2 1. VERANSTALTER Die BW Brandmann & Weppler Veranstaltungs-und Beratungs-GmbH, im folgenden BW GmbH genannt, ist Veranstalter von Fachmessen. Diese Allgemeinen Teilnahmebedingungen gelten für alle Veranstaltungen der BW GmbH. 2. DEFINITIONEN Aussteller im Sinne dieser Teilnahmebedingungen ist diejenige juristische Person oder Firma, auf deren Namen die verbindliche Anmeldung lautet und die von BW GmbH als Aussteller zugelassen wird. 3. ANMELDUNG/VERTRAGSABSCHLUSS 3.1 Anmeldung (1) Die Anmeldung muss auf dem für die Ausstellung besonderen Anmeldevordruck erfolgen, der ausgefüllt und rechtsverbindlich unterschrieben an die BW GmbH bis zum angegebenen Anmeldetermin (siehe Anmeldevordruck und Besondere Teilnahmebedingungen) einzusenden ist. Der Anmeldung ist ein Handelsregisterauszug beizufügen. (2) Der Anmelder ist an seine Anmeldung bis 8 Tage nach dem in der öffentlichen Bekanntmachung durch die BW GmbH im Internet bekannt gegebenen Anmeldeschluss, längstens bis 6 Wochen vor Eröffnung der Messe/Ausstellung gebunden, sofern inzwischen nicht die Zulassung erfolgt ist. An Anmeldungen, die später oder nach Anmeldeschluss eingehen, bleibt der Anmelder 14 Tage gebunden. (3) Die Zusendung des Anmeldevordrucks begründet keinen Anspruch auf Zulassung. Die Rücksendung der ausgefüllten und unterschriebenen Anmeldung an die BW GmbH ist ein Vertragsangebot des Ausstellers, an das er 4 Wochen nach Zugang bei der BW GmbH gebunden ist und das der Annahme durch die BW GmbH bedarf. (4) Mit der Anmeldung erkennt der Aussteller die Allgemeinen und Besonderen Teilnahmebedingungen, die gültigen Preise sowie die Technischen Richtlinien der BW GmbH, oder entsprechend die Technischen Richtlinien des jeweiligen Messegeländes an. Die gesetzlichen, arbeits- und gewerberechtlichen Vorschriften, besonders für Umweltschutz, Feuerschutz, Unfallverhütung, Firmenbezeichnung und Preisauszeichnung sind einzuhalten. Einseitige Vorbehalte oder Bedingungen in Zusammenhang mit der Anmeldung werden nicht berücksichtigt. (5) Der Aussteller bzw. der Antragende haftet für die Folgen, die durch das ungenaue, unvollständige oder irrtümliche Ausfüllen des Anmeldeformulars entstehen. (6) Der Aussteller hat dafür einzustehen, dass auch die von ihm auf der Ausstellung beschäftigten Personen und seine Erfüllungsgehilfen/Unteraussteller die Bedingungen und Richtlinien der BW GmbH einhalten. (7) Zum Zweck der Anmeldungsverarbeitung werden die Angaben gespeichert, ausgewertet und ggf. zwecks Vertragsvollziehung an Dritte weitergegeben. Der Aussteller erteilt hierzu seine Einwilligung. 3.2 Vertragsabschluss / Zulassung (1) Mit Eingang der Bestätigung für die Zulassung oder der Rechnung beim Aussteller ist der Vertragsabschluss zwischen Veranstalter und Aussteller vollzogen. Der Aussteller verzichtet auf den Zugang der Annahmeerklärung. (2) Über die Zulassung der Aussteller und der einzelnen Ausstellungsgegenstände entscheidet die BW GmbH. Die BW GmbH ist berechtigt, aus konzeptionellen Gründen eine Beschränkung der angemeldeten Ausstellungsgegenstände sowie eine Veränderung der angemeldeten Fläche vorzunehmen. (3) Die BW GmbH kann aus sachlich gerechtfertigten Gründen, insbesondere wenn der zur Verfügung stehende Platz nicht ausreicht, einzelne Aussteller und Anbieter von der Teilnahme ausschließen. Er kann, wenn es für die Erreichung des Veranstaltungszweckes erforderlich ist, die Veranstaltung auf 1. ORGANISER BW Brandmann & Weppler Veranstaltungs-und Beratungs-GmbH (referred to as BW GmbH hereafter) is an organiser of trade fairs. These General Conditions of Participation apply to all events of BW GmbH. 2. DEFINITIONS For the purpose of these Conditions of Participation, an exhibitor is the legal person or fi rm in whose name the binding registration is made and who is accepted as an exhibitor by BW GmbH. 3. REGISTRATION/SIGNING A CONTRACT 3.1 Registration (1) The registration must be submitted on the special registration form provided for the exhibition, which is to be completed and sent to BW GmbH with a legally binding signature by the registration date provided (see Registration Form and Special Conditions of Participation). A commercial register extract must accompany the registration. (2) The registration by the applicant shall remain binding until 8 days after the registration date publically announced by BW GmbH in the Internet, at the latest until 6 weeks before the trade fair/exhibition opens, provided no acceptance has been received in the mean time. Registrations received later or after registration date shall remain binding for the applicant for 14 days. (3) Sending in the registration form does not establish a right to acceptance. By returning the completed and signed registration form to BW GmbH, the exhibitor makes an offer of contract which shall remain binding for 4 weeks after receipt by BW GmbH and which requires acceptance by BW GmbH. (4) With his registration, the exhibitor recognises the General and Special Conditions of Participation, the valid prices and the technical guidelines of BW GmbH, or the corresponding technical guidelines of the respective fairgrounds. The statutory, labour and industrial regulations, in particular for environmental protection, fire protection, accident prevention, company name and labelling are to be observed. Unilateral reservations or conditions in the context of the reservation shall not be taken into account. (5) The exhibitor or the applicant shall be liable for the consequences resulting from imprecise, incomplete or erroneous completion of the registration form. (6) The exhibitor shall ensure that people employed by him at the exhibition and their assistants/sub-exhibitors observe the conditions and guidelines of BW GmbH. (7) For registration processing purposes data shall be saved, evaluated and if appropriate passed on to third parties for execution of contract. The exhibitor explicitly consents to this. 3.2 Signing a contract / acceptance (1) The contract between the organiser and exhibitor is considered signed when the exhibitor receives the acceptance confirmation or the invoice. The exhibitor foregoes the receipt of a declaration of acceptance. (2) BW GmbH shall decide about the acceptance of the exhibitor and the individual exhibits. For conceptual reasons BW GmbH is entitled to limit the exhibits registered or to alter the area registered for. (3) BW GmbH can exclude individual exhibitors and providers from participation for objectively justifiable reasons, in particular if there is insufficient space available. BW GmbH shall be entitled to limit the event to particular groups of exhibitors, providers and visitors if this is necessary to achieve the purpose of the event. The exclusion of competitors can be neither demanded nor agreed. 2

