3 Page 3 of 12 PART A Risk Management This document describes the acceptable use conditions required for extension of the registration of SpinTor containing Spinosad in Germany. The risk assessment conclusions are based on the already existing registration of the PPP. Assessments for the safe use of SpinTor have been made using endpoints agreed in the EU reviews of Spinosad. Appendix 1 of this document provides a copy of the final product authorisation in Germany. 1 Details of the application Application to extend the authorisation of a plant protection product (PPP) already authorised in Germany to minor uses not yet covered by that authorisation. In Germany the cultivated area of table and wine grape is about ha including a cultivated area of about ha of red grape vine (drosophila species). Approx ha of these ha need to be controlled. The cultivated area of grape vine (thrips) is about ha, of which approx ha need to be controlled. Calculation shows that authorisation holder will not profit from an authorisation of the requested uses. Upon this calculation and the examination of available alternative measures for the applied uses it can be stated that the applied uses is minor in nature and the authorisation is in the public interest. 1.4 Data protection claims No new studies were submitted. 1.5 Letters of Access As no new studies were submitted no letter of access is required. Authorisation holder agrees to the current application to extend the authorisation.

In addition, in an adjoining strip of at least 20 m, the product must be applied using loss reducing equipment which is registered in the index of 'Loss Reducing Equipment' of 14 October 1993 (Federal Gazette No 205, p. 9780) as amended, and be registered in at least drift reducing class 90 %. Neither loss reducing equipment nor a buffer zone of at least 5 m are required if the product is applied with portable plant protection equipment or if adjacent areas (field boundaries, hedges, groups of woody plants) are less than 3 m wide. A buffer zone of at least 5 m is also unnecessary if the product is applied in an area which has been declared by the Biologische Bundesanstalt in the "Index of regional proportions of ecotones" of 7 February 2002 (Federal Gazette no. 70 a of 13 April 2002), as amended, as agrarian landscape with a sufficient proportion of natural and seminatural structures, or if evidence can be shown that adjacent areas (e.g. field boundaries, hedges, groups of woody plants) were planted on agriculturally or horticulturally used areas. Uses NW607-1 When applying the product on areas adjacent to surface waters - except only occasionally but including periodically water bearing surface waters - the product must be applied with equipment which is registered in the index of 'Loss Reducing Equipment' of 14 October 1993 ('Bundesanzeiger' [Federal Gazette] No 205, p. 9780) as amended. Depending on the drift reduction classes for the equipment stated below, the following buffer zones must be kept from surface waters. In addition to the minimum buffer zone from surface waters stipulated by state law, the ban on application in or in the immediate vicinity of waters must be observed at all times for drift reduction classes marked with "*". If used properly and according to the intended conditions of use, adverse health effects for operators, workers, bystanders and residents will not be expected Residues and Consumer Exposure The residue behaviour of the active substance spinosad has been evaluated within the EU review process. Information about metabolism is sufficient to evaluate the intended use in grapes, utilisation as table and wine grape Residues The available residue information is sufficient to perform an adequate assessment. Residues that are expected from the intended use of the plant protection product will not exceed the MRL set in Regulation (EC) No 396/2005 for spinosad. Consumer exposure An assessment of residue uptake by consumers (IEDI calculation, EFSA PRIMo, based on WHO cluster diet B) results in 70 % ADI exhaustion. Long-term dietary intake of residues of spinosad is unlikely to present a public health concern for European consumers. No acute risk is expected from the consumption of grapes treated according to the intended use Environmental fate and behaviour No new studies on environmental fate and behaviour were submitted; all data were reviewed within the EU review for the active substance spinosad and the national authorisation procedure for the product SpinTor ( ), respectively, and assessed according to the uniform principles of Regulation (EU) No 546/2011.

