Informativa ai sensi dell art. 13 D.Lgs. 196/03 Codice in materia di protezione dei dati personali Premessa A seguito della disciplina dettata dal D.Lgs. 196/03 Codice in materia di protezione dei dati personali (di seguito Codice ) la Osai A.S. S.r.l., quale Titolare del trattamento, è tenuta a fornire alcune informazioni riguardanti l utilizzo dei dati personali. Fonte dei dati personali I dati in nostro possesso, raccolti direttamente presso l interessato, saranno trattati nel rispetto della normativa vigente, e comunque, con la dovuta riservatezza. Finalità del trattamento La raccolta ovvero il trattamento dei dati personali ha l esclusiva finalità di provvedere in modo adeguato agli adempimenti connessi all espletamento dell attività economica della nostra società e in particolare per: - l adempimento degli obblighi contrattuali; - l adempimento di specifiche richieste dell interessato prima della stipulazione del contratto; - l esecuzione e l adempimento di obblighi previsti da leggi, regolamenti e dalla normativa comunitaria; - l adempimento di obblighi fiscali o contabili; - esigenze di tipo gestionale, operativo e di controllo affidabilità; - gestione del contenzioso. Modalità del trattamento In relazione alle indicate finalità, il trattamento dei dati personali avviene mediante strumenti manuali, informatici e telematici con logiche strettamente correlate alle finalità stesse e, comunque, in modo da garantire la sicurezza e la riservatezza dei dati stessi nel rispetto del Codice. Natura della raccolta La raccolta di alcuni dati personali ha anche natura obbligatoria dovendosi dare corso agli adempimenti di legge e fiscali ed il rifiuto di fornire tali dati comporterà l impossibilità di instaurare rapporti con la nostra società. Comunicazione e diffusione I dati personali ed il relativo trattamento sarà oggetto di comunicazione a società e/o consulenti esterni per lo svolgimento di attività economiche (commerciali, gestionali, raccolta informazioni economiche e finanziarie, gestione dei sistemi informativi, assicurative, intermediazione bancaria o non bancaria, factoring, gestione della spedizione, imbustamento e invio corrispondenza, gestione e tutela del credito) o per l assolvimento di norme di legge (studi commercialisti, notai, avvocati). I dati non saranno diffusi. Potranno venire a conoscenza dei Vostri dati le seguenti categorie di soggetti incaricati del trattamento: Sviluppo Processi; Sistema di Gestione Qualità Sicurezza Ambiente; Progettazione Meccanica; Progettazione e Costruzione Elettrica; Logistica e Controllo Qualità; Direzione Tecnica; Costruzione Meccanica; Controllo di Gestione; Assistenza Tecnica; Analisi e Sviluppo Software; Amministrazione e Personale; Acquisti. Diritti dell interessato L interessato potrà rivolgersi al Servizio Privacy presso il titolare del trattamento per verificare i propri dati e farli integrare, aggiornare o rettificare e/o per esercitare gli altri diritti previsti dall art. 7 del Codice (riportato in allegato). Art. 7 d.lgs. 196/03 (Diritto di accesso ai dati personali ed altri diritti) 1. L'interessato ha diritto di ottenere la conferma dell'esistenza o meno di dati personali che lo riguardano, anche se non ancora registrati, e la loro comunicazione in forma intelligibile. 2. L interessato ha diritto di ottenere l indicazione: a) dell origine dei dati personali; b) delle finalità e modalità del trattamento; c) della logica applicata in caso di trattamento effettuato con l ausilio di strumenti elettronici; d) degli estremi identificativi del titolare, dei responsabili e del rappresentante designato ai sensi dell articolo 5, comma 2; e) dei soggetti o delle categorie di soggetti ai quali i dati personali possono essere comunicati o che possono venirne a conoscenza in qualità di rappresentante designato nel territorio dello Stato, di responsabili o incaricati. 3. L interessato ha diritto di ottenere: a) l'aggiornamento, la rettificazione ovvero, quando vi ha interesse, l'integrazione dei dati; b) la cancellazione, la trasformazione in forma anonima o il blocco dei dati trattati in violazione di legge, compresi quelli di cui non è necessaria la conservazione in relazione agli scopi per i quali i dati sono stati raccolti o successivamente trattati; c) l'attestazione che le operazioni di cui alle lettere a) e b) sono state portate a conoscenza, anche per quanto riguarda il loro contenuto, di coloro ai quali i dati sono stati comunicati o diffusi, eccettuato il caso in cui tale adempimento si rivela impossibile o comporta un impiego di mezzi manifestamente sproporzionato rispetto al diritto tutelato. 