The annual report gives information about past and current activities, and takes a look ahead to our future focus topics for research. The growth in significance of the Gaming Research Center can be clearly seen by the Symposium. This yearly conference was for the first time in 2007 an all day event, with international attendees. The symposium was marked by the discussion over the German State Treaty on Gambling, which was drafted in December The individual presentations at the Symposium can be found in the 2007 conference proceedings, titled: New Legal Framework for the Gaming Industry (Neue Rechtliche Rahmenbedingungen für das Glücksspielwesen). In the current year, the proceedings from the Symposium in 2006 were released, titled: Gambling in Upheaval (Glücksspiel im Umbruch). The director and the members of the scientific management board have participated in numerous conferences and events, presenting their research results. In addition, media interest in the Gaming Research Center has increased. Particularly pleasing is the intensifying of contacts with the national press. This increase indicates that the Gaming Research Center is established as a recognized source for information concerning gaming and gambling themes. In addition, requests for information from various government agencies and officials have increased. The dialogue with politicians and policy makers was carried on in conjunction with various state and federal agencies, and various officials. One major topic of discussion consisted in whether slot machines could be included in the State Treaty of Gambling. Legal aspects also were the central focus of our newsletters, which in 2007 regularly reported on relevant current developments and decisions. We are especially pleased that this year three new members have joined us in the capacity of scientific management board: Prof. Dr. Sabine M. Grüsser-Sinopoli from the Johannes Gutenberg- University in Mainz, who sadly and surprisingly unexpectedly died on the 3 rd of January 2008; Prof. Dr. Christian Pohl from the Reinhold-Würth-Hochschule of the Hochschule Heilbronn in Künzelsau; and Prof. Dr. Dr. Helmut Schneider, who holds the SVI- Stiftungslehrstuhl for Marketing and Dialogmarketing at the Steinbeis-Hochschule Berlin. Thus we have drawn closer to our goal of having represented in our organization all academic members from the major disciplines that are relevant to our focus theme of games and gambling. In addition, we are pleased that we obtained further gaming industry members as sponsors. Furthermore, this year we added to our personnel Mrs. Heidi-Maria Götz, filling a second part time scientific staff member position. Without the support of the sponsorship association, which finances the work of the Gaming Research Center, this would have not been possible. Therefore, I would like to express my thanks to our sponsors for their support. Mrs. Götz is a valuable staff addition, and will focus on obtaining further sponsors and fostering wider public recognition for the Gaming Research Center. This new progress would not have been possible without the great teamwork between the advisory board of the Gaming Research Center and the board of trustees, the members of which I would like to express my thanks here. The goal of providing information, and presenting research results to the general public was fully met this year by the Gaming Research Center. As per our mission statement, we will in the following year seek to expand our international and Europe wide exchanges with other research institutions active in the gaming sector. The Gaming Research Center has established itself in Germany as the contact point for research in the area of gaming, and will in the future function on a European level. 1 2

2 Foreword from the Chairman of the Advisory Board and the Board of Trustees, Dr. Wolfgang G. Crusen This report marks the release of the third annual report for the Gaming Research Center. The need for such a central and interdisciplinary contact point for answering questions in the theme gambling was already illustrated by the first symposium, which occurred in November 2003, before the founding of the Research Center. I am pleased that not only the expectations and predictions from that time have been met, but that they have been exceeded. Again this year, my special thanks goes out to all participating parties and individuals, and most especially to Mr. Prof. Dr. Tilman Becker, who leads the Gaming Research Center with great expertise and unswerving commitment. This year, we have made significant steps on the path of becoming an internationally oriented research group that has as its focus legal and economic issues. Further areas of focus have included the theme of addiction with all of its multiple facets, and also all the market and economic implications of the entire gaming industry. The year 2007, with its debate and discussion of the new German State Treaty on Gambling once again showed how little research on the gambling market has been previously done, and how important it is that the political decision makers more comprehensively inform themselves on these issues, in light of the newly effective German State Treaty on Gambling. I am pleased that the Gaming Research Center at the, with its numerous researchers and scholars in various disciplines, plays a key role in this. The wide coverage of topics in which the Gaming Research Center is active would not have been possible without the intensive effort from Mr.. I also am quite pleased with the growing number of our sponsors. We are thankful that through their steady financial support we have the necessary leeway to strive towards our long term goals of increasing our international focus, a more in depth handling of our areas of focus, and broadening our research themes. As the current financial resources are still not at the level necessary to research the entire range of gambling themes, we would greatly appreciate if governmental and public institutions, which benefit from gambling games, become aware of the potential of the Gaming Research Center, and become interested in providing us with sustained financial support. 