3 bestimmte Aussteller-, Anbieter- und Besuchergruppen beschränken. Konkurrenzausschluss kann weder verlangt noch zugesagt werden. (4) Die erteilte Zulassung kann widerrufen werden, wenn die Voraussetzung für die Erteilung nicht oder nicht mehr gegeben sind. Die BW GmbH ist berechtigt, eine sofortige Kündigung aus dem Vertrag auszusprechen, wenn trotz zweimaliger Mahnung ein Zahlungsverzug besteht. In diesem Falle ist die Gebühr in Höhe von 25% der Standmiete, mindestens aber 400,00 Euro, zur Deckung der bereits entstandenen Kosten zu entrichten. (5) Ergeben sich berechtigte Reklamationen oder Beanstandungen in Bezug auf angebotene Waren oder Arbeitsweise einer beteiligten Firma, ist die BW GmbH im allgemeinen Interesse berechtigt und befugt, sofort angemessene Maßnahmen zur Behebung zu treffen. In einem solchen Falle kann die BW GmbH bestehende Verträge für nachfolgende Messen/Ausstellungen stornieren, weil wesentliche Voraussetzungen, die diesen Verträgen zugrunde liegen, nicht mehr gegeben sind Mieten und Kosten (1) Die Standmieten und die Zuschläge für Eck-, Kopf- und Blockstände sind aus den Bekanntmachungen der BW GmbH und dem Anmeldeformular zu ersehen. (2) Die Kosten für die auf Antrag des Ausstellers hergestellten Versorgungsanlage sowie andere Nebenleistungen, wie Lieferung von Gas, Wasser, Strom usw., sind von dem Aussteller mit dem Messedienstleister zu klären. (3) Für den AUMA-Ausstellungs- und Messe-Ausschuss der Deutschen Wirtschaft e.v. wird ein Beitrag je Quadratmeter erhoben. Die Höhe richtet sich nach der Veranstaltungsart und ist dem Anmeldeformular zu entnehmen. 3.4 Zahlungsbedingungen (1) Die in der Anmeldung und Rechnung genannten Zahlungstermine sind einzuhalten. Rechnungen, die später als 6 Wochen vor Eröffnung ausgestellt werden, sind sofort in voller Höhe zahlbar. Die vorherige und volle Bezahlung der Rechnungsbeträge ist Voraussetzung für den Bezug der Ausstellungsfl äche und für die Aushändigung der Ausstellerausweise. In einer eventuellen Abweichung von dieser Regelung ist keine Stundung zu sehen. (2) Sollte der Anmelder/Aussteller seine Verpflichtungen nicht fristgemäß erfüllen, behält sich die BW GmbH das Recht vor, nach Setzen einer unter Berücksichtigung der Umstände und der verbleibenden Zeit bis zum Ausstellungsbeginn angemessenen Nachfrist, den Vertrag zu kündigen. (3) Bei Zahlungen wird um Angabe der Rechnungs-, Kunden- und Standnummer gebeten. (4) Bei verspäteter Bezahlung der Rechnung werden Verzugszinsen in Höhe von 8% über dem Basiszinssatz berechnet. Die BW GmbH kann nach vergeblicher Mahnung und bei entsprechender Ankündigung über nicht voll bezahlte Stände anderweitig verfügen. Sie kann in diesem Falle die Überlassung des Standes und die Ausgabe der Ausstellerausweise verweigern bzw, diese zurückfordern. (5) Bankgebühren hinsichtlich Auslandsüberweisungen oder Scheckrückgabe gehen zu Lasten des Ausstellers. (6) Bei Anmeldungen und Bestellungen, die später als sechs Wochen vor Veranstaltungsbeginn bei der BW GmbH eingehen, wird vorbehalten, Vorauszahlung zu verlangen. (7) Rechnungsstellung über sämtliche Nebenkosten erfolgt unverzüglich nach Schluss der Veranstaltung. Die Rechnungen sind sofort fällig. (8) Die Abtretung von Forderungen gegen die BW GmbH ist ausgeschlossen. Die Aufrechnung von Forderungen ist nur mit unstreitigen oder rechtskräftig festgestellten Gegenforderungen zulässig. (9) Beanstandungen der Rechnung können nur berücksichtigt werden, wenn sie innerhalb von 14 Tagen nach Rechnungserteilung schriftlich gegenüber der BW GmbH erfolgen. (4) Acceptance given can be revoked if the requirement for acceptance is not given or is no longer given. (5) If justifi ed complaints or objections are received in respect of the goods offered or the methods of a fi rm involved, BW GmbH is authorised and entitled to take immediate steps to remedy this in the general interest. In such cases BW GmbH can cancel existing contracts for future fairs/exhibitions as the basic conditions, on which these contracts were based, no longer apply Rental and costs (1) The stand rental and the surcharges for corner, head and block stands are shown in the notices of BW GmbH and the registration form. (2) The exhibitor must clarify costs for supply systems applied for by them and other extra charges like supply of gas, water and electricity with the trade fair service provider. (3) A contribution to AUMA-Ausstellungs- und Messe-Ausschuss of the Deutsche Wirtschaft e.v. shall be charged per square metre. This amount depends on the type of event and is shown in the registration form. 3.4 Conditions of payment (1) The payment dates named in the registration and invoice are to be observed. Invoices issued later than 6 weeks before the opening are due in full immediately. Prior and full payment of invoiced amounts is a requirement for occupying the exhibition area and for issuing exhibitor passes. Any possible divergence from this rule does not constitute a deferment. (2) Should the applicant/exhibitor not meet his obligations before the deadline BW GmbH reserves the right to cancel the contract after setting a suitable extension taking the circumstances into account and the time remaining before the start of the exhibition. (3) Please provide invoice, customer and stand number in all payments. (4) Default interest of 8% over the basic interest rate shall be charged for late payment of invoice. BW GmbH can dispose otherwise of stands that have not been fully paid after failure to respond to a reminder and due prior notification. In such cases BW GmbH can refuse to hand over the stand and issue exhibitor passes or demand that these are returned. (5) Bank fees for foreign bank transfers or returned checks shall be at the exhibitor s expense. (6) BW GmbH reserves the right to demand advance payment for all registrations and orders received later than six weeks before the start of the event. (7) All extra charges shall be invoiced for immediately after the event closes and are due at once. (8) The assignment of claims against BW GmbH is not permissible. The offsetting of claims shall only be admissible against counterclaims which have been judicially decided and are fi nal and legally binding. (9) Objections to the invoice can only be taken into account if these are made in writing and received by BW GmbH within 14 days of invoicing. (10) For any and all unfulfilled obligations and the resulting costs BW GmbH reserves the right to enforce the lessor s lien, as permitted by law, in order to secure claims arising from the rental and the resulting costs. If an exhibitor does not meet his financial obligations, BW GmbH can detain the exhibits and stand fittings and, at the exhibitor s expense, sell them at public auction or after written notification on the open market. BW GmbH does not accept liability for damage beyond their control to pledged property. It is as- 3