4. L interessato ha diritto di opporsi, in tutto o in parte: a) per motivi legittimi al trattamento dei dati personali che lo riguardano, ancorché pertinenti allo scopo della raccolta; b) al trattamento di dati personali che lo riguardano a fini di invio di materiale pubblicitario o di vendita diretta o per il compimento di ricerche di mercato o di comunicazione commerciale. Information gemäß Art. 13 des ital. Gesetzelasses 196/03 Gesetz zum Schutz der personenbezogenen Daten Vorbemerkung Infolge der Bestimmungen laut Gesetzesverordnung 196/03 Datenschutzkodex (nachfolgend Kodex ) ist Osai A.S. S.r.l. als Dateninhaber verpflichtet, einige Informationen über die Verarbeitung der personenbezogenen Daten Ihres Unternehmens zu liefern. Quelle der personenbezogenen Daten Die in unserem Besitz befindlichen und direkt von der betroffenen Person übermittelten Daten werden unter Einhaltung der geltenden Gesetze und in jedem Fall mit der notwendigen Vertraulichkeit behandelt. Zweck der Datenverarbeitung Die Sammlung bzw. Verarbeitung der personenbezogenen Daten dient ausschließlich dem Zweck der angemessenen Durchführung der Geschäftstätigkeit unseres Unternehmens, insbesondere: - zur Erfüllung von Vertragspflichten; - zur Beantwortung spezifischer Anfragen der betroffenen Person vor dem Vertragsabschluss; - zur Ausführung und Erfüllung der Pflichten, die laut Gesetzen, Verordnungen und gemeinschaftlichen Vorschriften vorgesehen sind; - zur Erfüllung steuerlicher oder buchhalterischer Pflichten; - aufgrund von Anforderungen in Bezug auf Management, Betrieb und die Überprüung von Zuverlässigkeit; - zur Abwicklung von Streitsachen; Art der Datenverarbeitung Die Verarbeitung der personenbezogenen Daten zu den genannten Zwecken erfolgt manuell oder mit elektronischen und telematischen Hilfsmitteln auf Basis von Programmen, die eng mit eben diesen Zwecken verknüpft sind und in jedem Fall die Sicherheit und Vertraulichkeit der Daten laut Kodex garantieren. Art der Datensammlung Die Erfassung personenbezogener Daten ist in einigen Fällen außerdem verpflichtend, da sie zur Erfüllung gesetzlicher und steuerlicher Vorschriften notwendig ist. Bei einer Verweigerung der Bekanntgabe dieser Daten ist die Aufnahme von geschäftlichen Beziehungen zu unserem Unternehmen nicht möglich. Übermittlung und Verbreitung Die personenbezogenen Daten, sowie ihre Verarbeitung werden zur Durchführung wirtschaftlicher Tätigkeiten (geschäftlicher und verwaltungstechnischer Art, Sammlung von Wirtschafts- und Finanzdaten, Verwaltung von Computersystemen, Versicherung, Vermittlungstätigkeiten durch Banken und andere, Factoring, Versandabwicklung, Kuvertierung und Versendung von Korrespondenz, Kreditmanagement und Kreditschutz) oder zur Erfüllung gesetzlicher Vorschriften (Steuerberaterbüros, Notare, Rechtsanwälte) an externe Gesellschaften und/oder Berater übermittelt. Die Daten werden nicht verbreitet. Die im Folgenden genannten, mit der Datenverarbeitung betrauten Kategorien oder Personen können von Ihren Daten Kenntnis erhalten: Prozessentwicklung; Qualitäts-, Sicherheits- und Umweltmanagement; Mechanische Entwürfe; Elektrische Entwürfe und Konstruktionen; Logistik und Qualitätskontrolle; Verkaufsleitung und sekretariat; Controlling; Technischer Kundendienst; Softwareanalyse und entwicklung; Verwaltung und Personal; Einkauf. Rechte der betroffenen Person Daher sind im Falle Ihrer Zustimmung auch diese automatisch mit einbezogen. Zur Überprüfung, Ergänzung, Aktualisierung oder Berichtigung Ihrer Daten und/oder zur Ausübung aller sonstigen Rechte gemäß Art. 7 des Kodex (siehe Anhang) können Sie sich an den Datenschutzservice des Dateninhabers wenden. Art. 7 des ital.gesetzerlasses 196/03 (Recht auf Zugang zu den personenbezogenen Daten und sonstige Rechte) 1. Der Betroffene hat Anrecht auf Bestätigung des Vorhandenseins von ihn betreffenden personenbezogenen Daten, auch falls noch nicht registriert, sowie auf deren Mitteilung in verständlicher Form. 2. Der Betroffene hat Anrecht auf die folgenden Informationen: a) die herkunft der personenbezogenen Daten; b) die Zwecke und die Modalitäten der Verarbeitung; c) die angewendete Logik im Fall der Verarbeitung mit elektronischen Hilfsmitteln; d) die Daten zur Identifizierung des Rechtsinhabers, der Datenschutzbeauftragten sowie des ernannten Vertreters gemäß Art. 5, Absatz 2; e) der Subjekte oder Kategorien von Subjekten, denen die personenbezogenen Daten mitgeteilt werden können oder die in ihrer Eigenschaft als ernannte Vertreter im Staatsgebiet, verantwortliche oder Beauftragte in deren Kenntnis kommen können. 3. Der Betroffene hat Anrecht auf: a) das Aktualisierung, die Berichtigung oder falls in seinem Interesse die Vervollständigung der Daten; b) die Löschung, die Umwandlung in anonyme Form oder die Blockierung der gesetzwidrige verarbeiteten Daten, einschließlich derjenigen, deren Aufbewahrung nicht für die zwecke erforderlich ist, für die sie erfasst und anschließend verarbeitet worden sind; c) die Bescheinigung, dass die Operation der Punkte a) und b) auch hinsichtlich ihres Inhalts denjenigen zur Kenntnis gebracht worden sind, an die die Daten mitgeteilt oder weitergeleitet worden sind, mit Ausnahme des Falles, dass dies unmöglich ist oder zu einem Aufwand führt, den das geschützt Recht nicht rechtfertigt. 