- 3 - Der Deutsche Anwaltverein (DAV) ist der freiwillige Zusammenschluss der deutschen Rechtsanwältinnen und Rechtsanwälte. Der DAV mit derzeit rund 66.000 Mitgliedern vertritt die Interessen der deutschen Anwaltschaft auf nationaler, europäischer und internationaler Ebene. Zusammenfassung Der DAV befürwortet die Schaffung und Vernetzung regionaler Register Europäischer Nachlasszeugnisse ebenso wie die Vernetzung nationaler Testamentsregister. Im Register Europäischer Nachlasszeugnisse sollen nur die Daten erfasst werden, die erforderlich sind, um zu klären, ob bereits ein Gericht oder eine andere zuständige Stelle, etwa ein Notar in einem anderen Mitgliedsstaat bereits seine Zuständigkeit für einen Nachlassfall bejaht und ein Europäisches Nachlasszeugnis erteilt hat. Zugang zum Register sollten die mit Nachlassverfahren befassten Gerichte und Notare sowie die anwaltlichen Vertreter Beteiligter solcher Verfahren erhalten. Durch die Vernetzung nationaler Testamentsregister dürfen keine Auskunftsrechte geschaffen werden, die die im Recht der Mitgliedstaaten vorgesehene Vertraulichkeit gespeicherter Daten verletzen würden. Auch die Schaffung eines elektronischen Europäischen Nachlasszeugnisses wird für sinnvoll erachtet. Zunächst sollten aber erste Erfahrungen mit den erst seit August 2015 anwendbaren Vorschriften über das Europäische Nachlasszeugnis in seiner jetzigen Fassung und dessen Akzeptanz gesammelt werden. Please provide any comments and suggestions you wish to make concerning the registration of the ECS and the interconnection of national ECS registers. As to questions 4 and 8, the DAV considers that an ECS register should be accessible for courts and notaries. Lawyers shall only have access to an ECS register where they can show a legitimate interest of their client. Regarding question 5 the DAV would like to stress, that an ECS can only be issued since August 2015 and practitioners so far have little experience with the procedure and acceptance of an ECS in other member states. The introduction of the ECS as an electronic instrument should not be rushed, experiences with Regulation (EU) No. 650/2012 should be taken into account. 15. Please provide any comments and suggestions you wish to make concerning the registration of dispositions of property upon death (including wills) and the interconnection of national registers of dispositions of property opon death (including will). Regarding question 9 the registration of dispositions of property upon death should be mandatory for wills which are deposited at courts or other competent authorities, such as notaries, as well as after reading the will ( Testamentseröffnung ). There shall be no mandatory registration for handwritten wills. Whether a will is legally valid, shall not depend on its registration. As to question 10 the DAV strongly opposes to include the content of the disposition in registers of dispositions of property (prior to and after the death of the testator). Concerning questions 11 and 13, the DAV considers that the access right to the register of dispositions should be restricted to the testator and the notary who represents the testator.
