The three standard-setting bodies referenced in the SPS Agreement Food Safety and Food Quality - Codex Alimentarius (185 - EU/GER, 234 observers) Animal health - OIE (Office International des Epizooties) (180 - GER/EU is guest) Plant Health - IPPC (International Plant Protection Convention) (182 - EU/GER) The Agreement names the joint FAO/WHO Codex Alimentarius as the relevant standard-setting organization for food safety (represents > 99% of world s population) Seite 8

10 1992 International Conference on Nutrition Recognized that: Access to nutritionally adequate and safe food is a right of each individual. and that Food regulations should fully take into account the recommended international standards of the Codex Alimentarius Commision Agreement on the Application of Sanitary and Phytosanitary Measures and Agreement on Technical Barriers to Trade Formally recognized: International standards, guidelines and recommendations, including the Codex Alimentarius, as reference points for facilitating international trade and resolving trade disputes in international law. 14 CCMAS - 1 CCMAS Codex Committee on Methods of Analysis and Sampling (terms of reference) (a) to define the criteria appropriate to Codex Methods of Analysis and Sampling; (b) to serve as a coordinating body for Codex with other international groups working in methods of analysis and sampling and quality assurance systems for laboratories; (c) to specify, on the basis of final recommendations submitted to it by the other bodies referred to in (b) above, Reference Methods of Analysis and Sampling appropriate to Codex Standards which are generally applicable to a number of foods; (d) to consider, amend, if necessary, and endorse, as appropriate, methods of analysis and sampling proposed by Codex (Commodity) Committees, except that methods of analysis and sampling for residues of pesticides or veterinary drugs in food, the assessment of micro biological quality and safety in food, and the assessment of specifications for food additives, do not fall within the terms of reference of this Committee; (e) to elaborate sampling plans and procedures, as may be required; (f) to consider specific sampling and analysis problems submitted to it by the Commission or any of its Committees; and, (g) to define procedures, protocols, guidelines or related texts for the assessment of food laboratory proficiency, as well as quality assurance systems for laboratories. 22 Private Food Standards (PFS) - 1 spielen eine immer wichtigere Rolle, wenn es darum geht, Zugang zu internationalen Märkten zu bekommen es werden Lebensmittelsicherheit, Lebensmittelqualität und Umweltaspekte angesprochen die Kette wird von der Produktion bis zum Marketing abgebildet private Standards sind nicht an die SPS-Abkommen gebunden Entwicklungsländer haben Sorge, dass die gesetzlich beschlossenen Standards der Codex Alimentarius Commission (CAC) unterlaufen werden Industrieländer argumentieren, dass mit diesen Standards die Wirtschaft ihrer Verpflichtung nachkomme, nur sichere und gute Lebensmittel zur Verfügung zu stellen Seite 22

24 Private Food Standards (PFS) - 3 Bedenken der Entwicklungsländer die wissenschaftliche Grundlage der Anforderungen zur Lebensmittelsicherheit und deren Übereinstimmung (ja oder nein) mit den Standards des Codex Alimentarius ist nicht leistbar Zwang zur Übernahme detaillierter Regelungen, wenn der PFS etabliert werden soll Zertifizierungskosten (zu teuer) Einfluss der PFS auf den Zugang zum Markt sowie auf die öffentliche Gesundheit die (monetären) Ziele der Interessenvertreter an den PFS die Sorge, dass die PFS die behördlichen Standards unterlaufen könnten Keine Anwendung von proprietary methods Seite 24

26 Ausblick mehr Transparenz und bessere Kommunikation bessere Zusammenarbeit zwischen Wirtschaft und Behörden die Sorgen der Entwicklungsländer ernst nehmen den Auf- und Ausbau von wissenschaftlichen und technischen know-how, von Produktionskapazitäten sowie den Auf- und Ausbau von Managementund Kontrollsystemen zur Lebensmittelsicherheit in den Entwicklungsländern fördern schnellere Implementierung von Codex Standards (für Produktion, Handel und Kontrolle) als Voraussetzung für den Abgleich mit PFS Lebensmittelsicherheit als öffentliches Gut ist Voraussetzung für Lebensmittelqualität der Markt allein liefert nicht das gesellschaftlich gewünschte Maß an Lebensmittelsicherheit Methodensammlungen und Normung als Grundlage für die Vergleichbarkeit von Messergebnissen fördern Seite 26
