, auf denen Sie es installiert haben, entfernen werden, wenn dieses Datum eingetreten ist. (c) KOMMERZIELLE LIZENZ. Die Bestimmungen dieses Abschnittes ("KOMMERZIELLE LIZENZ") finden nur Anwendung, wenn Sie eine kommerzielle Lizenz des SOFTWAREPRODUKTES besitzen. "Desktop" ist definiert als PC eines "Endbenutzers". Eine BUILD-SERVERLIZENZ berechtigt Sie dazu, das SOFTWAREPRODUKT auf einem Build-Server zu verwenden. Sie dürfen das SOFTWAREPRODUKT dazu verwenden um Sourcecode und Dokumentation mit bis zu 25 beitragenden Entwicklern und Hilfeautoren zu verarbeiten. (d) UNTERRICHTSLIZENZ. Die Beschränkungen dieses Abschnittes ("UNTERRICHTSLIZENZ") gelten nur, wenn Sie eine UNTERRICHTSLIZENZ für das SOFTWAREPRODUKT erworben haben. Zusätzlich gelten alle Bestimmungen des Abschnittes (c) ("KOMMERZIELLE LIZENZ"). Sie dürfen das SOFTWAREPRODUKT nur verwenden, wenn Sie von der toolsfactory software inc. dazu ermächtigt wurden. Sie dürfen das SOFTWAREPRODUKT für den alleinigen Zweck der Erstellung von Dokumentation als Teil einer nicht-kommerziellen akademischen Arbeit verwenden. Sie dürfen das SOFTWAREPRODUKT nur für nicht-kommerzielle Zwecke verwenden. Sie dürfen Dateien und Teile von Dateien, die mit dem SOFTWAREPRODUKT erstellt wurden nicht verkaufen, vermieten, verleasen oder anderweitig kommerziell verwenden. II (e) DOC-O-MATIC 7 EXPRESS LIZENZ FÜR DIE NICHT-KOMMERZIELLE NUTZUNG Die Beschränkungen dieses Abschnittes ("EXPRESS LIZENZ FÜR DIE NICHT-KOMMERZIELLE NUTZUNG") gelten für Benutzer, die DOC-O-MATIC 7 EXPRESS unter Verwendung eines Testschlüssels betreiben. Sie dürfen das SOFTWAREPRODUKT für nicht-kommerziellen Zwecke verwenden. Sie dürfen Dateien und Teile von Dateien, die mit dem SOFTWAREPRODUKT erstellt wurden nicht verkaufen, vermieten, verleasen oder anderweitig kommerziell verwenden. Die Verwendung des SOFTWAREPRODUKTES ist für gewinnorientierte Unternehmen und Verwaltungsbehörden 6 / 8
ausdrücklich untersagt. (f) Backup-Kopien. Sie dürfen Kopien des SOFTWAREPRODUKT, die für Backup oder archivarische Zwecke notwendig sind, anlegen. 2. BESCHREIBUNG ANDERER RECHTE UND BESCHRÄNKUNGEN. (a) Aufrechterhaltung der Urheberrechtsvermerk. Sie dürfen die Urheberrechtsvermerke auf den Kopien des SOFTWAREPRODUKTES nicht verändern oder entfernen. (b) Übertragung. Sie dürfen Kopien des SOFTWAREPRODUKT und Teile davon nicht an dritte Parteien übertragen. (c) Verbot des Reverse Engineering, des Dekompilierens und Disassemblierens. Sie dürfen das SOFTWAREPRODUKT nicht reverse engineeren, dekompilieren, oder disassemblieren, ausser zu dem Ausmass, als eine solche Aktivität unter anwendbarem Recht, trotz bestehender Beschränkung, erlaubt ist. (d) Vermietung. Sie dürfen das SOFTWAREPRODUKT nicht vermieten oder verleihen. (e) Supportdienste. toolsfactory software inc. kann Ihnen Supportdiensten in Verbindung mit dem SOFTWAREPRODUKT("Supportdienste") gewähren. Jeder zusätzliche Softwarecode, der Ihnen als Teil des Supportdienstes zur Verfügung gestellt wurde, wird als Teil des SOFTWAREPRODUKTES angesehen und unterliegt den Bestimmungen und Bedingungen dieses EULAs. (f) Befolgung von anwendbaren Gesetzen. Sie müssen alle anwendbaren Gesetze im Hinblick auf die Verwendung des SOFTWAREPRODUKTES befolgen. (g) Das Urheberrecht an den XML Schema-Dateien ist in Besitz der Borland Software Corporation dba CodeGear. Borland und/oder sein Lizenzgeber behalten alle Rechte, Titel und Interessen in und an den Urheberrecht XML Schema-Dateien. Diese Vereinbarung gewährt weder ausdrücklich noch implizit zusätzlichen Lizenzen, Rechte oder Interessen an dem geistigen Eigentum