4 (10) Für alle nicht erfüllten Verpflichtungen und die daraus entstehenden Kosten steht der BW GmbH zur Sicherung ihrer Forderungen das Vermieterpfandrecht zu. Die BW GmbH ist berechtigt, die Ausstellungsgegenstände und/oder die Standeinrichtung zurückzubehalten und sie auf Kosten des Ausstellers öffentlich versteigern zu lassen oder nach schriftlicher Ankündigung freihändig zu verkaufen. Die BW GmbH haftet nicht für unverschuldete Beschädigungen und Verluste der Pfandgegenstände. Es wird dabei vorausgesetzt, dass alle vom Aussteller eingebrachten Gegenstände unbeschränktes Eigentum des Ausstellers sind. Die gesetzlichen Vorschriften über die Pfandverwertung sind soweit gesetzlich zulässig abgedungen. Eine Haftung für Schäden am Pfandgut wird nur im Rahmen der Ziffer 6 übernommen. (11) Wenn der Aussteller abweichend von der Anmeldung Änderungen wünscht, die eine Modifizierung in der Rechnungsstellung zur Folge haben, ist die BW GmbH berechtigt, eine Gebühr von 15, Euro zzgl. der gesetzlichen Mehrwertsteuer zu erheben. 3.5 Mitaussteller / Zusätzlich vertretene Firmen / Verkauf für Dritte (1) Der Aussteller ist ohne Genehmigung der BW GmbH nicht berechtigt, den ihm zugewiesenen Stand an Dritte ganz oder teilweise unterzuvermieten, ihn zu tauschen oder sonst zu überlassen bzw. für nicht bekannt gegebene Unternehmen zu werben oder Aufträge anzunehmen. (2) Die Nutzung der Standfläche durch weitere Unternehmen, sei es, dass diese Unternehmen mit eigenem Personal (Mitaussteller) oder nur mit eigenen Produkten bzw. Informationsmaterialien (zusätzlich vertretene Unternehmen) in Erscheinung treten, bedarf der Genehmigung durch die BW GmbH. Der Aussteller hat die Anmeldung der Unternehmen auf dem entsprechenden Anmeldeformular vorzunehmen. Diese gelten auch dann als Mitaussteller, wenn sie zum Hauptaussteller enge wirtschaftliche oder organisatorische Bindungen unterhalten. Die Zulassung gilt als erteilt, wenn keine ausdrückliche Ablehnung erfolgt. Die von der BW GmbH genehmigte Aufnahme eines Mitausstellers ist gebührenpflichtig. (3) Im Fall eines Verstoßes hiergegen kann die BW GmbH vom Mieter des Standes Unterlassung oder Räumung der Standfläche verlangen oder 50% der Standmiete zusätzlich beanspruchen. (4) Für die Entgegennahme von Aufträgen müssen die Auftragsbücher, sofern nicht eigene verwandt werden, neben der Anschrift der Lieferfirmen auch die genaue Anschrift des Standinhabers aufweisen. Aus dem Auftragsschein muss ersichtlich sein, bei welchem Aussteller und für welche Firma der Kaufvertrag abgeschlossen wurde. 3.6 Exponate (1) Die Ausstellung nicht gemeldeter, nicht zugelassener oder gebrauchter Ware ist unzulässig. (2) Der Aussteller ist verpflichtet, die BW GmbH im Rahmen des Antrages auf Standbaugenehmigung über die technischen Daten der einzelnen Exponate sowie Maße und Gewichte zu informieren. Evtl. notwendige Dienstleistungen zum Transport von Exponaten auf dem Messegelände müssen von dem Aussteller bei dem Messedienstleister im eigenen Namen beauftragt werden und gehen zu Lasten des Ausstellers. (3) Die BW GmbH kann verlangen, dass Ausstellungsgüter entfernt werden, die in der Standanmeldung nicht enthalten waren oder sich als belästigend oder gefährdend erweisen oder auch mit dem Veranstaltungsziel nicht vereinbar sind. Wird dem Verlangen nicht entsprochen, so entfernt die BW GmbH die Veranstaltungsgüter im Namen und auf Kosten des Ausstellers. Hierfür erteilt der Aussteller der BW GmbH bereits jetzt eine entsprechende Vollmacht. (4) Sofern der Direktverkauf von Exponaten im Einzelfall von der BW GmbH zugelassen ist (vgl. Punkt 4.2) und die erforderlichen, behördlichen Genehmigungen und Bescheinigung vorliegen (vgl. Punkt 4.6), sind die Ausstellungsgüter mit deutlich lesbaren Preisschildern zu versehen. sumed that all objects used by the exhibitor are the absolute property of the exhibitor. (11) If the exhibitor requests changes in the registration which necessitate a modifi cation in the invoice, BW GmbH is entitled to charge a fee of EUR 15 plus statutory value-added tax. 3.5 Co-exhibitors / Additionally represented companies / Sales for third parties (1) Without BW GmbH s authorisation, the exhibitor is not entitled to sublet the stand in part or in whole to third parties, to exchange or share his stand, nor surrender it, nor to advertise or accept orders for companies that have not been made known. (2) Use of the stand area by other companies with their own personnel (coexhibitors) or only with their own products or information material (additionally represented companies) must be approved by BW GmbH. The exhibitor must register these companies on the respective registration form. These are also considered co-exhibitors if they have close commercial or organisational ties with the main exhibitor. The co-exhibitors are deemed to be accepted if they are not expressly rejected. BW GmbH shall charge a fee for the acceptance of a co-exhibitor. (3) In the event of a violation of this rule BW GmbH can demand that the exhibitor clear or evacuate the stand or demand an additional 50 % stand rental. 4) Any orders received must include the address of supplier fi rms and the exact address of the exhibitor if own order books are not used. On the order form it must be clearly visible with which exhibitor and for which fi rm the sales contract was signed. 3.6 Exhibits (1) The exhibition of goods which are not registered, not approved or used is prohibited. (2) Within the scope of application for stand construction approval, the exhibitor is obliged to inform BW GmbH of the technical data, measurements and weights of the individual exhibits. The exhibitor must arrange any transport of exhibits required on the fairgrounds with the fair service provider in his own name and at the exhibitor s expense. 3) BW GmbH can demand that the exhibitor remove exhibits that were not included in the stand registration or which prove to be inconvenient or endangering or are incompatible with the aim of the event. If the exhibitor does not comply, BW GmbH can remove the exhibits in the name of the exhibitor and at his expense. The exhibitor hereby gives BW GmbH the corresponding authorisation. 4) Provided the direct sale of exhibits is approved by BW GmbH in a given case (see point 4.2) and the required, regulatory approval and certification has been obtained (see point 4.6), the prices of the exhibits are to be clearly labelled. (5) The exhibitor must have copyright and other industrial property rights to the exhibited articles. (6) The exhibitor shall observe the currently valid version of all applicable legal regulations when running a stand (e.g. German Act on Restaurants, German Industrial Code, Hygiene Regulations, Foodstuffs and Consumer Goods Act, Regulations for Beverage Dispensers). Should the exhibitor fail to carry out his cleaning and waste disposal obligations with regard to the provision of food and drink at his stand even after warning, then BW GmbH is entitled to close down the stand or the sales unit. 4

