10 US Workers Compensation Workers Compensation is insurance that provides cash benefits and/or medical care for workers who are injured or become ill as direct result of their job Mandatory No-fault (regardless of negligence) Employers pay for this insurance Benefits vary state to state Provides weekly cash benefits Unlimited medical care Exclusive remedy Auditable Exclusive Remedy Every state WC law includes an exclusive remedy provision that stipulates that the benefits prescribed in the act are the sole remedy of covered injured employees against the employer However, most states allow law suits against the employer if the employer is subject to the act but has failed to purchase WC insurance, or when the employee`s injury was intentionally caused by the employer 10