11 Page 11 of 12 The environmental exposure due to the minor use extension applied for (spraying of vine) is covered by the uses already authorised in the same crop. Neither accumulation in soil nor leaching to groundwater of the active substance or relevant metabolites in concentrations above 0.1 µg/l has to be expected. Specific additional risk mitigation measures are not required Ecotoxicology No new studies on ecotoxicological effects were submitted; all data were reviewed within the EU review for the active substance spinosad and the national authorisation procedure for the product SpinTor ( ), respectively, and assessed according to the uniform principles of Regulation (EU) No 546/2011. The risk for non-target organisms as a consequence of the minor use extension applied for is considered acceptable since exposure due to the intended uses (spraying of vine) is covered by the uses already authorised in the same crop. Toxicity exposure ratios (TER) calculated for the exposure of aquatic organisms and terrestrial non-target arthropods via spray drift show for the field spray uses an acceptable risk only considering specific additional risk mitigation measures. For the uses in vine with 4 x 19.2 up to 76.8 g a.i./ha drift reducing technique and buffer zones have to be considered for the protection of aquatic organisms (90 % - 10 m, 75 % - 15 m) to achieve the required TER of 10 (relevant ecotoxicological endpoint: Daphnia magna 21 d NOEC = µg a.i./l). In addition drift reducing technique and buffer zones have to be considered for the protection of terrestrial off-crop non-target arthropods (90 % - 5 m) to achieve the required TER of 5 (relevant ecotoxicological endpoint: Typhlodromus pyri LR 50 = g a.i./ha, extended laboratory test on bean leaves, two dimensional exposure pattern). The product SpinTor as well as the active substance spinosad is very toxic to the aquatic environment. Therefore, additional labelling with risk phrases (NW262, NW264) and safety phrases (NW468) is assigned, particularly to encourage prevention of any point source entry into surface waters; see also chapter 2.2. Risk Assessment for Honeybees The honeybee risk assessment for the main application covers the use(s) in accordance with Article 51 of regulation (EC) No 1107/2009 (see also point 2.2) Efficacy Labelling in accordance with the requirements of ANNEX III General Principles of integrated pest management under directive 2009/128/EC (see also point 2.2): -The classification of effects on beneficial arthropods for the main application covers the uses applied for under the terms of Article 51 of regulation (EC) No 1107/ The categories and labelling for mode of action for the main application cover the uses applied for under the terms of Article 51 of regulation (EC) No 1107/2009. According to Article 51 of the regulation (EC) No 1107/2009 the requirements for approval concerning the sufficient effect and any unacceptable effects on plants and plant products not need to be checked.

12 Page 12 of Conclusions PPP SpinTor is already registered in Germany according to Directive 91/414/EEC taking into account the uniform principles of Annex VI. The intended use is minor in nature and the extension of authorisation is in public interest. Effects on bees and other beneficials were evaluated in the frame of the already authorised uses. No additional effects are anticipated because of the extension of uses(s). The indended uses in grapes, utilisation as table and wine grape, will not result in residues above the MRL of spinosad set in Regulation (EC) No 396/2005. A risk for consumers through the consumption of food with these residues of spinosad is not expected. There is no special risk mitigation necessary which deviate from the existing registration. Considering the minor use extensions