4. Der Betroffene hat das Recht, die Verarbeitung der personenbezogenen Daten vollständig oder teilweise zu widersprechen: a) aus gerechtfertigten Gründen, die mit dem Zweck in Zusammenhang stehen, für den die Daten erfasst wurden; b) für die Sendung von Werbematerial, für Direktverkaufmaßnahmen, für die Durchführung von Marktuntersuchungen oder für geschäftliche Mitteilungen. Policy statement in compliance with section 13 of Legislative Decree196/03 Data Protection Law Preamble In terms of the provisions of Law Decree 196/03 Data Protection Code (hereinafter referred to as the Code ), the Data Controller, Osai A.S. S.r.l., is bound to provide information about the use of personal details. Source of Personal Details The data we hold as directly received from the interested party, shall be processed in compliance with applicable law and with due confidentiality. Purpose of Processing The collection and processing of personal details shall be exclusively carried out to adequately meet the obligations related to the business activity of our company, particularly: - fulfilment of contractual obligations; - fulfilment of specific requests made by the interested person before conclusion of the contract; - the execution and fulfilment of the obligations provided by law, regulations and European regulations; - fulfilment of tax and fiscal obligations; - administrative, operational and reliability/solvency check requirements; - dispute management; Method of Data Processing The data processing for the above-indicated purposes is carried out using manual, computer and telematic instruments and the logic applied is such as to guarantee the security and confidentiality of the data in respect of the Code. Nature of the Data Collected The transmission of certain personal details is compulsory and required for the fulfilment of legal and fiscal obligations; our company shall not commence relations with any person who fails to provide this data. Communication and Dissemination The personal details and relevant processing may be transmitted to external companies and/or consultants for the performance of commercial activities (business, administrative, collection of economic and financial information, management of the computer systems, insurance, banking and non-banking intermediation, factoring, delivery management, mail processing and posting, credit management and protection) or for the fulfilment of legal obligations (accountants, notaries, lawyers). The details shall not be disseminated. The following persons responsible for the data processing may receive the data: Process Development; Environmental Safety Quality Management; Mechanical Design; Electrical Design and Construction; Logistics and Quality Control; Technical Management; Mechanical Construction; Management Control; Technical Assistance; Software Analysis and Development; Administration and HR; Purchasing. Rights of the Interested Party You may contact the Privacy Service offered by the data controller in order to verify personal details, make any additions, updates or amendments and/or to exercise the other rights provided by section 7 of the Code (quoted as an Appendix to this document). Section 7 of Legislative Decree 196/03 (Right to access personal data and other rights) 1. The data subject shall have the right to obtain confirmation as to whether or not personal data concerning them exist, regardless of such data being recorded, and to communication of said data in an intelligible form. 2. The data subject shall have the right to be informed: a) of the source of the personal data; b) of the processing aims and methods; c) of the logic applied to processing, if this latter is carried out using electronic means; d) of identification details concerning the data controller, data processors and representative, designated as per Section 5, subsection 2; e) of the entities or categories of entity to whom or which the personal data may be communicated and who or which may get to know said data in their capacity as designated representative/s within the State, or person/s in charge of processing. 3. The data subject shall have the right to obtain: a) updating, rectification or where interested, integration of the data; b) the deletion, anonymisation or blocking of data that have been processed unlawfully, including data the storage of which is unnecessary for the purpose for which they were collected and subsequently processed; c) certification to the effect that the operations, as stated in letters a) and b) have been made known, including as regards their content, to those entities to whom or which the data were communicated or disseminated, unless this is impossible or requires a manifestly disproportionate effort compared with the right being protected. 4. The data subject shall have the right to object, wholly or in part: a) on legitimate grounds, to the processing of personal data concerning them, even though such data are relevant to the purpose of their collection; b) to the processing of personal data concerning them for the purpose of sending advertising material or direct selling or else for the purpose of performing market research or commercial communication surveys.