von Borland. Sie dürfen keine Schutzvermerke für Urheberrechte, Betriebsgeheimnisse oder Eigentumsrechte von Borland aus den XML Schema-Dateien entfernen. Sie dürfen die XML Schema-Dateien nicht kopieren, verändern, portieren, übersetzen, lokalisieren oder daraus abgeleitete Werke erstellen. Sie dürfen die XML Schema-Dateien nicht dekompilieren, disassemblieren oder sonst reverse engineeren. Sie dürfen die XML Schema-Dateien nicht verkaufen, die Lizenz übertragen oder auf sonstige Weise verfügbar machen. II 3. KÜNDIGUNG Ohne Rücksicht auf andere Rechte ist toolsfactory software inc. berechtigt, das EULA zu kündigen, wenn Sie die Bestimmungen und Bedingungen des EULAs nicht einhalten. In diesem Fall müssen Sie alle Kopien des SOFTWAREPRODUKT in Ihrem Besitz zerstören. 7 / 8
4. URHEBERRECHT Alle Eigentumsrechte, und sonstige Rechte einschliesslich aber nicht beschränkt auf das Urheberrecht an dem SOFTWAREPRODUKT und alle Kopien davon sind im Besitz der toolsfactory software inc. oder seiner Zulieferer. Alle Eigentumsrechte und Immaterialgüterrechte an dem Inhalt, der durch die Verwendung des SOFTWAREPRODUKTES zugänglich gemacht wurde, ist im Besitz des jeweiligen Besitzers des Inhaltes oder ist möglicherweise durch anwendbare Urheberrechtsgesetze oder Gesetze zum Schutz geistigen Eigentums oder Verträge geschützt. Dieses EULA gewährt keine Rechte diesen Inhalt zu verwenden. Alle Rechte, die nicht ausdrücklich gewährt werden, bleiben der toolsfactory software inc. vorbehalten. 5. KEINE GARANTIEN toolsfactory software inc. lehnt ausdrücklich alle Garantien für das SOFTWAREPRODUKT ab. Das SOFTWAREPRODUKT wird geliefert wie "es ist" ohne ausdrückliche oder implizite Garantien irgendwelcher Art, einschliesslich aber nicht beschränkt auf die Garantie für Gebrauchstauglichkeit, Nichtvertragsbruch, oder die Gebrauchstauglichkeit für einen bestimmten Zweck. toolsfactory software inc. garantiert nicht und übernimmt keine Verantwortung für die Richtigkeit oder Vollständigkeit irgendwelcher Informationen, Texte, Graphiken oder Verknüpfungen oder anderen Bestandteilen im SOFTWAREPRODUKT. toolsfactory software inc. gibt keine Garantien in Bezug auf Schäden, die möglicherweise durch die Übertragung von Computerviren, Würmer, Zeitbomben, logische Bomben oder solche Computerprogramme verursacht werden können, ab. toolsfactory software inc. lehnt weiters alle Garantien oder Zusicherungen an autorisierte Benutzer oder dritte Parteien ab. 6. HAFTUNGSBESSCHRÄNKUNG Unter keinen Umständen ist toolsfactory software inc. für Schäden irgendwelcher Art (einschliesslich, ohne Beschränkung, Gewinnentgang, Betriebsunterbrechung, oder Informationsverlust), die durch die Verwendung durch 'Autorisierte Benutzer' des SOFTWAREPRODUKTES entstehen, auch wenn toolsfactory software inc. auf die Möglichkeit dieser Schäden hingewiesen wurde, haftbar. Unter keinen Umständen ist toolsfactory software inc. haftbar für den Verlust von Daten, oder für indirekte, ungewöhnliche, zufällige, oder Folgeschäden (einschliesslich Gewinnentgang) oder andere Schäden aus dem Vertrag, aus Schadenersatz oder sonstige Rechtsgründe. toolsfactory software inc. trägt keine Haftung in Bezug auf den Inhalt des SOFTWAREPRODUKTES oder irgendeines Teiles davon, einschliesslich aber nicht beschränkt auf darin enthaltene Fehler oder Auslassungen, für Verletzung der Ehre, des Namensrecht, der Verletzung am eigenen Bild, Verletzung der Privatspäre, des Markenrechte, Betriebsunterbrechung, persönliche Verletzungen, Verlust von Schutz der Privatsphäre, moralische Rechte und Offenlegung von vertraulicher Information.
