Adresse:.. beauftragt hiermit die Auszeit-weltweit Reisen GmbH (im weiteren Verlauf Auszeit genannt), Marspfortengasse 6, 50667 Köln einen Au Pair Aufenthalt in Australien für die/den Teilnehmer/in zu vermitteln. Auszeit vermittelt in fremdem Namen Programme und touristische Einzelleistungen anderer Organisationen und haftet für die ordnungsgemäße Vermittlungstätigkeit, nicht jedoch für die vermittelten Leistungen selbst. Beide Vertrags-Parteien vereinbaren: 1.1 Vermittlungsleistungen von Auszeit Vor der Ausreise Ausführliches Informieren der/des Teilnehmerin/ Teilnehmers über die aktuellen allgemeinen Bedingungen der Partnerorganisation und über die Aufnahmemodalitäten in das Programm (siehe Website). Beratung und Betreuung vor der Ausreise (Unterstützung bei Erstellung der Anmeldeunterlagen, bei der Suche nach einem günstigen Flug (nur Vermittlung). Auszeit empfiehlt der/dem Teilnehmer/in, eine Auslandsversicherung und eine Rücktrittskostenversicherung abzuschließen. Auszeit berät die/den Teilnehmer/in über entsprechende Angebote. Die Entscheidung darüber, welcher Schutz gewählt und gebucht wird, obliegt allein der/dem Teilnehmer/in. Die/Der Teilnehmer/in ist bereit die ihr/ihm gestellten Aufgaben nach bestem Wissen und Können auszuführen. Die/Der Teilnehmer/in ist sich im Klaren darüber, dass Australien ein anderer Kontinent mit anderen Gewohnheiten, Ansichten, Mentalitäten ist und akzeptiert diese. Die/Der Teilnehmer/in verpflichtet sich, die Sitten und Gesetze des Gastlandes während des Aufenthaltes zu befolgen. Die/Der Teilnehmer/in informiert sich selber über aktuelle Sicherheitshinweise sowie über die medizinische Situation in Australien (z.b. beim Auswärtigen Amt). Die/Der Teilnehmer/in informiert sich über aktuelle Einreisebestimmungen (z.b. bei der Botschaft). Die/Der Teilnehmer/in benachrichtigt Auszeit sowie deren Partnerorganisation in Australien umgehend, falls er/sie die Teilnahme am Programm nicht mehr wünscht. 3. Gebühren Die/Der Teilnehmer/in verpflichtet sich mit Zusenden ihrer/seiner Anmeldeunterlagen (inkl. Vertrag) zur Zahlung einer Anmeldegebühr in Höhe von 49. Die/Der Teilnehmer/in verpflichtet sich, für die Vermittlungsleistungen von Auszeit eine Vermittlungsgebühr in Höhe von 350 an Auszeit zu zahlen. Die Vermittlungsgebühr wird fällig sobald die Platzierung in einer Gastfamilie erfolgreich war. Rücktritt Wenn der/die Teilnehmer/in vor Programmstart von der Teilnahme an dem Programm zurücktreten möchte, nachdem sie/er erfolgreich in einer Gastfamilie platziert wurde, wird neben der Anmeldegebühr eine Bearbeitungsgebühr von 250 erhoben. Dem Teilnehmer steht es frei, Auszeit nachzuweisen, dass durch seinen Rücktritt kein bzw. ein der Höhe nach geringerer Aufwand als die geltend gemachten Bearbeitungskosten entstanden ist. Ein kostenfreier Rücktritt nach Programmbeginn ist mit Ausnahme der gesetzlichen Gewährleistungsansprüche ausgeschlossen. Tritt der/die Teilnehmer/in während des Aufenthaltes vom Vertrag zurück, steht ihr/ihm unabhängig von Grund und Zeitpunkt der Absage, keine Rückerstattung der Vermittlungsgebühr zu. Anspruch auf eine Erstattung über etwaig ersparte Aufwendungen hinaus, besteht nicht. Unberührt hiervon bleiben 1/3
