Oktober 2009 zur Änderung der Gebührenordnung und zur Anpassung des Betrags der Herabsetzung der Gebühr für die ergänzende europäische Recherche, wenn ein von einer der Internationalen Recherchenbehörden in Europa erstellter internationaler Recherchenbericht vorliegt (CA/D 19/09) DER VERWALTUNGSRAT DER EURO- PÄISCHEN PATENTORGANISATION, gestützt auf das Europäische Patentübereinkommen, insbesondere auf Artikel 33 Absatz 2 Buchstabe d und Artikel 153 Absatz 7, auf Vorschlag der Präsidentin des Europäischen Patentamts, nach Stellungnahme des Haushalts- und Finanzausschusses, BESCHLIESST: Artikel 1 Artikel 2 der Gebührenordnung erhält folgende Fassung: "Artikel 2 Im Übereinkommen und seiner Ausführungsordnung vorgesehene Gebühren (1) Die nach Artikel 1 an das Amt zu entrichtenden Gebühren werden wie folgt festgesetzt, sofern in Absatz 2 nichts anderes vorgesehen ist: EUR 1. Anmeldegebühr (Artikel 78 Absatz 2), wenn die europäische Patentanmeldung oder, im Falle einer internationalen Anmeldung, das Formblatt für den Eintritt in die europäische Phase (EPA Form 1200) online eingereicht wird 105 die europäische Patentanmeldung oder, im Falle einer internationalen Anmeldung, das Formblatt für den Eintritt in die europäische Phase (EPA Form 1200) nicht online eingereicht wird 190 Decision of the Administrative Council of 28 October 2009 amending the Rules relating to Fees and adjusting the amount of the reduction in the fee for the supplementary European search where the international search report was drawn up by one of the European International Searching Authorities (CA/D 19/09) THE ADMINISTRATIVE COUNCIL OF THE EUROPEAN PATENT ORGANISATION, Having regard to the European Patent Convention and in particular Articles 33(2)(d) and 153(7) thereof, On a proposal from the President of the European Patent Office, Having regard to the opinion of the Budget and Finance Committee, HAS DECIDED AS FOLLOWS: Article 1 Article 2 of the Rules relating to Fees shall be amended to read as follows: "Article 2 Fees provided for in the Convention and in the Implementing Regulations (1) The fees due to be paid to the Office under Article 1, unless otherwise provided in paragraph 2, shall be as follows: EUR 1. April 2009 eingereicht wurden, und für internationale Anmeldungen, die vor diesem Zeitpunkt in die regionale Phase eingetreten sind, werden die Beträge der Gebühren, die in Artikel 2 Nummern 3, 3a, 7 und 15 der bis zum 31. März 2009 geltenden Gebührenordnung genannt sind, wie folgt festgesetzt: 3. Benennungsgebühr für jeden benannten Vertragsstaat (Artikel 79 Absatz 2) mit der Maßgabe, dass mit der Entrichtung des siebenfachen Betrags dieser Gebühr die Benennungsgebühren für alle Vertragsstaaten als entrichtet gelten 90 3a. Gemeinsame Benennungsgebühr für die Schweizerische Eidgenossenschaft und das Fürstentum Liechtenstein Erteilungsgebühr einschließlich Druckkostengebühr für die europäische Patentschrift (Regel 71 Absatz 3) bei einer Seitenzahl der für den Druck bestimmten Anmeldungsunterlagen von 7.1 höchstens 35 Seiten mehr als 35 Seiten 830 zuzüglich 13 EUR für die 36. und jede weitere Seite 15. Article 2 The fee for a supplementary European search on an international application for which the international search report was drawn up by the Austrian Patent Office, or, in accordance with the Protocol on Centralisation, by the National Board of Patents and Registration of Finland, the Spanish Patent and Trademark Office, the Swedish Patent and Registration Office or the Nordic Patent Institute, shall be reduced by EUR 940. Artikel 4 Es gelten folgende Übergangsbestimmungen: (1) Unbeschadet des Absatzes 2 sind die in Artikel 1 dieses Beschlusses festgesetzten neuen Beträge der Gebühren für Zahlungen verbindlich, die ab dem 1. April 2010 geleistet werden. (2) Die neuen Beträge der Gebühr für eine internationale Recherche und der Übermittlungsgebühr für eine internationale Anmeldung sind für Patentanmeldungen verbindlich, die ab dem 1. April 2010 eingereicht werden. (3) Wird eine Gebühr innerhalb von sechs Monaten nach dem 1. April 2010 fristgerecht entrichtet, jedoch nur in der vor dem 1. April 2010 maßgebenden Höhe, so gilt diese Gebühr als wirksam entrichtet, wenn die Differenz innerhalb von zwei Monaten nach einer entsprechenden Aufforderung durch das Europäische Patentamt beglichen wird. (4) Artikel 2 dieses Beschlusses gilt für internationale Anmeldungen, die bis einschließlich 30. Juni 2013 eingereicht werden, wenn die Gebühr für eine ergänzende europäische Recherche ab dem 1. April 2010 entrichtet wird. Artikel 5 Der Beschluss CA/D 46/07 vom 14. Dezember 2007 (ABl. EPA 1/2008, 12) wird mit Wirkung vom 1. April 2010 aufgehoben und durch diesen Beschluss ersetzt. (4) Article 2 of this decision shall apply to international applications filed up to and including 30 June 2013, where the fee for the supplementary European search is paid on or after 1 April Article 5 Decision CA/D 46/07 of 14 December 2007 (OJ EPO 1/2008, 12) shall be rescinded as from 1 April 2010 and replaced by this decision. (4) L'article 2 de la présente décision est applicable aux demandes internationales déposées jusqu'au 30 juin 2013 inclus, lorsque la taxe due pour la recherche européenne complémentaire est acquittée à compter du 1 er avril Article 5 La décision CA/D 46/07 du 14 décembre 2007 (JO OEB 1/2008, 12) est annulée avec effet à compter du 1 er avril 2010 et remplacée par la présente décision.
