2 Harmonisierte Normen und ihre Vermutungswirkung Der Hersteller muss für jedes explosionsgeschützte Gerät neben der Betriebsanleitung auch eine Konformitätserklärung gemäss Richtlinie 2014/34/EU Anhang X mitliefern. Unter anderem muss die Konformitätserklärung die Angabe der einschlägigen harmonisierten Normen oder der anderen technischen Spezifikationen enthalten. Die harmonisierten Normen müssen mit der im Europäischen Amtsblatt (Official Journal «OJ») publizierten Liste übereinstimmen. Nur jene harmonisierten Normen, die im Zeitpunkt der Inverkehr setzung gelten, können für die Vermutungswirkung herangezogen werden. Der Hersteller ist verantwortlich, dass bei neuen Ausgaben der Normen eine Differenzbetrachtung zwischen den Normenausgaben mit einer Bewertung der für das Gerät zutreffenden Änderungen stattfindet und ein entsprechendes Update der Konformitätserklärung erfolgt. Beim Erscheinen einer neuen IEC-Norm kann die entsprechende alte EN-Norm normalerweise noch etwa 3 Jahre herangezogen werden. Diese Übergangsfrist wird ebenfalls im OJ angegeben. Seit einigen Jahren wird verlangt, dass jede Norm eine Liste enthält, welche Angaben zu geringen redaktionellen Änderungen, zu Erweiterungen oder zu bedeutenden technischen Änderungen enthält. Diese Liste kann für die Differenzbetrachtung herangezogen werden. Es kann beispielsweise vorkommen, dass ein explosionsgeschütztes Gerät von der neuen Ausgabe einer Norm nicht betroffen ist. In diesem Fall kann der Hersteller die neue Norm für die Konformitätsvermutung heranziehen, ob - wohl die EG- bzw. EU-Baumusterprüfbescheinigung die Vorgängernorm enthält. Der Hersteller führt dafür verpflichtend eine Analyse und eine Bewertung zwischen den beiden Normenausgaben durch und prüft, ob sein Gerät von den Änderungen betroffen ist. Ist dies nicht der Fall, kann er beispielsweise folgende Erklärung auf seiner Konformitätser klärung aufführen: «Der Vergleich zwischen den Normenausgaben EN :2007 und der EN :2014 hat ergeben, dass sich für das vorliegende explo - sionsgeschützte Gerät keine zutreffenden Änderungen ergeben haben. Dadurch ist sichergestellt, dass das Gerät dem heutigen technischen Erkenntnisstand gemäss der Richtlinie 2014/34/EU entspricht.» Les normes harmonisées et leur présomption de conformité Conformément à la directive 2014/34/UE annexe X, le fabricant doit fournir une déclaration de conformité pour chaque dispositif antidéflagrant en plus de la notice d utilisation. La déclaration de conformité doit notamment indiquer les normes harmonisées ou les autres spécifications techniques pertinentes. Les normes harmonisées doivent être conformes à la liste publiée dans le Journal officiel (JO) de l Union européenne. Seules les normes harmonisées qui sont en vigueur au moment de la mise sur le marché peuvent être utilisées pour la présomption de conformité. Dans le cas de nouvelles éditions des normes, le fabricant est responsable de l examen des différences entre les versions afin d évaluer les modifications qui s appliquent au dispositif et, par conséquent, de la mise à jour de la déclaration de conformité. Lorsqu une nouvelle norme CEI est publiée, l ancienne norme EN correspondante peut normalement encore être utilisée pendant 3 ans. Cette période transitoire est également indiquée dans le JO. Depuis quelques années, il est exigé que chaque norme contienne une liste des modifications rédactionnelles mineures, des compléments ainsi que des modifications techniques importantes. Cette liste peut être utilisée pour l analyse des écarts. Par exemple, il peut arriver qu un dispositif antidéflagrant ne soit pas affecté par la nouvelle édition d une norme. Dans ce cas, le fabricant peut utiliser la nouvelle norme pour la présomption de conformité, bien que l attestation d examen CE ou UE de type soit basée sur la norme précédente. A cet effet, le fabricant effectue obligatoirement une analyse et une évaluation des deux éditions de la norme et vérifie si son appareil est concerné par les modifications. Si ce n est pas le cas, il peut par exemple ajouter la mention suivante sur sa déclaration de conformité: «La comparaison entre les versions EN :2007 et EN :2014 a montré qu il n y a pas eu de changements concernant cet appareil antidéflagrant. De ce fait, il est certain que l appareil correspond à l état actuel des connaissances techniques selon la directive 2014/34/UE.» Harmonised standards and their presumption of conformity 2 3 In addition to the instructions manual, the manufacturer shall also supply a declaration of conformity in accordance with Annex X of Directive 2014/34/EU with every item of explosionproof equipment. For some years now each standard has been required to include a list stating details of minor editorial amendments, enhancements or significant technical changes. This list can be used for the comparative analysis. It might, for example, be possible that an item of explosionproof equipment is not affected by the new version of the standard. In this case the manufacturer can apply the new standard for the presumption of conformity although the EC or EU type examination certificate states the preceding standard. Here the manufacturer is obliged to carry out an analysis and evaluation of the two versions of the standard and to check whether his equipment is affected by the changes. If this is not the case, he can, for example, include the following declaration in his declaration of conformity: «The comparison of the versions of the standards EN :2007 and EN :2014 has shown that there are no relevant changes with regard to the explosionproof equipment under consideration. Thus it is ensured that the equipment complies with the current state of technical knowledge in accordance with Directive 2014/34/EU. Die Liste enthält die harmonisierten Normen und gibt Auskunft, ab welchem Datum die Vorgängernorm nicht mehr für die Vermutungswirkung herangezogen werden kann. Im untenstehenden Beispiel für die EN ist ersichtlich, dass die Ausgabe 2007 ihre Vermutungswirkung am 1. August 2017 verloren hat und nur noch die Ausgabe 2014 herangezogen werden kann.