applied for neither harmful effects on groundwater nor unacceptable effects on the environment have to be apprehended as a consequence of proper use consistent with good plant protection practice. Zusätzlich muss die Anwendung in einer darauf folgenden Breite von mindestens 20 m mit einem verlustmindernden Gerät erfolgen, das in das Verzeichnis "Verlustmindernde Geräte" vom 14. Oktober 1993 (Bundesanzeiger Nr. 205, S. 9780) in der jeweils geltenden Fassung, mindestens in die Abdriftminderungsklasse 90 % eingetragen ist. Bei der Anwendung des Mittels ist weder der Einsatz verlustmindernder

17 SEITE 5 VON 9 Technik noch die Einhaltung eines Abstandes von mindestens 5 m erforderlich, wenn die Anwendung mit tragbaren Pflanzenschutzgeräten erfolgt oder angrenzende Flächen (z. B. Feldraine, Hecken, Gehölzinseln) weniger als 3 m breit sind. Bei der Anwendung des Mittels ist ferner die Einhaltung eines Abstandes von mindestens 5 m nicht erforderlich, wenn die Anwendung des Mittels in einem Gebiet erfolgt, das von der Biologischen Bundesanstalt im "Verzeichnis der regionalisierten Kleinstrukturanteile" vom 7. Februar 2002 (Bundesanzeiger Nr. 70a vom 13. April 2002) in der jeweils geltenden Fassung, als Agrarlandschaft mit einem ausreichenden Anteil an Kleinstrukturen ausgewiesen worden ist oder angrenzende Flächen (z. B. Feldraine, Hecken, Gehölzinseln) nachweislich auf landwirtschaftlich oder gärtnerisch genutzten Flächen angelegt worden sind. Begründung: Das Pflanzenschutzmittel "SpinTor" bzw. der darin enthaltene Wirkstoff Spinosad besitzt ein hohes Gefährdungspotenzial für terrestrische Nichtziel-Arthropoden auf Nichtzielflächen. Der Wirkstoff Spinosad weist, entsprechend seiner Funktion als Insektizid, eine hohe Toxizität gegenüber Insekten auf. Die meisten vorliegenden Untersuchungen zu den Auswirkungen der Formulierungen "NAF-85" bzw. "GF-976" auf terrestrische Nichtziel-Arthropoden erlauben keine Ableitung von LR50-Werten auf der Grundlage von Dosis-Wirkungs-Beziehungen. Für Aphidius rhopalosiphi liegen derartige Untersuchungen aus einem Test unter erweiterten Laborbedingungen an Gerstensämlingen vor: LR50 = 18,48 g a.i./ ha (Mortalität). Auf Glasplatten (Laborversuch) wurde für diese Spezies bei Dosen von 40 bis 120 g a.i./ ha eine Mortalität von 100 % beobachtet. Die Indikatorart Typhlodromus pyri zeigte unter diesen Bedingungen (Dosen von 40 bis 320 g a.i./ha im Laborversuch) ebenfalls eine 100 %ige Mortalität. Mit Nachlieferung vom 15. März 2006 liegt auch für Typhlodromus pyri ein erweiterter Laborversuch (auf Bohnenblättern) vor, in dem eine LR50 von 0,3513 g ai/ha (Mortalität) abgeleitet wurde. Begründung: Das Pflanzenschutzmittel "SpinTor" bzw. der darin enthaltene Wirkstoff Spinosad besitzt ein hohes Gefährdungspotenzial für terrestrische Nichtziel-Arthropoden auf Nichtzielflächen. Der Wirkstoff Spinosad weist, entsprechend seiner Funktion als Insektizid, eine hohe Toxizität gegenüber Insekten auf. Die meisten vorliegenden Untersuchungen zu den Auswirkungen der Formulierungen "NAF-85" bzw. "GF-976" auf terrestrische Nichtziel-Arthropoden erlauben keine Ableitung von LR50-Werten auf der Grundlage von Dosis-Wirkungs-Beziehungen. Für Aphidius rhopalosiphi liegen derartige Untersuchungen aus einem Test unter erweiterten Laborbedingungen an Gerstensämlingen vor: LR50 = 18,48 g a.i./ ha (Mortalität). Auf Glasplatten (Laborversuch) wurde für diese Spezies bei Dosen von 40 bis 120 g a.i./ ha eine Mortalität von 100 % beobachtet. Die Indikatorart Typhlodromus pyri zeigte unter diesen Bedingungen (Dosen von 40 bis 320 g a.i./ha im Laborversuch) ebenfalls eine 100 %ige Mortalität. Mit Nachlieferung vom 15. März 2006 liegt auch für Typhlodromus pyri ein erweiterter Laborversuch (auf Bohnenblättern) vor, in dem eine LR50 von 0,3513 g ai/ha (Mortalität) abgeleitet wurde.
