1 This page contains information relating to the filing of Swiss (ornamental) design applications and is intended primarily for our foreign associates and patent agents Contact us: P&TS Ltd Tél Fax > Filing in Switzerland of a Swiss (ornamental) design application 5 easy steps for filing a design application in Switzerland: 1 Refer to our attached check-list, which you can also download 2 Send us your order by fax, mail or , using our attached order form if you wish 3 We will acknowledge receipt within 24 hours of receiving your order 4 If all requirements are met, we will file the application within 24 hours and in any case within the official deadline 5 The official certificate of registration is usually available within 15 workdays after filing A new Swiss Design Law was introduced on July 1, Under this law, the scope of protection granted has been considerably enlarged and the total period of protection has been extended to 25 years (previously 15 years), divided in 5-year terms, whilst the advantages of the former law, i.e. a fast, simple and relatively inexpensive procedure, have been retained. Kindly note that the Principality of Liechtenstein is not included in the territory of protection for Swiss designs. Furthermore, there are no provisions in the Swiss law for the protection of utility models. Procedure The procedure in Switzerland for designs is rather quick: we can file the application electronically and the first confirmation is received instantly from the Swiss authorities. If all the requirements are met and no deferral of the publication has been requested, the official certificate of registration will be issued within about 15 to 30 workdays from filing.multiple-design applications are possible in Switzerland (within the same class of the Locarno Classification), although the basic fee covers only one object in the design application. The overall costs for obtaining design protection in our country will also depend on the number of designs (i.e. objects) comprised in the application and on the total number of representations, as well as on publication in black-in-white vs. publication in colours. Annuities The basic filing fee covers the first 5-year period of protection. Renewal fees, amounting to approximately the filing fees (without publication fees), are due every five years until expiration of the total term of 25 years. GESCHÄFTSBEDINGUNGEN > EXTRAIT DES CONDITIONS GENERALES > EXTRACT FROM THE GENERAL CONDITIONS Patents & Technology Surveys AG (P&TS) ist bemüht, jeden angenommenen Auftrag so rasch wie möglich nach bestem Wissen und Können durchzuführen, in enger Zusammenarbeit mit dem Auftraggeber, der vollständige Angaben über den vorliegenden Fall liefert. P&TS nimmt den Auftrag an, unter Vorbehalt allfälliger Interessenskonflikte, von denen der Auftraggeber unmittelbar unterrichtet wird. Die Zahlung eines Vorschusses kann verlangt werden und eine Arbeitsaufnahme kann davon abhängig gemacht werden. Amtliche Mitteilungen werden in der Regel dem Auftraggeber mitgeteilt und Letzterer ist jederzeit berechtigt, in die Akte Einsicht zu nehmen sowie eine Kopie der Unterlagen zu verlangen. Der Auftraggeber prüft die Richtigkeit der ihm vorgelegten Dokumente; ohne Gegenbericht wird angenommen, dass er mit deren Inhalt einverstanden ist. Der Auftraggeber erteilt P&TS alle nötigen Weisungen so frühzeitig, dass die Arbeit mit der erforderlichen Sorgfalt durchgeführt werden kann. Werden Weisungen nicht rechtzeitig vor Fristablauf erteilt lehnt P&TS jegliche Haftung für eine Nichtbehandlung des Falls innert der gesetzten Frist ab. Für allfällige infolge verspäteten Weisungen entstandenen Rechtsverluste kann der Auftraggeber verantwortlich gemacht werden. Die Verpflichtung des Vertreters aus der Beibehaltung des Domizils beschränkt sich auf die Weiterleitung der eingehenden Mitteilungen. Mitteilungen an die Adresse, die vom Auftraggeber zuletzt bekannt gegeben wurde, gelten als rechtmässig zugestellt. Der Auftraggeber wird P&TS über alle Adressänderungen unterrichtet halten. Die vorliegende Vollmacht erlischt nicht ohne ausdrücklichen Widerruf. Ohne ausdrückliche gegenteilige Vereinbarung erlischt der Auftrag nicht beim Tod, bei eintretender Handlungsunfähigkeit und durch den Konkurs des Auftraggebers oder des Beauftragten. Gerichtsstand für alle Streitigkeiten aus dem der Vollmacht zugrunde liegenden Rechtsverhältnis ist Neuchâtel/Schweiz. Es gilt schweizerisches Recht. P&TS accepte le mandat sous réserve d éventuels conflits d intérêt dont le mandant serait aussitôt avisé. Le versement d une provision ou d une avance de frais peut être requis et pourra constituer une condition pour l acceptation d un mandat. Les communications officielles sont en principe communiquées au mandant qui est en droit d exiger en tout temps un état du dossier et une copie des pièces constitutives. Le mandant contrôle l exactitude des documents qui lui sont transmis; sauf avis contraire de sa part en temps utile, il est admis que celui-ci est en accord avec leur contenu. Le mandant fera parvenir à P&TS toute instruction utile suffisamment à l avance pour permettre à celui-ci d effectuer le travail avec le soin nécessaire. Lorsque les instructions ne sont pas reçues en temps utile avant l expiration d un délai, P&TS est dégagé de toute responsabilité pour nonexécution en temps utile et dans les règles. Le mandant peut être tenu responsable des pertes de droit occasionnées par l absence d instructions claires reçues à temps. L obligation pour le mandataire de maintenir le domicile est limitée à la transmission des communications reçues. Les communications faites à l adresse indiquée en dernier lieu par le mandant sont considérées comme légalement et valablement faites. Le mandant informera P&TS de toute changement intervenu dans ses coordonnées. Les pouvoirs ne s éteignent pas sans un retrait exprès. Sauf convention expresse contraire, le mandat ne s éteint pas avec le décès, l incapacité d agir en affaires ou la faillite du mandant ou du mandataire. Le for pour toute dispute quant à l interprétation de ces conditions ou des pouvoirs est à Neuchâtel/CH. Le droit suisse est applicable. Patents & Technology Surveys Ltd (P&TS) will make every effort to execute within the shortest possible time each mandate that has been accepted, to the best of their knowledge and possibilities, in close cooperation with the principal who will supply detailed information on the case at hand. P&TS accepts the mandate with the proviso of potential conflicts of interest of which the principal would immediately be notified. Payment of an advance on costs can be required and may constitute a condition for the acceptance of a case. Official communications are generally forwarded to the principal who may request at any time a full status report and a copy of all documents on file. The principal checks the papers submitted as to their accuracy; unless otherwise stated in due time, it is assumed that the principal is in agreement with their contents. The principal will provide P&TS with all needed instructions early enough so that the work can be carried out with all due care. If the instructions are not received in good time before expiration of a deadline, P&TS is relieved of all responsibility for not having dealt with the case in due time and according to official requirements. The principal can be held responsible for any loss of rights resulting from the absence of clear instructions received in time. The obligation for the attorney to maintain the domicile is limited to forwarding any communications received. Communications sent to the last address given by the principal are considered as having been legally and validly dispatched. The principal will inform P&TS of any change of particulars. The powers of attorney do not expire unless expressly revoked. Unless specifically agreed otherwise, the mandate is not relinquished because of the decease, incapacity to act in business or bankruptcy of the principal or of the attorney. The forum for any dispute arising in respect of this power is Neuchâtel/ Switzerland. Swiss law applies.