5 (5) Urheberrechtliche und sonstige gewerbliche Schutzrechte an den Ausstellungsgütern hat der Aussteller sicherzustellen. (6) Bei der Betreibung seines Standes hat der Aussteller die einschlägigen Rechtsvorschriften in ihrer jeweils gültigen Fassung (z.b. Gaststättengesetz, Gewerbeordnung, Hygienevorschriften, Lebensmittel- und Bedarfsgegenstandsgesetz, Verordnung über Getränkeschankanlagen) einzuhalten. Sollte der Aussteller seiner Reinigungs- und Entsorgungspflicht bzgl. des Verkaufs oder der Abgabe von Speisen und Getränken an seinem Stand auch nach Abmahnung nicht nachkommen, so ist die BW GmbH berechtigt, den Stand bzw. die Verkaufseinrichtung schließen zu lassen. (7) Gemäß 3 des Gesetzes über die technischen Arbeitsmittel (Gerätesicherheitsgesetz in ihrer jeweils gültigen Fassung) sind Hersteller, Einführer oder Aussteller von technischen Arbeitsmitteln im Sinne dieser Gesetze verpflichtet, nur Geräte auszustellen, die allgemein anerkannte Regeln der Technik sowie die Arbeitsschutz- und Unfallverhütungsvorschriften vollständig einhalten und somit die Voraussetzungen für die CE-Kennzeichnung erfüllen. Als Nachweis sind vom Aussteller folgende Unterlagen am Stand bereitzuhalten: a) EG-Konformitätserklärung bzw. Herstellererklärung nach Anhang II der Maschinenrichtlinie. b) Betriebsanleitung nach Anhang I Nr der Maschinenrichtlinie. Geräte, die für Lieferungen außerhalb der EU bestimmt sind und den Anforderungen des Gesetzes nicht genügen, müssen einen entsprechenden Hinweis nach 3a des Gerätesicherungsgesetzes tragen. Bei Vorführungen sind die erforderlichen Vorkehrungen zum Schutz von Personen durch das Standpersonal zu treffen. Das Standpersonal ist auch für die Gewährleistung des Ausschlusses von unbefugten Schaltvorgängen verantwortlich. 3.7 Standzuteilung (1) Die Standzuteilung erfolgt durch die BW GmbH auf der Grundlage des mit dem Messedienstleister geschlossenen Vertrages, wobei das Eingangsdatum der Anmeldung nicht maßgebend ist. Die Entscheidung richtet sich u. a. nach organisatorischen und veranstaltungsbezogenen Gesichtspunkten. Besondere Wünsche des Ausstellers werden nach Möglichkeit berücksichtigt. Ein Tausch der zugeteilten Standfläche mit einem anderen Aussteller sowie eine teilweise oder vollständige Überlassung des Standes an Dritte ist ohne schriftliche Genehmigung durch die BW GmbH nicht erlaubt. (2) Die Standzuteilung wird schriftlich durch die BW GmbH, im Regelfall gleichzeitig mit der Zulassung und der Bekanntgabe der Hallen- und Standnummer mitgeteilt. Beanstandungen müssen innerhalb von 8 Tagen nach Erhalt der Standzuteilung schriftlich erfolgen. (3) Der Aussteller ist damit einverstanden, dass sich bei Beginn der Veranstaltung die Lage der einzelnen Stände gegenüber der ursprünglichen Planung verändert haben kann. Ersatzansprüche sind ausgeschlossen. (4) Der Aussteller muss damit rechnen, dass aus technischen Gründen eine geringfügige Beschränkung des zugeteilten Standes erforderlich ist. Diese darf in der Breite und Tiefe höchstens 10 cm betragen und berechtigt nicht zur Minderung der Standmiete. (5) Bei Vorliegen eines sachlichen, zwingenden Grundes ist die BW GmbH befugt, nach erfolgter Standzuteilung ohne Zustimmung des Ausstellers eine Verlegung des Standes vorzunehmen. Die BW GmbH hat dem betroffenen Aussteller eine/n möglichst gleichwertige/n Stand/Fläche zu geben. Ausgenommen hiervon ist die Verschiebung eines Standes um einige Meter in derselben Halle. (6) Die BW GmbH behält sich vor, die Ein- und Ausgänge, die Notausgänge sowie die Durchgänge aus zwingenden Gründen zu verlegen. Dadurch werden weder Ersatzansprüche des Ausstellers noch ein Recht zum Rücktritt begründet. (7) Die BW GmbH teilt dem Aussteller umgehend Änderungen der Lage, der Art oder der Maße des Standes schriftlich mit. (7) In compliance with Section 3 of the Law on Technical Equipment (the currently valid version of the Equipment Safety Act) manufacturers, importers or exhibitors of technical equipment are only permitted to exhibit equipment which is fully in compliance with the generally recognised rules of technology and the safety and accident prevention regulations and thus satisfies the requirements for CE certification. The exhibitor shall have the following documents at the stand as proof: a) EG Declaration of Conformity or manufacturer s declaration according to Appendix II of the Machinery Directive. b) Operating Instructions according to Appendix I No of the Machinery Directive. Equipment which is destined for delivery outside of the EU and which does not comply with this Act must be appropriately marked according to Section 3a of the Equipment Safety Act. The stand personnel are to take the necessary precautions for personal safety in any demonstrations of the equipment. The stand personnel are also responsible for guaranteeing the exclusion of unauthorised use or operation of equipment. 3.7 Stand assignment (1) The stands shall be assigned by BW GmbH on the basis of the contract signed with the trade fair service provider, whereby the date of receipt of the registration is not decisive. The decision shall be made according to organisational and event-related factors. Special wishes of the exhibitor shall be taken into account if possible. The exhibitor may not exchange the stand area assigned with another exhibitor, nor surrender it either in part or in whole to third parties, without BW GmbH s written consent. (2) BW GmbH shall notify the exhibitor of the stand assignment in writing, generally together with the acceptance and the notification of the hall and stand number. Complaints must be made in writing within 8 days of receipt of stand assignment. (3) The exhibitor agrees that at the start of the event the position of the individual stands may have changed from the original plan. Compensation claims are excluded. (4) The exhibitor must take into account that for technical reasons a slight limitation of the stand area assigned might be necessary. This may be at most 10 cm in width and depth and does not entitle the exhibitor to a reduction in stand rental. (5) In case of a compelling practical reason, BW GmbH is entitled to change the location of the stand after stands have been assigned without the approval of the exhibitor. BW GmbH shall give the exhibitor concerned a stand/ area which is as far as possible equivalent. The shifting of a stand by several metres in the same hall is excluded from this rule. (6) BW GmbH reserves the right to relocate entrances and exits, emergency exits and passageways for compelling reasons. This does not entitle an exhibitor to claim compensation or to withdraw. (7) BW GmbH shall inform the exhibitor without delay in writing of changes in location, type or dimensions of the stand. 3.8 Exhibitor passes (1) Each exhibitor shall receive a number of exhibitor passes corresponding to the size of the stand. The number is specified in the Special Conditions of Participation for the respective event. (2) Exhibitor passes are only valid during the event and during construction and dismantling periods. The right to issue work passes for construction and dismantling periods is reserved. (3) If demand is proven up to half as many additional passes can be issued. A fee shall be charged. 5