gesetzliche gewährleistungsrechtliche Ansprüche des Teilnehmers bei Mangelhaftigkeit der Vermittlungsoder Programmleistung, Schlecht- oder Nichterfüllung des Vertrages. 5. Haftung Auszeit haftet als Vermittler dafür, dass die Vermittlung, die Abwicklung der Platzierung, das Inkasso und die Übermittlung von Unterlagen mit der Sorgfalt eines ordentlichen Kaufmanns vorgenommen werden. Auszeit haftet nicht dafür, dass ein dem Platzierungsauftrag entsprechender Vertrag mit der Partnerorganisation oder deren Leistungsträger zustande kommt. Auszeit haftet nur für Fehler in seinem eigenen Verantwortungsbereich, also für Vermittlungsfehler, die Auszeit selbst oder seine Mitarbeiter oder Erfüllungsgehilfen begehen, wie z.b. bei fehlerhafter Beratung oder nicht auftragsgemäß durchgeführter Platzierung. Die Haftung des Reisevermittlers Auszeit ist auf Vorsatz und grobe Fahrlässigkeit beschränkt, soweit eine etwaige Pflichtverletzung des Reisevermittlers nicht vertragliche Hauptpflichten des Reisevermittlers oder Ansprüche des Kunden aus Körperschäden betrifft. Angaben über Programminhalte und touristische Einzelleistungen beruhen auf den Informationen unserer Partnerorganisation oder deren Leistungsträger. Wir geben keine eigenen Zusicherungen für Richtigkeit, Vollständigkeit oder Aktualität der dem/r Teilnehmer/in vermittelten Informationen. Auszeit übernimmt keinerlei Haftung für Schäden, die von Dritten verursacht wurden. Dies gilt insbesondere für Verkehrsunfälle und auch für andere Risiken, die bspw. durch die gesellschaftliche Situation des Gastlandes verursacht werden. Auszeit ist nicht dafür verantwortlich, wenn es der/dem Teilnehmer/in im Zielland nicht gefällt oder der Aufenthalt nicht ihren/seinen Vorstellungen entspricht. Hat die/der Teilnehmer/in etwas zu beanstanden, ist er/sie verpflichtet, die Probleme Auszeit sowie deren Partnerorganisation im Zielland sofort (schriftlich) mitzuteilen, damit direkt vor Ort nach einer Lösung zur Abhilfe gesucht werden kann. Wird erst nach Rückkehr etwas beanstandet, ohne das oben genannte Vorgehen eingehalten zu haben, kann die/ der Teilnehmer/in keine Forderungen geltend machen. 6. Sonstiges Durch Unterschreiben dieses Vertrages stimmt die/der Teilnehmer/ in einer Weiterleitung ihrer/seiner persönlichen Daten zur Abwicklung des Programms zu. Die/Der Teilnehmer/in bestätigt, dass sie/er die Programminformationen und Bedingungen der Partnerorganisation zur Kenntnis genommen hat. Die/der Teilnehmer/in kann ohne Rückzahlung der Vermittlungsgebühr von der Teilnahme ausgeschlossen werden, falls sie/er die Programmvorschriften trotz vorhergehender Abmahnung weiter grob fahrlässig verletzt. Dem Teilnehmer steht es frei, Auszeit nachzuweisen, dass durch sein vertragswidriges Verhalten jedoch kein, bzw. ein der Höhe nach geringerer Schaden als die geltend gemachten anteilig verbleibenden Vermittlungsgebühr entstanden ist. Schlussbestimmungen Änderungen oder Ergänzungen dieses Vertrages bedürfen zu ihrer Gültigkeit der Schriftform, ebenso die Aufhebung der Schriftlichkeitsklausel. Abweichend von Satz 1 sind auch formlos getroffene Änderungen oder Ergänzungen dieses Vertrags wirksam, wenn sie Individualabreden im Sinne von 305b BGB sind. Unwirksamkeit einer einzelnen Bestimmung dieses Vertrags berührt andere Bestimmungen dieses Vertrags nicht. Es findet das Recht der Bundesrepublik Deutschland Anwendung. Sie können dafür das beigefügte Muster-Widerrufsformular verwenden, das jedoch nicht vorgeschrieben ist. Zur Wahrung der Widerrufsfrist reicht es aus, dass Sie die Mitteilung über die Ausübung des Widerrufsrechts vor Ablauf der Widerrufsfrist absenden. Folgen des Widerrufs Wenn Sie diesen Vertrag widerrufen, haben wir Ihnen alle Zahlungen, die wir von Ihnen erhalten haben, unverzüglich und spätestens binnen vierzehn Tagen ab dem Tag zurückzuzahlen, an dem die Mitteilung über Ihren Widerruf dieses Vertrags bei uns eingegangen ist. Für diese Rückzahlung verwenden wir dasselbe Zahlungsmittel, das Sie bei der ursprünglichen Transaktion eingesetzt haben, es sei denn, mit Ihnen wurde ausdrücklich etwas anderes vereinbart; in keinem Fall werden Ihnen wegen dieser Rückzahlung Entgelte berechnet.
