Prinzipien des Art. 5 Verfahrens Zulassungsinhaber (MAH) und Behörden können vor Einreichung einer Variation den CMDh/v (für MRP/DCP) oder die Agentur (EMA) um Empfehlung für eine Klassifizierung bisher nicht klassifizierter Änderungen zu bitten Empfehlung von CMDh, CMDv oder EMA innerhalb von 45 Tagen Abstimmung der Empfehlungen zwischen CMDh/CMDv/EMA Kommission (EC) von Anfang an beteiligt Empfehlung nur für Klassifizierung kein (pre)-assessment Veröffentlichung der Empfehlungen auf CMDh oder CMDv oder EMAwebsite mit gegenseitigem Link zu den Empfehlungen Kommission soll auf Basis der Empfehlungen regelmäßig die Classification Guideline ergänzen 2/15
Unforeseen Variations vs. foreseen Typ IB A variation is considered unforeseen when: the proposed variation is not considered a minor variation of Type IB following the Commission classification Guideline, or has not been classified as a Type IB variation in an Article 5 recommendation. Antragformular, Fußnote 2 Foreseen Type IB variations are those variations which: listed as examples of Type IB in the Classification Guideline are recommended to be Type IB following an Article 5 procedure are listed as Type IA but do not meet all of the conditions set-out in the Guideline and they are not listed as Type II variations in the Classification Guideline. Erfahrungen (1) Bisher (in 2010) 17 Art. 5 Anfragen eingegangen 70 % der Anfragen von Firmen bei > 60 % der bearbeiteten Anfragen vorgeschlagene Einstufung bestätigt Anfragen betreffen überwiegend Änderungen zur Qualität, aber auch Änderungen der SmPC, User test Anfragen z.t. keine unforeseen-variations, sondern aus dem Annex II der Variation Regulation bzw. der Classification Guideline ableitbar 8/15
Bisherige Erfahrungen (2) Press release April CMDh: Marketing Authorisation Holders are reminded that the classification guideline should be carefully checked before a request for classification in accordance with Art. 5 is sent to the CMDh. The CMDh would remind applicants that the default position is a type IB variation. Attention is drawn to the text in the Commission Guideline When one or more of the conditions established in the Annex to this Guideline for a minor variation of type IA are not met, the concerned change may be submitted as a type IB variation unless the change is specifically classified as a major variation of type II. 9/15

Fazit Die Möglichkeit des Art. 5 Verfahrens wird zunehmend von Firmen und Behörden genutzt zur Klärung produktspezifischer Klassifizierungen zur grundsätzlichen Klärung bei wiederkehrenden Änderungen offizielle, abgestimmte und veröffentlichte Empfehlung damit größere Handlungssicherheit in den Verfahren Prüfung der Type IB by default Möglichkeit vor Art. 5 Anfrage 12/15