6 3.8 Ausstellerausweise (1) Jeder Aussteller erhält entsprechend der Größe seines Standes Ausstellerausweise. Die Anzahl ist in den Besonderen Teilnahmebedingungen der jeweiligen Veranstaltung geregelt. (2) Ausstellerausweise sind nur während der Veranstaltung und während der Auf- und Abbauzeiten gültig. Für die Zeiten des Auf- und Abbaus bleibt die Ausgabe von Arbeitsausweisen vorbehalten. (3) Bei nachgewiesenem Bedarf können zusätzliche Ausweise bis zur Hälfte der kostenlos zu beanspruchenden Ausweise kostenpflichtig ausgegeben werden. (4) Bei Missbrauch wird der Ausweis entschädigungslos entzogen. 3.9 Vertragsänderungen Änderungen des Vertrages bedürfen der Schriftform. Wenn die Veranstaltung aus wichtigem Grund zeitlich oder räumlich verlegt werden muss, gilt die Anmeldung des Ausstellers auch für den neuen Termin und zu den neuen Bedingungen, falls der entsprechenden Mitteilung der BW GmbH nicht binnen zwei Wochen nach Zugang schriftlich widersprochen wird Rücktritt/Kündigung (1) Nach Vertragsabschluss (Punkt 3.2) besteht kein Rücktritts- und/oder Kündigungsrecht des Ausstellers nach dem 15. Mai (2) Der Aussteller hat den vollen Beteiligungspreis auch dann zu zahlen, wenn er nur Teile der Mietfläche nutzt oder an der Veranstaltung nicht teilnimmt. (3) Bei Nichtteilnahme oder nur teilweiser Nutzung der Fläche durch den Aussteller oder im Falle des Punktes 3.4 (2) bleibt der Aussteller zur Zahlung des gesamten Beteiligungspreises und der bestellten zusätzlichen Leistungen (100 %) verpflichtet. (4) Eine Reduzierung der Zahlungsverpflichtung des Ausstellers kann nur erfolgen, wenn es der BW GmbH gelingt, die gesamte Fläche anderweitig zu dem mit dem Aussteller vereinbarten Preis einschließlich sonstiger bestellter Leistungen zu vermieten und wenn auf der Ausstellung keine unvermietete Fläche vorhanden ist (Belegung durch Tausch ist ausgeschlossen). In diesem Fall vermindert sich der Beteiligungspreis (Standmiete und Vergütung für zusätzlich bestellte Leistungen) um 75%; mindestens sind jedoch 400, Euro als Schadensersatz zu bezahlen. Im Zweifel ist von Ausstellerseite nachzuweisen, dass die BW GmbH eine mögliche Vermietung unterlassen hat. Dem Aussteller bleibt vorbehalten, einen geringeren Schaden nachzuweisen. (5) Die BW GmbH ist zur Kündigung berechtigt, wenn: a) der Aussteller seine ihm aufgrund dieses Vertrages obliegenden Verpflichtungen nicht erfüllt oder gröblich verletzt. In diesem Fall kann BW GmbH den Standbau untersagen bzw. Räumung/Schließung des Standes verfügen, b) der Aussteller seine Zahlungsverpflichtungen nicht fristgemäß erfüllt (siehe Punkt 3.4), c) über das Vermögen des Ausstellers das Insolvenzverfahren beantragt oder gegen ihn fruchtlos vollstreckt worden ist, d) der Stand nicht rechtzeitig, d. h., bis spätestens 24 Stunden vor Eröffnung der Veranstaltung erkennbar ist, e) der Aussteller sein Ausstellungsprogramm derart ändert, dass die Exponate nicht mehr der Branche zugerechnet werden können, für die er zugelassen ist oder f) die Standzuteilung aufgrund falscher Voraussetzungen oder Angaben erfolgte bzw. die Voraussetzungen zur Standzulassung nicht mehr bestehen. (6) Die Verpflichtung des Ausstellers zur Zahlung der Standmiete und der zusätzlich bestellten Leistungen entsprechend (Punkt 3.4) sowie zur Bezahlung aller durch seine Anmeldung veranlassten Leistungen und Kosten bleibt in diesen Fällen bestehen. (4) In the event of abuse the pass shall be withdrawn without compensation. 3.9 Changes in contract Changes in contract must be made in writing. If the event has to be postponedor relocated for good cause the registration is also valid for the new date and under the new conditions if the corresponding notification from BW GmbH is not objected to in writing within two weeks of receipt Withdrawal / Cancellation (1) After signing the contract (point 3.2) the exhibitor has no right to withdraw and/or cancel after 15th May (2) The exhibitor shall pay the full participation price even if he only uses part of the rental area or does not take part in the event. (3) In the event of non-participation or only partial use of the area by the exhibitor or in the event of point 3.4 (2), the exhibitor is obliged to pay the full price of participation and of additional services ordered (100%). (4) The exhibitor s payment obligation can only be reduced if BW GmbH manages to rent the entire area to a third party at the price agreed with the exhibitor including other services ordered and if there is no unrented area at the exhibition (an exchange of stands is excluded). In this case the participation price (stand rental and fee for additional services ordered) shall be reduced by 75%; however, at least EUR 400 in damages shall be due. In case of doubt, the exhibitor has to prove that BW GmbH neglected a possible rental opportunity. The exhibitor reserves the right to prove a lesser damage was incurred. 5) BW GmbH is entitled to cancel the contract if: a) the exhibitor does not satisfy or grossly infringes his obligations under this contract. In this case, BW GmbH can prohibit stand construction or insist on clearance/closure of the stand, b) the exhibitor does not fulfil his payment obligations on time (see point 3.4), c) bankruptcy proceedings have been instituted or fruitlessly enforced against the assets of the exhibitor, d) the stand is not recognisable in time, i.e. at the latest 24 hours before the opening of the event, e) the exhibitor changes his exhibition program to such an extent that the exhibits can no longer be considered suitable for the sector for which he has been accepted or f) the stand was assigned on the basis of false assumptions or data, or the conditions for stand acceptance no longer apply. (6) In these cases, the exhibitor is nonetheless obliged to pay the stand rental and the additional services ordered in compliance with point 3.4 and to pay all services and costs incurred by his registration. (7) If after a binding registration or stand assignment BW GmbH exceptionally agrees to a withdrawal, 25% of the rental is due as compensation as well as the costs incurred for orders already issued at the initiative of the exhibitor Reduction of stand area (1) The provisions of point 3.11 of the shall apply as appropriate if the exhibitor informs BW GmbH in writing, after signing the contract that he wishes to reduce the area of his stand. The exhibitor shall pay the full stand rental plus statutory value-added tax, even if he does not use the entire stand. (2) The exhibitor s payment obligation shall only be reduced under the requirements of point 3.11 (4). 6

