4 K-79 3 rd European Conference Cohesion Fund BACKGROUND With a budget of 347 billion the EU s Cohesion Policy represents the second strongest policy in terms of financial weight after Common Agriculture Policy. The European Commission estimates that cohesion instruments could boost growth in the new Member States as well as in Spain, Greece and Portugal by 6% on average thereby creating two million new jobs. By reforming cohesion policies in the present programming period, structural actions are better targeted at the EU s strategic priorities (Lisbon and Gothenburg agendas) as well as following a more decentralised approach. In association with ERDF, the Cohesion Fund aid significantly contributes to regional development. To benefit from the 69.6bn Euros that have been made available for funding, Member States need to implement efficient programme management. After installing coherent regulations on funding and establishing extensive management systems on a European level, it is a task for Member States to implement these structures and thus fulfil the joint effort with regional content. Decision-Making Processes and Principles BACKGROUND The EU legislation has made considerable changes to the substantive law effect in the EU Member States and has a decisive impact on many national legislative acts. As the EU has constantly been in a state of evolution, the decision making processes have been continously developed as well. In order to be prepared for new decisions by EU institutions, public officials dealing with EU affairs need to know how the decision making processes are structured and how exactly is the interplay among intergovernmental and supranational actors. Furthermore, they need to be familiar with the process of how the European Community legal order operated within the legal and economic system of the Member States. 6 S-169 Interactive European Seminar How to Monitor and Evaluate Communication of EU Funds BACKGROUND The structural funds regulations as well as agricultural funds regulations require a communication plan including subsequent strategy which outlines aims, target groups, content, budget, responsible authorities and criteria for evaluation. EU funds communication activities have to be evaluated on a regular basis and to be revised if needed. For this, the responsible body should be able to adjust and optimise the plan and measures implemented. Difficulties arise as the process of evaluating communication is only slowly becoming more concrete as a tool itself. This lack is in startling contrast with the extent to which communication actions have increased. BACKGROUND Although the waste treatment is in first instance a national responsibility of each EU Member State, the shipment of waste between EU Member State as well as import from and export to third countries has become strictly regulated by EU law. The European legislation determines the overall procedural framework, makes demands on notification, conclusion of contracts and financial guarantees and sets the conditions for shipment. Public authorities, waste companies and industrial producers are facing several difficulties in the implementation of the European rules in the practice. Public authorities have to control and prevent illegal waste shipments. For many waste management and industrial companies transboundary shipment is becoming essential for the future existence on the European market. 8 Practical Seminar Certifying Authority s New Roles and Requirements S-171 BACKGROUND As the role of the certifying authority has been strengthened remarkably, employees and officials working in certifying authorities face new challenges. TARGET GROUP Certifying authorities Other intermediate bodies designated to carry out tasks of the certifying authority The certifying authority is now the Commission s guarantee of assurance. It has to guarantee that the statements of expenditure are accurate, result from reliable accounting systems and are based on verifiable supporting documents. Furthermore, it ensures the compliance of expenditure with Community and national regulations. The certifying authority is responsible that the amounts recovered are reimbursed to the general budget of the European Union. To meet the new requirements, certifying authorities need well skilled and persistent officials able to examine the expenditures reported by the managing authorities and intermediate bodies. Officials need to be able to assess the effective functioning of management and control systems as well as the logic of audit trails and the quality of auditing results by the managing and audit authorities. They need to assure by stand alone auditing actions that the controls are suitable and sufficient to serve as a basis to certify the expenditures. 12 S-195 European Seminar Technical Assistance under ESF, ERDF and EAFRD BACKGROUND Technical Assistance is part of all structural and agricultural funding. As such it is part of every Operational Programme. The structural funds regulation as well as the agricultural regulations only broadly specifies Technical Assistance. As a result organisational structures and use of Technical Assistance can be quite different in each Member State. The essential aims of Technical Assistance, however, stay the same. The Technical Assistance s global objective is to strengthen and improve the management, coordination and monitoring of programmes that are cofinanced by EU funds. Technical Assistance is generally the smallest part of all Operational Programmes, but plays an important role because of its impact on administrative capacities. Each Member State can set its own priority axes for Technical Assistance according to what is needed and what improvements are necessary. Nevertheless, key skills for programme management need to be acquired by every Member State s Technical Assistance unit in order to prevent a loss or waste of funding. Further, the development of Technical Assistance Strategies, as has been done by some Member States, facilitates a more efficient and effective use of the limited funding available under Technical Assistance. 13 S-180 European Seminar State Aid Rules in Practice BACKGROUND Support for SMEs or large companies granted by national or local governments of the Member States are running the risk of violating EU State Aid rules. This support is in principle forbidden by the European Community Treaty. The purpose of State aid control is, to ensure that state interventions do not distort competition and intercommunity trade. Therefore, the European Community has developed an elaborate system of rules and procedures to prevent public authorities from using state aid to support industries and offering unfair incentives to attract mobile capital. The state aid rules are important for all organisations providing and receiving business support of any kind. The EU Commission is very accurate in controlling this field of its competences. TARGET GROUP This seminar is of particular interest to practitioners applying for state aid and to decision makers implementing state aid schemes. Private and public companies National, regional and local authorities responsible for finance and economy Banks Lawyers & Consultancy Firms State aid is defined as an advantage in any form whatsoever conferred on a selective basis to undertakings by national public authorities. This very wide definition causes a high risk, especially for the beneficiaries of support. In case of violation, commission can order the recovery of unlawful state aid, which might result in drastic consequences for the company, which received it. 14 K-84 5 th European Annual Symposium: EU Funds 2010 TOPIC The simplification of EU funding procedures and faster implementation of Operational Programmes has developed to be a relatively controversial topic. On the one hand improvements will be achieved by making requirements clearer and processes more transparent. On the other hand the introduction of new requirements or changes of procedures will also entail a restructuring and reorganisation of processes which by now although complicated might actually be working well. The question remains, how can simplification really simplify procedures and ease the administrative burden on all parties involved? Was ist bei der Auswahl der privaten Partner zu beachten? Welche vergaberechtlichen Vorgaben sind bindend? Welche Regelungsaspekte spielen eine Rolle? Im deutschen Vergaberecht gibt es keine speziellen IT-Regelungen. In Betracht kommen grundsätzlich VOF und VOL/A, für die genaue Bestimmung bedarf es aber einer Betrachtung des Einzelfalles. Zu den nationalen Fördermitteln treten fast immer und in großem Umfang EU-Mittel.