3 4 The Gaming Research Center The Gaming Research Center consists of the scientific management board and the advisory board. The institution is headed by the acting director, and he is supported by two staff members, Heidi-Maria Götz and Christine Baumann. The Gaming Research Center is financially supported by the Association for the Sponsorship of Research and Education on the Topic of Gaming and Betting (referred to as the Sponsorship Association in the following). The Sponsorship Association promotes interdisciplinary research on the topic of games and betting for solely non-profit purposes. At the time this report was written, the group of members consisted mainly of professors who were active at the. However, membership is open to academics and researchers from other universities or institutes that concern themselves with the themes of games of chance and betting, and upon application they can be included as members of the Gaming Research Center. Thus, to date, there are among the scientific leadership members various researchers and academics from other universities and institutes. The scientific management board consists of Gaming Research Center members, and they work in conjunction with the advisory board approving research projects, and managing and approving the research budget planning for the Gaming Research Center. The Gaming Research Center stands out due to its interdisciplinary approach. The advisory board is equally represented through four professors currently active in the Gaming Research Center and four representatives drawn from the industry or institutions that support the Gaming Research Center. The representatives for the sponsors are drawn from members of the sponsorship association. The sponsorship association is a nonprofit association. Upon application, interested companies and organizations which are active in the area of gaming, and are interested in supporting research concerning the topic of gaming and gambling, can be accepted as members of the association. The interdisciplinary Gaming Research Center has as its goal the implementation of scientific findings into policy and procedures, in other words facilitating a transfer of knowledge between the theoretical and the applied. This transfer is beneficial for both sides: Those involved in policy and procedures gain through the insights provided by theory, and academia gains from the insights won from the application of theory. KG The Sponsorship Association The Association for the Sponsorship of Research and Education on the topic of Gaming and Betting (referred to as Sponsorship Association in the following) was officially formed on the 16 th of December, This association sponsors scientific research and education on the topic of gaming and betting for solely non-profit purposes. Membership application is open to those interested in the purposes of the Sponsorship Association: private citizens, legal persons, partnerships, organizations and associations, as well as unofficial groups. The organizational structure of the Sponsorship Association consists of a Managing Director, the Board of Trustees and the Member Assembly. The Managing Director of the Gaming Research Center,, manages the business of the Sponsorship Association. The Board of Trustees is composed of up to seven representatives elected by the Advisory Committee, and serve three years. The Chairman of the Board of Trustees is Dr. Wolfgang G. Crusen. The Board of Trustees is composed of the following members:, Prof. Dr. Harald Hagemann, Matthias Früh and Bernhard Knäuper. The Member Assembly consists of the members of the Sponsorship Association, and is responsible for the election of members to the Board of Trustees, the selection of the comptroller, resolutions to alter by-laws, resolutions concerning the disbanding of the Sponsorship Association, decisions concerning budget approval and the discharge of the Director and the Board of Trustees, as well as responding to queries posed by the Director and the Board of Trustees. For example, probability theory and statistics originated from the analysis of dice games. The analysis of the socalled St. Petersburg Paradox, a game of chance with an infinite expected value, led to economic utility theory. Game theory originated form the analysis of parlour games. This illustrates that games of chance have long been of special significance for mathematicians and statisticians, and more recently games of chance have been of particular significance for economists as they provide a valuable research model from which new knowledge can be won. In the field of law, the legal perspective dominates the considerations. Jurisdiction is followed and commented on, the relevance of different legal decisions and interpretations are discussed, and a weighing of the legal ramifications occurs. data from addiction treatment centres for pathological gamblers indicates exactly the opposite. This example serves to illustrate the urgent need for an interdisciplinary overview of gambling and game of chance, in order for the formation of a rational political policy. While every researcher and academic involved with the Gaming Research Center hopes to win new knowledge for their discipline or area of research, the true potential of the Center lies in its interdisciplinary approach. The research results are not only of academic interest, but are also relevant for unsolved questions and problems arising in day to day implementation, and therefore of great interest. The goals of, as well as the questions proposed by research projects can be determined by the researcher alone, or developed in association with external potential clients and sponsors. In psychology and medicine, knowledge over pathological gaming is won, and therapy methods are developed. Even in these two well established research areas, up until now little has been done on an interdisciplinary basis. From the governmental perspective the justification for the regulation of gaming and gambling is based on protecting the public. Differences and comparisons between pathological gamblers and 'normal' players have been well researched. From the research conducted on addiction therapies, it is well known which forms of gambling pose a particularly high addiction potential and hazard. When the legal perspectives are compared with findings from the research done on gambling addiction, an astonishing discrepancy is noted, and it is only with such an interdisciplinary approach that such discrepancies can be found. Whereas from the legal perspective the lottery poses an especially grave hazard, and the cash game machines are viewed as posing only a minimal one, the 21 22