7 (7) Wird nach verbindlicher Anmeldung oder nach erfolgter Zulassung ausnahmsweise von der BW GmbH ein Rücktritt zugestanden, so sind 25% der Miete als Kostenentschädigung sowie die auf Veranlassung des Ausstellers bereits entstandenen Kosten aus bereits erteilten Aufträgen zu entrichten Reduktion der Standfläche (1) Die Bestimmungen des Punktes 3.11 der Allgemeinen Teilnahmebedingungen fi nden entsprechende Anwendung, wenn der Aussteller nach Vertragsschluss schriftlich gegenüber der BW GmbH erklärt, seine Standfläche reduzieren zu wollen. Der Aussteller hat die volle Standmiete zuzüglich gesetzlicher Mehrwertsteuer zu zahlen, auch wenn er nicht den gesamten Stand nutzt. (2) Eine Reduzierung der Zahlungsverpflichtungen des Ausstellers tritt nur unter den Voraussetzungen des Punktes 3.11 (4) ein Höhere Gewalt (1) Unvorhergesehene Ereignisse, die eine planmäßige Durchführung der Messe/Ausstellung unmöglich machen, und nicht von der BW GmbH zu vertreten sind, berechtigen diese: a) die Messe/Ausstellung vor Eröffnung abzusagen. Muss die Absage mehr als 6 Wochen, längstens jedoch 3 Monate vor dem festgesetzten Beginn erfolgen, werden 25% der Standmiete als Kostenbeitrag erhoben. Erfolgt die Absage in den letzten 6 Wochen vor Beginn, erhöht sich der Kostenbeitrag auf 50%. Außerdem sind die auf Veranlassung des Ausstellers bereits entstandenen Kosten zu entrichten. Muss die Messe/Ausstellung infolge höherer Gewalt oder auf behördlicher Anordnung geschlossen werden, sind die Standmiete und alle vom Aussteller zu tragenden Kosten in voller Höhe zu bezahlen. b) die Messe/Ausstellung zeitlich zu verlegen. Aussteller, die den Nachweis führen, dass sich dadurch eine Terminüberschneidung mit einer anderen, von ihnen bereits fest belegten Messe/Ausstellung ergibt, können Entlassung aus dem Vertrag beanspruchen. c) die Messe/Ausstellung zu verkürzen. Die Aussteller können eine Entlassung aus dem Vertrag nicht verlangen. Eine Ermäßigung der Standmiete tritt nicht ein. Der Aussteller hat keinen Anspruch auf Rückzahlung oder Erlass der Standmiete. Schadensersatzansprüche sind in jedem Fall für beide Teile ausgeschlossen. 4. TECHNISCHE / ORGANISATORISCHE MIETBEDINGUNGEN 4.1 Ordnungsbestimmungen (1) Der Aussteller unterliegt während der Veranstaltung auf dem gesamten Gelände der Hausordnung der Landesmesse Stuttgart GmbH. Den Anordnungen der Vertreter der Landesmesse Stuttgart und dem Personal der BW GmbH, die sich durch einen Dienstausweis legitimieren, sind Folge zu leisten. (2) Während der Veranstaltung dürfen nur Fahrzeuge das Messegelände und ggf. die Ladezonen befahren, die über eine Einfahrtsgenehmigung bzw. einen Parkschein verfügen. Für Wohnmobile werden keine Einfahrtsgenehmigungen erteilt. Das Entladen von Fahrzeugen während der Veranstaltung muss rechtzeitig vor Beginn der täglichen Öffnungszeit abgeschlossen werden. Die Fahrzeuge müssen das Gelände nach dem Entladen sofort wieder verlassen. Binnen einer Stunde nach Ablauf der täglichen Öffnungszeit für Besucher müssen Aussteller und Begleitpersonen die Hallen verlassen und das Gelände von Fahrzeugen geräumt haben. (3) Tiere dürfen auf das Messegelände nicht mitgebracht werden. (4) Das Auslegen, Plakatieren und Verteilen von politischem Informationsmaterial etc. ist untersagt. Ebenso muss bei der Standgestaltung und Dekoration auf jede politische Aussage verzichtet werden. (5) Der Aussteller ist verpflichtet, während der gesamten Veranstaltungsdauer seinen Stand zu belegen und mit Standpersonal zu besetzen Force majeure (1) Unforeseen circumstances which make the planned implementation of the trade fair/exhibition impossible and for which BW GmbH is not responsible, entitle BW GmbH a) to cancel the trade fair/exhibition before the opening. If the cancellation takes place more than 6 weeks but less than 3 months before the planned date 25% of the stand rental shall be charged. If the cancellation takes place in the last 6 weeks before the start, the fee to cover costs shall be 50%. In addition all cost incurred at the initiative of the exhibitor must also be paid. If the trade fair/exhibition must be cancelled as a result of force majeure or by offi cial order, stand rental and all costs to be borne by the exhibitor must be paid in full. b) to postpone the trade fair/exhibition. Exhibitors who can prove that this results in a conflict of dates with another trade fair/exhibition for which they have already committed themselves can demand to be released from the contract. c) to shorten the trade fair/exhibition. Exhibitors cannot demand to be released from the contract. Stand rental shall not be reduced. The exhibitor has no right to a refund or waiver of stand rental. Neither party has a right to claim for damages. 4. TECHNICAL / ORGANISATIONAL CONDITIONS OF RENTAL 4.1 Regulations (1) During the event the exhibitor is subject to the house rules of Landesmesse Stuttgart GmbH on the entire fairgrounds. The instructions of representatives of Landesmesse Stuttgart and BW GmbH personnel, who will identify themselves, are to be followed. (2) During the event only vehicles which have access authorisation or a parking permit shall be permitted onto the fairgrounds and if appropriate the loading areas. No access authorisation shall be issued for caravans. During the event vehicles must be unloaded in good time before the daily opening hours. The vehicles must leave the grounds immediately after unloading. Exhibitors and accompanying persons must leave the halls and the fairgrounds must be cleared of vehicles within an hour of the end of daily opening hours for visitors. (3) No animals are allowed on the fairgrounds. (4) The display and distribution of political information material or putting up of posters, etc. is prohibited. No political statement is to be made in the stand design and decoration. (5) The exhibitor is obliged to ensure that the stand is occupied and staffed throughout the duration of the event. (6) Dismantling of the stands may only commence after the end of the trade fair on the last day of the trade fair. BW GmbH is entitled to demand a penalty of EUR 3000 for each violation by the exhibitor. 4.2 Sales activity (1) Direct sales are not permitted at the event. This does not apply if direct sales were applied for separately naming the products and this was approved in writing by BW GmbH before the start of the event. The sale of articles which contravene the character of the trade fair is not permitted. (2) Catering stands are not permitted. In exceptional cases the sale of typical local specialities is possible with the written authorisation of the organiser. The organiser shall inform the exhibitor of the special conditions to be fulfilled in a statement of approval; approval shall be given on condition that the exhibitor satisfi es the limitations imposed. (3) The exhibitor shall be responsible for obtaining and complying with any trade licenses and health certifi cates required (see point 4.6). 7

