Die permanente Verfassung und das Ausscheiden der National Party (NP) aus der Regierung der nationalen Einheit im Jahre 1996 haben die Aussichten eines politischen Ausgleichs in dieser pluralen Gesellschaft geschwächt. Nachdem der African National Congress (ANC) zur dominanten Partei wurde, setzten manche Beobachter ihre Hoffnungen darauf, dass der ANC zu einer inklusiveren und partizipatorischeren Partei werde. Diese Entwicklung lässt sich als Übergang von einer Standardform der Konkordanzdemokratie zwischen (segmentierten) Parteien zur Konkordanz innerhalb einer (Konkordanz) Partei beschreiben. Der Aufsatz untersucht die Chancen bzw. Aussichten bezüglich einer solchen Entwicklung für den ANC und richtet sein Augenmerk vor allem auf die Organisation der Partei, die innerparteiliche Repräsentation, und den internen Ausgleich sozialer Konflikte. Die Analyse bezieht vergleichende Erkenntnisse über andere Konkordanzparteien wie die Congress Party in Indien, Alliance Party/National Front in Malaysia und die Kenya African National Union (KANU) mit ein. Es wird gezeigt, dass der ANC eine noch negativere Auffassung partei-interner Konkordanz besitzt als von klassischer Konkordanzdemokratie. Diese Tatsache weist auf die Wahrscheinlichkeit einer dauerhaften politischen Marginalisierung der Minderheiteninteressen in Südafrika hin. In Northern Ireland, the system for power sharing prescribed in the 1998 Good Friday Agreement has repeatedly broken down. In Bosnia-Herzegovina, the system prescribed under the Dayton Accord of 1995 depends for its survival on the presence of a substantial international peacekeeping force. From Power Sharing to Democracy examines the theoretical underpinnings of power sharing as a means of achieving sustainable democratic governance. International scholars examine key areas, including Afghanistan, Cyprus, Kosovo, Macedonia, and South Africa, where power-sharing constitituons and political institutions have been employed or proposed. They provide an in-depth exploration of consociationalism, under which the previously warring ethnic communities are guaranteed a proportionate share of political offices and protection of their vital interests, and federalism, which provides for substantial territorial autonomy in cases where the communities are territorially segregated. Minorities and indigenous peoples recognize that, as well as their right to a distinctive group identity, they are entitled to participation in the political, cultural, social and economic life of the countries where they live. Members of majority communities concerned about long-term equity, stability and peace in their societies accept this equally. The lack of such participation can have major repercussions - economic costs, violent conflict and ruined lives. This report by Professor Yash Ghai, a leading constitutional lawyer, clearly describes the range of devices that can be used to provide for participation - representation, power sharing, autonomy and self-determination - and discusses the experiences of constitutional and political provision for minorities and indigenous peoples. The author supplements this discussion with a wealth of examples: Bosnia and Herzegovina, Cyprus, Fiji, India, Northern Ireland and South Africa, amongst others. While there is agreement that participation in public affairs is central to minorities sense of identity, to their feeling a part of the wider community and to protect their interests, there is less agreement on how such participation should be facilitated and structured. The debate between those who favour as much self-government by minorities as possible and those supporting measures designed to encourage the political integration of minorities is likely to continue. This report recommends avoiding generalizations and instead argues that choices should be made in relation to case-specific circumstances and constraints. With this in mind, the report sets out a menu of possible approaches and modalities in the hope of furthering the cause of intercommunity cooperation throughout the world. In principle, this form of government enables communities that have conflicting identities to remedy longstanding patterns of discrimination and to co-exist peacefully. Key arguments in support of this view can be found in the highly influentional works of Arend Lijphart and Donald Horowitz. Power sharing seeks to explore the unintended consequences of power sharing for the communities themselves, their individual members, and for others in society. More specifically, it is distinctive in questioning explicitly whether powersharing: perpetuates intercommunal conflict by institutionalising difference at the political level; inhibits conflict resolution by encouraging extremism; stifles internal diversity; and fails to leave sufficient space for individual autonomy. This book not only provides a theoretical exploration and critique of these questions, but also comprehensively examines specific test cases where power-sharing institutions have been established, including Northern Ireland, Belgium, Bosnia- Herzegovina, Macedonia and Lebanon. This multi-year venture has been accompanied by three major workshops on project methodology, initial chapter reviews and final discussions. A point was made of including both scholars and practitioners involved in power-sharing settlements in the review process, in the hope that more would be learned about the actual

The project team was united in its wish to explore whether long-standing secessionist conflicts have been addressed effectively through the significant number of self-determination settlements that were generated in response to the wave of internal conflicts of the 1990s. It was also committed to testing whether consociationalist and integrative tecniques of conflict settlement really are as mutually exclusive as is sometimes supposed, or whether they can in fact be mutually reinforcing. Finally, the project derives its impetus from the necessity to critically rethink the doctrine of self-determination. One may question whether its traditional, restrictive interpretation will be adequate in confronting the wide variety of future challenges to the territorial integrity of states. Hierfür werden in diesem Beitrag zunächst zwei ideengeschichtliche Traditionen unterschieden. Die funktionalistische Gewaltentrennung findet sich in den Modellen der Volkssouveränität (z. B. Locke, Rousseau, Sieyes und Kant), während die Aufteilung der staatlichen Macht auf Montesquieu zurückzuführen ist und prominent in den Federallst Papers vertreten wird. Tsebelis Vetospieler- Theorie ist insbesondere an die letztere Tradition anschlussfähig und kann als empirisch-analytisches Konzept zur Feststellung tatsächlicher Machtteilung politischer Systeme herangezogen werden. Sie erweist sich jedoch an einigen Punkten auch in Bezug auf die ideengeschichtlichen Leitbilder als zu eng. Ich schlage daher eine Modifikation vor, die es erlaubt, auch gesellschaftliche Akteure zu berücksichtigen. Ziel ist es, zentrale Mechanismen des politischen Spiels zu identifizieren, um das Ausmaß an Machtteilung vergleichend bestimmen und auf einem Vektor der Machtteilung abbilden zu können.