9 Symposium on June 29 th, 2007 Since its founding in 2004, the Gaming Research Center has developed into an internationally recognized institution. The Symposium Glücksspiel was held this year on the 29 th of June in 2007 at the. Once again, well over a hundred people participated in this yearly symposium. As the interest in the symposium this year was once again quite large, particularly from those in legal and academic fields, researchers, politicians, and for those in the gaming industry, one could state that the Symposium was an interesting and overall successful event. Prof. Siegbert Alber, retired Advocate General from ECJ, presented an overview of the basic principles of European gambling laws. This was followed by the presentation of Prof. Dr. Jörg Ennuschat from the University of Konstanz addressing the ramifications of European jurisdiction for Germany. Prof. Dr. Armin Dittmann, Chair of Public Law at the, addressed in his presentation the legal framework for the licensing model. In the fourth presentation, discussed from an economic perspective the three approaches of monopoly, licensing solutions or liberalising. Dr. Josef Skala from the Swiss Institute of Comparative Law in Lausanne addressed the theme of legal regulation of gambling in the EU member states. The impact of the drafted German State Treaty on Gambling was explored in a presentation from Georg Nagel, the Director of the Department Gambling, at the North Rhine Westphalian ministry of interior. Following the presentations, a discussion round over legal aspects took place. The names of those participating can be found in the program. 10 The German Gambling Market in the Year 2007 The gambling market in the year 2007 was marked by a series of national and international events. From the German perspective, a significant role was played by the signing of the German State Treaty on Gambling. Thereby, 16 German states agreed to a draft treaty on gambling. The treaty was ratified during the course of the year by the various individual state parliaments. To put the State Treaty into effect, the states also agreed on laws to implement it. The realization of this contract particularly impacted sports betting. In this case the primary impact fell on the private betting providers in the internet that hold a GDR-license. Particularly in this case it became clear even before the decision from the Federal Constitutional Court (Bundesverfassungsgericht), that there were areas that were legally unclear, as well as deficits in the implementation. During the course of the year a series of administrative courts and higher administrative courts tried to clarify these areas. Last, but not least, the Saxon higher administrative court in Bautzen has limited the area covered by a GDR-license to the five new German states. Germany is the awaited notification process of the EU commission s decision against the drafted State Treaty on Gambling. The main point of contention that the commission had against the planned internet gambling ban was that it was a disproportionate method of fighting gambling addiction and protecting juveniles. With a detailed position statement, the commission commented on the planned state treaty. From the viewpoint of the state casinos, the following significant events occurred in 2007: the decision of the Federal Constitutional Court (Bundesverfassungsgerichtshof) that recognized the Bavarian casino monopoly, and the decision of the Federal Supreme Court (Bundesgerichtshof) to widen the control duty placed on casinos in the case of gaming automats. On a European level, the gaming and gambling entities were impacted by the decisions of the European, and respectively the EFTA Court (The Placanica, Ladbrokes and ESA decisions). In Germany, the Placanica case was of great significance, as the European court explicitly addressed in its decision the application of national criminal law in cases concerning betting providers that possess a European license. In addition to the European Court of Justice, the EFTA court made two decisions impacting the rights of the Norwegian betting monopoly. While these decisions have no immediate impact on the gambling market in Germany, they could in the midterm be of great significance. Of great relevance for Timetable 2007 March 6th European Court of Justice decides in Placanica Case. March 14th EFTA Court dismisses claim of EFTA Surveillance Authority (ESA). March 22nd EU-Commission prolongs notification procedure for German State Treaty on Gambling. April 11th Department of county administration Munich imposes penalty payment of on AC Milan for advertisement for illegal gaming. March 26th Federal Constitutional Court confirms Bavarian casino monopoly. May 7th Administrative Court Gießen appeals to ECJ for preliminary ruling. May 15th Higher Administrative Court Bremen confirms compatibility of German State Treaty on Gambling with European law. May 30th EFTA Court comments on Ladbrokes case. July 24th Administrative Court Stuttgart passes sports betting case on to ECJ for preliminary ruling (which has been done before by Administrative Courts Gießen and Cologne). July 26th Administrative Court Baden-Württemberg bans perimeter advertising for bwin. September 5th Higher Regional Court Celle decides that it is anticompetitive to run the state lottery Quicky in public houses. November 22nd Federal Supreme Court decides on control duty placed on casinos (including slot games). December 12th Saxon Administrative Court in Bautzen limits range of GDR-licenses to five new German states. Future Perspectives As of 2007, the Gaming Research Center provides the general public with information and research findings, and is gaining in recognition and its level of contacts. Thus an increasing internationalization is planned for the following year. The midterm goal is to network relevant persons involved in gaming and gambling themed work on a European level. It is planned to covert the Gaming Research Center website to be bilingual (English and German). A re-working of our internet presence and presentation is also planned. From here on all further released materials that represent the Research Center, whether flyer or annual report, will be translated into English. In the case of the yearly gambling symposium, the number of presenters as well as the number of presentations will be increased. The symposium will take place on the 14 th and 15 th of February, with an international attendance. In addition, a further conference on the theme of illegal gambling is planned for the fall of