8 (6) Mit dem Abbau der Stände darf erst am letzten Ausstellungstag nach Ausstellungsende begonnen werden. Die BW GmbH ist berechtigt, bei jedem Verstoß des Ausstellers eine Konventionalstrafe in Höhe von 3.000, Euro in Rechnung zu stellen. 4.2 Verkaufstätigkeit (1) Der Direktverkauf auf der Veranstaltung ist nicht erlaubt. Dies gilt nicht, wenn der Direktverkauf unter Angabe der Produkte getrennt beantragt worden ist und die BW GmbH einem solchen vor Veranstaltungsbeginn schriftlich zugestimmt hat. Der Verkauf von Produkten, die dem Charakter der Messe widersprechen, ist nicht erlaubt. (2) Bewirtungsstände sind grundsätzlich nicht zugelassen; in Ausnahmefällen ist der Verkauf landestypischer Spezialitäten nach schriftlicher Genehmigung durch den Veranstalter möglich. Die besonderen Konditionen, die der Aussteller zu erfüllen hat, werden dem Aussteller mit der Genehmigungserklärung durch den Veranstalter mitgeteilt; die Genehmigung wird unter der Bedingung erteilt, dass der Aussteller die erteilten Auflagen erfüllt. (3) Der Aussteller hat die gewerbe- und gesundheitspolizeilichen Genehmigungen zu beschaffen und einzuhalten (vgl. Punkt 4.6). 4.3 Werbung / Gewinnspiele (1) Der Aussteller ist zur Durchführung von Werbemaßnahmen, insbesondere der Verteilung von Prospektmaterial und der Ansprache von Besuchern, nur innerhalb seiner gemieteten Standfläche berechtigt. Das Bekleben der Wände und des Bodens außerhalb der gemieteten Standfläche ist untersagt. (2) Es darf lediglich Eigenwerbung betrieben werden; Werbung für Dritte ist ausgeschlossen. (3) Musik- und Lichtdarbietungen sowie AV-Medien jeder Art sowie der Betrieb von Lautsprecheranlagen auch zu Werbezwecken bedürfen der ausdrücklichen Genehmigung durch die BW GmbH und sind rechtzeitig vor Veranstaltungsbeginn anzumelden. Diese Genehmigung kann ebenso wie eine Genehmigung zur Vorführung von Maschinen, akustischen Geräten oder Lichtbildgeräten im Interesse der Aufrechterhaltung eines geordneten Veranstaltungsbetriebes eingeschränkt oder widerrufen werden. (4) Tombolas, Preisausschreiben, Quizveranstaltungen, Gewinnspiele u. ä. dürfen weder gegen Entgelt noch gegen Spenden durchgeführt werden. (5) Die BW GmbH ist berechtigt, über Messestände und Exponate der Aussteller in Wort und Bild zu berichten und die Aufnahmen für die Veranstaltungswerbung zu verwenden. (6) Das gewerbliche Fotografi eren, Filmen und Zeichnen innerhalb des Veranstaltungsgeländes bedarf der schriftlichen Genehmigung durch die BW GmbH. (7) Die Vorführungen von Maschinen, akustischen Geräten, von Lichtbildgeräten und Moden, auch zu Werbezwecken, kann im Interesse der Aufrechterhaltung eines geordneten Messe-/Ausstellungsbetriebes auch nach bereits erteilter Genehmigung eingeschränkt oder widerrufen werden. (8) Die BW GmbH behält sich Durchsagen via Lautsprecher vor. 4.4 Standbau, Gestaltung und Ausstattung der Stände (1) Auf den Ausstellungsflächen sind messeseitig keine Trennwände vorhanden. Diese müssen vom Aussteller selbst bzw. von einer geeigneten Standbaufirma im Auftrag des Ausstellers aufgebaut werden. (2) Das äußere Erscheinungsbild der Stände trägt maßgeblich zum Erfolg der Messe bei. Als Mindeststandgestaltung müssen alle Standgrenzen zu Nachbarständen und nicht vermieteten Leerflächen 2,50 m hohe undurchsichtige Standwände oder ähnliche die Durchsicht verhindernde Gestaltungselemente aufgestellt bzw. angebracht werden. Sind diese 18 Stunden vor Messebeginn nicht vorhanden, veranlasst die BW GmbH auf Rechnung des Ausstellers die Aufstellung geeigneter Trennwände. Der Aussteller erteilt insoweit der BW GmbH bereits jetzt eine entsprechende Vollmacht. 4.3 Advertising / Competitions (1) The exhibitor is authorised to implement advertising campaigns and in particular to distribute brochures and address visitors only within the stand area rented by him. Sticking posters on walls and fl oors outside of the rented stand area is prohibited. (2) Only personal publicity is permitted; advertising for third parties is prohibited. (3) For music and light performances and all kinds of AV media and the use of loudspeaker systems also for publicity purposes the express authorisation of BW GmbH is required. Authorisation must be applied for in good time before the start of the event. This authorisation and authorisation to demonstrate machines, acoustic equipment or light equipment can be restricted or revoked in the interests of maintaining order at the event. (4) No fee or donation may be demanded for raffles, contests, quizzes, competitions, etc. (5) BW GmbH is entitled to report about the exhibitor in images and text on fair stands and exhibits and to use these to advertise for the event. (6) The written authorisation of BW GmbH is required for photography, fi lming and drawing on the fairgrounds for commercial purposes. (7) In the interests of maintaining order at the trade fair/exhibition the demonstration of machines, acoustic equipment, cameras and fashion, also for publicity purposes can be restricted or revoked even after authorisation has been granted. (8) BW GmbH reserves the right to make announcements over the loudspeaker. 4.4 Stand construction, design and equipment of stands (1) No partitions are provided in the exhibition areas by the trade fair organisers. The exhibitor must install them himself or order them from a suitable stand construction firm. (2) The external appearance of the stands plays a decisive role in the success of the trade fair. The minimum requirement is that stand walls acing neighbouring stands and not rented empty areas must be at least 2.5 m high and opaque, or similar design elements which are not transparent must be provided. If 18 hours before the start of the fair these have not been installed, BW GmbH shall have suitable partitions installed at the exhibitor s expense. The exhibitor hereby gives BW GmbH a corresponding power of attorney. (3) The given limits of the stand may not be exceeded. The prescribed construction height of 2,500 mm and the exhibit height of 3,500 mm (measured from the floor to the upper limit) may only be exceeded with the express written authorisation of BW GmbH. (4) The exhibitor is responsible for equipping and designing the stand within the scope of the framework structure provided by BW GmbH if appropriate. The guidelines of BW GmbH are to be followed in the interests of a good overall impression. If the exhibitor organises his own stand construction he shall inform BW GmbH of the firms responsible for the construction. BW GmbH can demand that dimensionally correct drafts of the structure be provided for approval at least 7 weeks before the start of construction. The use of prefabricated or system stands is to be expressly noted in the registration (see also point 4.5). (5) Name and address of the stand holder must be clearly recognisable throughout the duration of the event; this must be clearly marked. (6) All materials used in the construction must be flame retardant. (7) BW GmbH is entitled to demand necessary changes and if appropriate, the clearance of the stand in the event of any violations of the design and equipment regulations. 8

