Siemens License Conditions Software-Lizenzvertrag zur Überlassung der Software RMOS3-DEMO V1.0 in funktionsmäßig eingeschränktem Umfang ( Software ) zu Zwecken der persönlichen Ausbildung und des Studiums ( Education-Lizenzvertrag ) Dieser Education-Lizenzvertrag für Studenten und Lehrkräfte ist ein rechtsgültiger Vertrag zwischen Ihnen und der Siemens AG. Sie müssen diesen Education-Lizenzvertrag aufbewahren, um nachzuweisen, dass Sie befugt sind, die Software zu nutzen. Durch die Benutzung der Software erklären Sie sich damit einverstanden, an die Bestimmungen dieses Education-Lizenzvertrages gebunden zu sein. Fall Sie mit den Bestimmungen dieses Education-Lizenzvertrages nicht einverstanden sind, dürfen Sie die Software nicht benutzen. 1. Siemens gewährt Ihnen das nicht ausschließliche, nicht übertragbare zeitlich unbeschränkte Recht, eine Kopie der Software im Objektcode sowie die Dokumentation ausschließlich zu den in folgender Ziffer 2 genannten Zwecken auf einem Computer zu installieren und zu nutzen. 2. Die Nutzung der Software ist nur im Rahmen der persönlichen Aus- und Weiterbildung an staatlich anerkannten Bildungseinrichtungen sowie im Rahmen von Forschung und Lehre an Hochschulen ohne Gewinnerzielungsabsicht zulässig. 3. Soweit die Software Open Source Software ( OSS ) enthält, ist diese in den Dokumenten ReadMe_OSS.PDF und License_OSS.PDF aufgeführt. Sie sind berechtigt, die OSS gemäß den jeweils einschlägigen, für die OSS geltenden Lizenzbedingungen zu nutzen. Diese sind in den oben angegebenen Dateien aufgeführt. Für OSS gelten vorrangig vor den Regelungen dieses Education- Lizenzvertrages die Lizenzbedingungen, denen die jeweilige OSS unterliegt. Soweit die Lizenzbedingungen für die OSS eine Herausgabe des Quellcodes vorsehen, wird Siemens diesen auf Ihr Verlangen gegen entsprechenden Aufwendungsersatz zur Verfügung stellen. 4. Diese Software und die Dokumentation sind sowohl durch Urheberrechtsgesetze als auch internationale Urheberrechtsverträge sowie durch andere Gesetze und Vereinbarungen über geistiges Eigentum geschützt. Sie werden diese Rechte beachten, insbesondere alphanumerische Kennungen, Marken und Urheberrechtsvermerke weder von den Informationen noch von der Software noch von der Dokumentation noch von Kopien davon entfernen. 5. Weder Software noch Dokumentation dürfen von Ihnen zu irgendeiner Zeit an Dritte vertrieben, vermietet, verliehen, verleast oder in sonstiger Weise überlassen werden. Soweit nicht zwingende rechtliche Vorschriften etwas anderes erlauben, dürfen Sie Page 3 of 6
weder die Software noch deren Dokumentation ändern, zurückentwickeln oder - übersetzen noch Teile herauslösen. Sie dürfen eine Sicherungskopie der Software erstellen, wenn diese Kopie für die Sicherung künftiger Benutzung auf der Grundlage dieses Education-Lizenzvertrages erforderlich ist. Jede weitere Vervielfältigung der Software ist untersagt. 6. Software und Dokumentation werden unentgeltlich überlassen. Deshalb ist eine Haftung für Sach- und Rechtsmängel der Informationen, Software und Dokumentation, insbesondere für deren Richtigkeit, Fehlerfreiheit, Freiheit von Schutz- und Urheberrechten Dritter, Vollständigkeit und/oder Verwendbarkeit - außer bei Vorsatz oder Arglist - ausgeschlossen. 7. Im Übrigen ist jegliche Haftung der Siemens AG ausgeschlossen, soweit nicht z.b. nach dem Produkthaftungsgesetz, wegen Vorsatzes, grober Fahrlässigkeit, wegen Verletzung des Lebens, des Körpers oder Gesundheit, wegen der Übernahme einer Beschaffenheitsgarantie, wegen arglistigen Verschweigens eines Mangels oder wegen der Verletzung wesentlicher Vertragspflichten zwingend gehaftet wird. Der Schadensersatz wegen Verletzung wesentlicher Vertragspflichten ist jedoch auf den vertragstypischen, vorhersehbaren Schaden begrenzt, soweit nicht Vorsatz oder grobe Fahrlässigkeit vorliegt. Eine Änderung der Beweislast zu ihrem Nachteil ist mit den vorstehenden Regelungen nicht verbunden. 8. Es gilt deutsches Recht unter Ausschluss des UN-Kaufrechts vom 11.4.1980.