9 (3) Die vorgegebenen Standgrenzen dürfen nicht überschritten werden. Eine Überschreitung der vorgeschriebenen Aufbauhöhe von mm und der Werbebauhöhe von mm (gemessen vom Fußboden bis zur oberen Begrenzung) ist nur mit ausdrücklicher schriftlicher Genehmigung der BW GmbH zulässig. (4) Die Ausstattung und Gestaltung der Stände im Rahmen des gegebenenfalls von der BW GmbH gestellten einheitlichen Aufbaus ist Sache des Ausstellers. Die Richtlinien der BW GmbH sind im Interesse eines guten Gesamtbildes zu befolgen. Bei eigenem Aufbau sind der BW GmbH die mit der Gestaltung bzw. dem Aufbau beauftragten Firmen bekannt zu geben. Bei eigenem Standbau kann verlangt werden, dass maßgerechte Entwürfe mindestens 7 Wochen vor Beginn des Aufbaus der BW GmbH zur Genehmigung vorgelegt werden. Der Einsatz von Fertig- oder Systemständen ist in der Anmeldung ausdrücklich zu vermerken (siehe auch Punkt 4.5). (5) Name und Anschrift des Standinhabers müssen für die gesamte Dauer der Veranstaltung für jedermann erkennbar sein; eine entsprechende Kennzeichnung ist vorzunehmen. (6) Alle beim Aufbau verwendeten Materialien müssen schwer entflammbar sein. (7) Die BW GmbH ist berechtigt, bei Verstößen gegen die genannten Gestaltungs- und Ausstattungsregelungen die notwendigen Änderungen und erforderlichenfalls die Entfernung des Standes zu verlangen. (8) Wird der entsprechenden schriftlichen Anforderung der BW GmbH nicht innerhalb von 24 Stunden Folge geleistet, kann die BW GmbH Änderung oder Entfernung des Standes auf Kosten des Ausstellers veranlassen. Im Falle der Schließung des Standes hat der Aussteller die volle Miete und die entstandenen Kosten zu tragen. (9) Bei doppelgeschossiger Bauweise wird für die begehbare Fläche (1. Etage) 50% des Mietpreises der Bodenfl äche berechnet. Eine zweigeschossige Bauweise kann nur im Einvernehmen mit der BW GmbH genehmigt werden. (10) Im Übrigen gelten die Technischen Richtlinien der BW GmbH bzw. des Messedienstleisters. 4.5 Standbaugenehmigung (1) Für alle Ausstellungsflächen besteht Antragspfl icht zur Errichtung eines Messestandes. Der Antrag ist der BW GmbH nach erfolgter Standzuweisung spätestens bis sieben Wochen vor Aufbaubeginn mit den Anlagen: a) Standgestaltungspläne (Grundriss/Ansichten im Maßstab 1:50); b) Baubeschreibung, Materialangaben in zweifacher Ausführung einzureichen. (2) Für besondere Standkonstruktionen in der Regel handelt es sich um zweigeschossige Stände ist die Bauerlaubnis innerhalb von Messe-und Ausstellungshallen spätestens sieben Wochen vor Aufbaubeginn mit den nachfolgenden Unterlagen bei der BW GmbH schriftlich zu beantragen: a) Bauantrag formlos; b) Baubeschreibung formlos; erforderlich sind insbesondere Angaben zum System, zur Konstruktion, Farbe, Einrichtung, Versorgung, Materialqualität (z. B. Brandschutzklasse); c) Bauzeichnungen, insbesondere Grundrisse, Schnitte, Ansichten, in der Regel im Maßstab 1:50 mit Vermaßung, evtl. Details in kleinerem Maßstab; d) Standsicherheitsnachweis (Statik) mit Positionsplänen, evtl. mit Prüfberichten oder vorliegenden Zulassungen. Die Beschreibungen und Berechnungen sind in deutscher Sprache und nach in Deutschland geltenden Normen zu erstellen. Alle Anträge, Pläne, Beschreibungen und Berechnungen sind vom Aussteller und Verfasser mit Tagesangabe urschriftlich zu unterzeichnen. (8) If the respective written request by BW GmbH is not obeyed within 24 hours BW GmbH can make changes or clear the stand at the exhibitor s cost. In the event of a closure of the stand the exhibitor shall bear the full rental and costs incurred. (9) For two-storey constructions 50% of the floor space rental fee shall be charged for the accessible area (1st floor). The authorisation of BW GmbH is required for a two-storey construction. (10) In all other matters the Technical Guidelines of BW GmbH or of the fair service provider shall apply. 4.5 Stand construction approval (1) An application for the erection of a trade fair stand is required for all exhibition areas. The application is to be submitted to BW GmbH after a stand has been assigned, at the latest seven weeks before start of construction with the following enclosures: a) Stand design plans (ground plan/elevation sketches on a scale 1:50); b) Building specification, material data in duplicate. (2) For special stand constructions these are generally two-storey stands the following documents are to be used to apply in writing to BW GmbH for a building permit within fair and exhibition halls at the latest seven weeks before the start of construction: a) Informal building application; b) Informal building specification; in particular data about the system, construction, colour, equipment, supply, material quality (e.g. fi re protection class) are required. c) Construction drawings, in particular ground plans, sections, elevation sketches, generally on a scale 1:50 with dimensioning, possibly details on a smaller scale. d) Proof of stand safety (statics) with position plans, possibly with test reports or approvals granted. The specifications and calculations are to be provided in German and according to German standards. All applications, plans, specifications and calculations must bear the original signatures of the exhibitor and the author, and the date. 4.6 Official authorisations and legal requirements The exhibitor has to apply for offi cial authorisations. He is responsible for ensuring that the GEMA regulations and the industrial, police, health and other legal requirements are observed, and in particular that the equipment safety law is enforced. 4.7 Construction and dismantling (1) The exhibitor is obliged to observe the time limits specified by BW GmbH for the construction and dismantling of the stand. (2) If the exhibitor has not started constructing the stand 12 hours before the opening of the event in the interests of the overall impression BW GmbH is entitled to relocate another exhibitor to the unoccupied stand or to occupy the stand in a different way. In this case the exhibitor shall pay the full participation fee including any additional services ordered and costs already incurred. In addition the decoration or occupation of the stand not used shall be at the exhibitor s expense. All claims for damages by the exhibitor shall be excluded. (3) Complaints about the location, type or size of the stand, which are not excluded under point 3.8, must be made in writing before the start of construction, at the latest one day after the start of construction specified by BW GmbH. (4) No stand may be partly or fully cleared before the end of the trade fair/ exhibition. Offending exhibitors shall have to pay a penalty of 50% of the stand rental. 9
